Book excerpt: PERBACCO (a free Italian acronym for Life-cycle Performance, Innovation and Design Criteria for Structures and Infrastructures Facing Æolian and Other Natural Hazards) is a research project partly funded by the Italian Ministry for University (MIUR) in the PRIN (Progetti di Ricerca di Interesse Nazionale) framework, for the years 2004-05.Within the project, a first attempt has been made to integrate different disciplines aiming at an overall optimization of the performance of a wide range of wind exposed structures and infrastructures, with consequent benefi cial impact on the society.The overall objectives were (a) to provide unifi ed concepts for "expected performance" and "risks induced by æolian and other natural hazards", to be applied to structures and infrastructures over their whole life-cycle, such to be acceptable to stakeholders in the construction process (i.e. from the owner to the end-user), (b) to provide models and methodologies for dynamic monitoring of the performance of structures and infrastructures, to be integrated in appropriately designed procedures, and (c) to collect, refi ne, fi le and disseminate the knowledge available on a European basis, concerning the performance of wind-exposed structures and facilities, in a way such to be of use to Construction Industry. This volume summarises the main results obtained during the Project, with each Section addressing a different class of problems, to which many research Units have contributed. A list of papers containing the main results of the research activities carried out within the Project is also provided in each Section.

He reveals the interdependent relationship between economic theory and law that existed in these decades of headlong growth and examines how this relationship shaped both the modern business corporation and substantive due process. Classical economic theory--the cluster of ideas about free markets--became the guiding model for the structure and function of both private and public law. Hovenkamp explores the relationship of classical economic ideas to law in six broad areas related to enterprise in the nineteenth and early twentieth centuries. He traces the development of the early business corporation and maps the rise of regulated industry from the first charterbased utilities to the railroads. He argues that free market political economy provided the intellectual background for constitutional theory and helped define the limits of state and federal regulation of business behavior. The book also illustrates the unique American perspective on political economy reflected in the famous doctrine of substantive due process. Finally, Hovenkamp demonstrates the influence of economic theory on labor law and gives us a reexamination of the antitrust movement, the most explicit intersection of law and economics before the New Deal. Book excerpt: Neoliberalism has been studied as a political ideology, an historical moment, an economic programme, an institutional model, and a totalising political project. Yet the role of law in the neoliberal story has been relatively neglected, and the idea of neoliberalism as a juridical project has yet to be considered. That is: neoliberal law and its interrelations with neoliberal politics and economics has remained almost entirely neglected as a subject of research and debate. This book provides a systematic attempt to develop a holistic and coherent understanding of the relationship between law and neoliberalism. It does not, however, examine law and neoliberalism as fixed entities or as philosophical categories. And neither is its objective to uncover or devise a ‘law of neoliberalism’. Instead, it uses empirical evidence to explore and theorise the relationship between law and neoliberalism as dynamic and complex social phenomena. Developing a nuanced concept of ‘neoliberal legality’, neoliberalism, it is argued here, is as much a juridical project as a political and economic one. And it is only in understanding the juridical thrust of neoliberalism that we can hope to fully comprehend the specificities, and continuities, of the neoliberal period as a whole.

Book excerpt: Obiettivo del presente lavoro è illustrare i risultati di una ricerca condotta sulle società italiane che per prime hanno scelto di adottare i principi contabili internazionali (IAS/IFRS) nella redazione dei propri conti annuali. In particolare, si documentano le determinanti e le conseguenze dell’adozione volontaria dei principi contabili internazionali nel rendiconto annuale, non consolidato. I risultati delle analisi condotte mostrano che i costi connessi alla transizione ad un nuovo set di principi contabili appaiono compensati dalla semplificazione amministrativa provocata dall’adozione degli IAS/IFRS da parte di società controllate da soggetti obbligati all’adozione degli standard internazionali. Al di fuori di questa circostanza, la scelta di adottare i principi citati sembra essere determinata più dalle richieste di soggetti esterni (investitori istituzionali) o dalla scelta dell’azionista di riferimento, che dall’ottenimento di vantaggi legati alla maggiore trasparenza informativa. Per quanto riguarda l’impatto dell’adozione sulla qualità dei dati contabili, vi è evidenza di un incremento dell’utilizzo di politiche di bilancio, insieme ad una riduzione della tempestività di riconoscimento delle perdite a seguito dell’adozione dei principi contabili internazionali. Poiché la letteratura precedente ha evidenziato che la struttura proprietaria può avere un’influenza significativa sulla qualità dei dati contabili, si sono anche studiati gli effetti dell’adozione degli standard internazionali sulle imprese familiari (family firm). I risultati delle analisi condotte indicano che l’effetto dell’adozione dei principi contabili internazionali non è omogeneo tra family e non family firm. L’impatto complessivo sembra essere peggiore nel caso delle family firm.
