But not only this: Africa is at the same time emerging as one of the great laboratories for novel forms of social, economic, political, intellectual, cultural, and artistic life. Often arising in unexpected places, these new forms of life materialize in practices that draw deeply from collective memory while simultaneously assuming distinctly contemporary, even futuristic, guises. In November 2017, the second session of the Ateliers de la pensée – Workshops of Thought – was held in Dakar, Senegal. Fifty African and diasporic intellectuals and artists participated and their debates unfolded along numerous thematic lines, approached from the standpoints of many different disciplines. This volume is the result of that encounter. Among the many topics discussed were the concurrence and entanglement of multiple temporalities, the politics of life in the Anthropocene, the project of decolonization, and the preservation and transmission of different ways of knowing. At a time when the world is haunted by the specter of its own end, the contributors to this volume ask whether one can, by taking Africa as a point of departure, seize hold of other options for the future – not only for Africa, but for the world. The Politics of Time and its companion volume, To Write the Africa World, will be indispensable works for anyone interested in Africa – its past, present, and future – and in the new forms of critical thought emerging from Africa and the Global South.

Book excerpt: European private international law is by now based mainly on a large body of uniform rules such as the Regulations Rome I, Rome II, Brussels I, Brussels I bis. This significant legislative output, however, does not take place in a vacuum. Rules of private international law have been earlier (and still are) adopted at national, international and even European level in scattered regulations and directives. The recent plethora of private international law rules gives rise to issues of delineation and calls for some sort of ordering as gaps, overlaps and contradictions become flagrant. At the same time, the resulting interactions can offer new insight, ideas and even opportunities at a more theoretical level. This book gathers a collection of essays resulting out of a series of international seminars held in Lyon, Barcelona and Louvain-la-Neuve. During those seminars, young researchers selected in an open call for papers had the opportunity to discuss their views among themselves as well as with various specialists of the field, such as more senior academics, EU civil servants, national experts and representatives of other international organisations. The book offers the fresh views of those who will in the future shape the dialectic between the various sources of private international law and attempts to launch a discussion on the “living together” of legal sources. Two ranges of topics are addressed in the book: - firstly, the relationship between EU private international law and national law (substantial and procedural) and/or international law (international instruments of private international law or of uniform substantive law); and - secondly, the relationship between EU private international law and other aspects of EU law (internal market rules of primary law, harmonisation through secondary law and other pieces of legislation enacted in the realm of the area of freedom, security and justice).

Filiation is a multifaceted concept in Muslim jurisdictions. Beyond its legal aspect, it encompasses the notion of inclusion and belonging, thereby holding significant social implications. Being the child of someone, carrying one’s father’s name, and inheriting from both parents form important pillars of personal identity. This volume explores filiation (nasab) and alternative forms of a full parent-child relationship in Muslim jurisdictions. Eleven country reports ranging from Morocco to Malaysia examine how maternal and paternal filiation is established – be it by operation of the law, by the parties’ exercise of autonomy, such as acknowledgement, or by scientific means, DNA testing in particular – and how lawmakers, courts, and society at large view and treat children who fall outside those legal structures, especially children born out of wedlock or under dubious circumstances. In a second step, alternative care schemes in place for the protection of parentless children are examined and their potential to recreate a legal parent-child relationship is discussed. In addition to the countr y-specific analyses included in this book, three further contributions explore the subject matter from perspectives of premodern Sunni legal doctrine, premodern Shiite legal doctrine and the private international law regimes of contemporary Arab countries. Finally, a comparative analysis of the themes explored is presented in the synopsis at the end of this volume. The book is aimed at scholars in the fields of Muslim family law and comparative family law and is of high practical relevance to legal practitioners working in the area of international child law. La lecture du droit positif à travers la grille des principes directeurs révèle deux tendances opposées : une réalisation des principes à finalité internationale, un refoulement de ces principes par les principes à finalité interne. Ce tiraillement entre deux logiques antinomiques appelle un délicat jeu d'équilibre. Cette étude se propose de découvrir dans les principes directeurs du droit international privé l'instrument de cet équilibre.

The modern state governs in the name of a people defined in ethnic and national terms. Democratic participation, equality before the law and protection from arbitrary violence were offered only to the ethnic group in a privileged relationship with the emerging nation-state. Depending on circumstances, the dynamics of exclusion took on different forms. Where nation building was successful , immigrants and ethnic minorities are excluded from full participation; they risk being targets of xenophobia and racism. In weaker states, political closure proceeded along ethnic, rather than national lines and leads to corresponding forms of conflict and violence. In chapters on Mexico, Iraq and Switzerland, Wimmer provides extended case studies that support and contextualise this argument.
