This book was released on 2012-02-22 with total page 86 pages. Available in PDF, EPUB and Kindle. Book excerpt: When a person goes missing their family can suffer serious financial repercussions, as well as inevitable pain and distress. Having examined the law and processes the Committee have found that such suffering is exacerbated by: a legislative patchwork of bewildering complexity; the inability to administer the financial situation of their missing relatives; a lack of information about the actions they are able to take; and ignorance of the correct procedures to be followed by police, lawyers, banks, insurers and others. This report puts forward a threefold recommended approach. Firstly, the introduction of a presumption of death act to clarify the legal position. Such an act should be modelled on the legislation in Scotland and Northern Ireland. Presumption of death orders, however, can only solve some of the problems families face. It will only be appropriate to declare a missing person dead several years after their disappearance. In that time, their financial affairs can be devastated beyond hope of recovery. The Committee also therefore recommends that legislation be introduced to allow for a system of guardianship orders, similar to those in Australia. These will allow for the administration of the missing person's property in his or her best interests if they have not returned after three months, as well as support for dependents. Finally, they call on the Government and industry to provide effective guidance for families in very difficult and distressing circumstances, as well as those who provide services for them.

Book excerpt: A missing person is an individual whose whereabouts are unknown and where there is some concern for his or her wellbeing. In the UK, around 250,000 people are reported missing every year, with the majority being children under the age of 18. Despite the fact that missing persons are a social phenomenon which encompasses vast areas of interest, relatively little is known about those who go missing, what happens to them while they are missing, and what can be done to prevent these incidents from occurring. This groundbreaking book brings together for the first time ideas and expertise across this vast subject area into one interconnected publication. It explores the subjects of missing children, missing adults, the investigative process of missing person cases, and the families of missing persons. Those with no prior knowledge or professionals with focused knowledge in some areas will be able to expand their understanding of a variety of topics relevant to this field through detailed chapters which advance our understanding of this complex phenomenon, discuss what is unknown, and suggest the best and most important steps forward to further advance our knowledge.

Available in PDF, EPUB and Kindle. Book excerpt: This textbook presents an engaging and thorough examination of the law in Northern Ireland. It guides students through the evolution of law-making, the legislative process, courts, and case law and presents a clear overview of the fundamental rules and principles of international law, public law, criminal law, and private law. It contextualises the myriad legal institutions operating in the jurisdiction, sets out how criminal and civil proceedings work in practice, and provides useful information on how people become lawyers, what lawyers actually do once they become qualified, and how the legal system is funded. The appendices set out sample sources of law so that readers can familiarise themselves with what is involved in handling legal documents. This edition has been updated following recent legal developments in Northern Ireland including the 'New Decade, New Approach' agreement of 2020 and the different elements of the power-sharing government, such as the proposed Languages Bill and the Northern Ireland (Ministers, Elections and Petitions of Concern) Bill. It explains the effect of Brexit, in particular the new concept of 'retained EU law' and the effect of the Ireland / Northern Ireland Protocol to the EU-UK Withdrawal Agreement. Setting out the implications of the recent UK-wide reviews of administrative law and the Human Rights Act for Northern Ireland, the book examines the work of the shadow Civil Justice Council and Family Justice Board and looks at the latest developments in the reform of abortion law. It explores new Assembly legislation that addresses the use of committal proceedings in criminal cases, the protection afforded to victims of domestic violence, and the rights of other victims, for example in relation to compensation for victims and survivors of the troubles and the appointment of an interim Victims of Crime Commissioner.

Book excerpt: The last time that anyone heard from 35-year-old Claudia Lawrence, a chef at the University of York, was when she sent a text message to a friend on 18 March 2009 at 8.23 p.m. She has never been heard from or seen again, and her disappearance is a mystery that endures to this day. What happened to Claudia that early spring evening – or was it early the following morning on her way to work? There had been nothing abnormal about her behaviour before she vanished, and there were no signs of a struggle at her home. A Crimewatch reconstruction has been broadcast, and the police investigation into the case has cost more than £750,000. Dozens of interviews have thrown up numerous leads, but there are no concrete clues. With extensive access to her family and friends, in Gone, Neil Root assesses the facts and theories and asks: where is Claudia?

Book excerpt: Terrorism law and legal practice has been politically and socially controversial to a degree beyond almost any other legal issue during the past few years, and this analytical text contains extensive analysis of these controversies. Terrorism and the Law offers a thoughtful and up-to-date discussion of all the key materials on terrorism law. It provides comprehensive coverage of all the major domestic, European, and international laws, and their impact on the UK. It also contains an extensive examination of the implementation of these terrorism laws, and of the practical issues they raise. The book contains three Parts. Part I focuses on meanings of 'terrorism' in law and political science. It provides the reader with an understanding of the phenomenon and the legal concept, including its statutory definitions, which is essential to the book's assessment of the strategies and tactics adopted in the codes of laws. It also covers normative constraints, such as human rights. Part II focuses on the United Kingdom law. It provides extensive coverage of the major UK terrorism legislation, such as: the Terrorism Act 2000; the Anti-Terrorism, Crime and Security Act 2001; the Prevention of Terrorism Act 2005; the Terrorism Act 2006; the Terrorism (Northern Ireland) Act 2006; the Justice and Security (Northern Ireland) Act 2007; and the Counter-Terrorism Act 2008. It also examines the key laws and rules relating to terrorism policing and legal processes. It discusses the meaning of these legislative materials, as well as their implementation, and includes reference to case law and practice statements from the police and courts. Part III reflects the impact of European, international and transnational laws and practices, covering international transnational cooperation and extradition, key European Union law measures against terrorism, other international law measures against terrorist activities, and international human rights and terrorism.
