Book excerpt: Presidential Legislative Activity explores the presidency and develops a typology that examines presidential activities. Author Carl D. Cavalli uses samples from the Eisenhower, Johnson, and Nixon administrations to explore questions about presidential behavior. The data confirms much of the heretofore descriptive and anecdotal evidence on such things as levels of presidential activity and travel, but dispute the popular conception of presidents being legislators. One advantage to this approach is the ability to explore commonalities across presidencies, instead of uniquely labeling each administration. Another advantage is the ability to empirically explore the president's relationship with Congress. A regression analysis of activity determines that contact with individual members of Congress is driven by their status within the hierarchy and secondarily by partisan concerns. Finally, there is also some evidence that contact with Congress varies directly with a president's legislative success.

Power, in this formulation, is strictly about bargaining and convincing other political actors to do things the president cannot accomplish alone. Power without Persuasion argues otherwise. Focusing on presidents' ability to act unilaterally, William Howell provides the most theoretically substantial and far-reaching reevaluation of presidential power in many years. He argues that presidents regularly set public policies over vocal objections by Congress, interest groups, and the bureaucracy. Throughout U.S. history, going back to the Louisiana Purchase and the Emancipation Proclamation, presidents have set landmark policies on their own. More recently, Roosevelt interned Japanese Americans during World War II, Kennedy established the Peace Corps, Johnson got affirmative action underway, Reagan greatly expanded the president's powers of regulatory review, and Clinton extended protections to millions of acres of public lands. Since September 11, Bush has created a new cabinet post and constructed a parallel judicial system to try suspected terrorists. Book excerpt: On January 13, 2012, President Barack Obama announced that he would ask Congress to reinstate so-called presidential reorganization authority, and his Administration conveyed a legislative proposal that would renew this authority to Congress on February 16, 2012. Bills based on the proposed language were subsequently introduced in the Senate (S. 2129) and the House (H.R. 4409) during the 112th Congress. Should this authority be granted, the President indicated that his first submitted plan would propose consolidation of six business and trade-related agencies into one: U.S. Department of Commerce's core business and trade functions, the Export Import Bank, the Overseas Private Investment Corporation, the Small Business Administration, the U.S. Trade and Development Agency, and the Office of the U.S. Trade Representative. It appears that this plan would also involve the relocation of some subunits and functions that are not directly linked with business and trade. The Administration has stated, for example, that the National Oceanic and Atmospheric Administration would be moved to the Department of the Interior. Between 1932 and 1981, Congress periodically delegated authority to the President that allowed him to develop plans for reorganization of portions of the federal government and to present those plans to Congress for consideration under special parliamentary procedures. Under these procedures, the President's plan would go into effect unless one or both houses of Congress passed a resolution rejecting the plan, a process referred to as a “legislative veto.” This process favored the President's plan because, absent congressional action, the default was for the plan to go into effect. In contrast to the regular legislative process, the burden of action under these versions of presidential reorganization authority rested with opponents rather than supporters of the plan. In 1984, the mechanism was amended to require Congress to act affirmatively in order for a plan to go into force. This arguably shifted the balance of power to Congress. The authority expired at the end of 1984 and therefore has not been available to the President since then. Presidents used this presidential reorganization authority regularly, submitting more than 100 plans between 1932 and 1984. Presidents used the authority for a variety of purposes, from relatively minor reorganizations within individual agencies to the creation of large new organizations, including the Department of Health, Education, and Welfare; the Environmental Protection Agency; and the Federal Emergency Management Agency. The terms of the authority delegated to the President varied greatly over the century. During some periods, Congress delegated relatively broad authority to the President, while during others the authority was more circumscribed. Congress might approach the question of whether, and how, to delegate this authority to the President in various ways. First, Congress could simply elect not to renew the authority, either by not acting on the President's proposal or by actively rejecting it. In the event that Congress elects to renew presidential reorganization authority, it might do so in a number of different ways. For example, it could renew the authority without modifications, with the requested changes to the scope of the authority, with a different set of changes to the scope of the authority, with changes to the nature of the expedited congressional procedures, or with some combination of these.

Book excerpt: Abstract: The president's agenda and Congress's support for the president's programs are key drivers in American public policy and electoral politics. The study of presidential-legislative relations, however, lacks a broad and rigorous treatment of the normal legislative process, from initial presidential position taking on votes before the House to final veto override votes cast by Congress. This dissertation broadly examines two stages of the normal legislative process, presidential position-taking and House support for the president's positions, using a data set consisting of more than 3,200 House votes representing the first terms of the Carter through Clinton administrations. The dissertation suggests that three temporal contexts-regime time; political, or intra administration time; and policymaking or discrete time-prominently shape the politics of presidential position taking and legislative support for the president. My analysis then employs a series of uniquely constructed variables to account for the personal and external context within which the president legislates and attempts to persuade members of the House. By doing so, this dissertation tests the degree to which the legislative or executive branch dominates the policy process. Drawing from a data set that treats presidential position-taking-and subsequent legislative action-as discrete decisions and using a series of binary cross-sectional probit models, the dissertation finds strong evidence suggesting that the waxing and waning of the president's political capital over regime and political time is among the most critical factors to consider when examining legislative-executive relations. These findings call into question past analyses of presidential-congressional relationships that fail to account for the dynamic nature of presidential and/or legislative dominance of the policy process. The dissertation concludes by discussing directions for subsequent research.

It provides for election of the President and Vice President by electors who are themselves elected by the voters. A majority of 270 of 538 electoral votes is necessary to win. The electoral college has been the subject of reform proposals since 1800. Constitutional and structural criticisms have centered on several of its features: it is not fully democratic, providing indirect election of the President; it can lead to the election of candidates who win the electoral college but fewer popular votes than their opponents or to contingent election in Congress if no candidate wins an electoral college majority; it results in electoral vote under- and over-representation between censuses; and that "faithless" electors can vote against the people's express choice. Legislative and political criticisms include the general ticket system, currently used in all states except Maine and Nebraska, which is said to disenfranchise voters who prefer the losing candidates in the states; various asserted "biases" that are alleged to favor different states and groups; and the electoral college "lock," which was once claimed to provide an advantage to Republican candidates, but is now said to favor Democrats. Electoral college reform options include the following: end it, mend it, or leave it alone. Proposals to end the electoral college almost always propose direct popular election, with the candidates winning the most popular votes nationwide elected. Almost all reform proposals would eliminate electors and award electoral votes directly by one of several methods: the general ticket system; the district system that awards electoral votes on a congressional-district and statewide-vote basis; and the proportional system that awards state electoral votes in proportion to the percentage of popular votes gained by each candidate. Despite more than 30 years of legislative activity from the 1940s through the late 1970s, proposed amendments never managed to win the constitutionally required two-thirds vote in both houses of Congress. Since 2004, some of the reforms identified above have been attempted in the states. District plan initiatives have been offered in California, Pennsylvania, Michigan, Virginia, and Wisconsin. Proportional plans have been proposed in Colorado and Pennsylvania. Nebraska has considered returning to the general ticket system. None of these, however, has been enacted to date.
