Book excerpt: O presente trabalho tem por finalidade desenvolver o Direito Processual Penal de forma contextualizada, de modo a permitir ao leitor uma visão concatenada do Processo Penal com os demais ramos do direito. Assim, pretende-se analisar o atual panorama doutrinário e jurisprudencial da matéria à luz do arcabouço jurídico-constitucional, sistematizando assim a análise do CPP atual com o projeto que visa substituí-lo. A obra é intitulada como fundamental por dois motivos, primeiramente porque se busca uma abordagem do processo penal como resultado da aplicação do que a doutrina denomina de filtragem constitucional (entendendo a Constituição como ápice do sistema, fundamento de validade de todas as demais normas) e, em segundo lugar, porque se apresentam os temas de modo objetivo, de forma a enfatizar os pontos mais relevantes da matéria e os que apresentam interdisciplinaridade. Com inserções comparativas do texto atual e do texto do projeto do novo CPP, pretende-se apresentar um processo penal moderno e um processo penal em perspectiva. Reescrita após a edição do CPC de 2015, a obra propõe um diálogo de fontes que respeite a natureza do processo penal, promovendo estudo legislativo, doutrinário e jurisprudencial integrado com o Direito Constitucional, Direito Penal, Criminologia e com outras ciências processuais, tais como o direito processual penal militar e o direito processual civil.

Book excerpt: Apesar de ser constante o debate acerca dos princípios processuais penais, nem tanto se fala em sua fundamentação constitucional e como tal enlace se desdobra no curso do processo penal brasileiro. Nesta senda, pouco também se discute sobre o diálogo do Direito Internacional dos Direitos Humanos com esta seara, haja vista que, majoritariamente, só os tribunais superiores debatem com maior frequência sobre eventuais aplicações e entendimentos de tratados internacionais para com o direito processual penal especificamente. Neste ínterim, este trabalho se propôs a explanar sobre os princípios processuais penais constitucionais brasileiros e denotar seu desembrulhar no âmbito dessa matéria. Tal análise será realizada sob a ótica do Direito Internacional dos Direitos Humanos, demonstrando como tais tratados possuem incidência – seja ela direta ou indireta – no ordenamento nacional na área em apreço. Como metodologia, utilizou-se estudo bibliográfico e jurisprudencial, majoritariamente do Supremo Tribunal Federal – STF, para analisar a incidência dos princípios em testilha com o enfoque de influência do direito internacional dos direitos humanos. No que concernem os resultados, verificou-se que os desdobramentos dos princípios em apreço permeiam todo o processo, alguns até mesmo a fase inquisitorial da investigação policial, atuando, assim, como verdadeiros primados que guiam o processo penal brasileiro.

Book excerpt: A reflection on the limits of the construction of judicial decisions from the Edenic Myth Having as its central element the rhetorical analysis of the Edenic myth (Gen. 2 and 3), this dissertation addresses the strength that such narrative has had to forge, both in the West and in the East, a behavior of submission and passivity in the face of authorities that place themselves in the power. It sees, however, also present in the text, an invitation to abstain from the practice of judgments of moral behavior (ignoring good and evil), which is presented as a task of God and not of men. These, according to the author, when they set out to pronounce sentences in relation to their peers, end up expressing prejudices, which are established in society through mechanisms of symbolic violence. At the end, the author, faced with the practical and immediate impossibility of a way of social coexistence without the structures of power and control, among which the judiciary stands out, inviting us to adopt a humbler and fraternal posture when the moment of the decision, with the aim of mitigating the effects of the potential and actual brutality that the sentences tend to carry out.
