One way presidents can influence the permanent bureaucracy is by filling key posts with people who are sympathetic to their policy goals. Book excerpt: In 1998, the Defense Science Board Task Force on Human Resources Strategy was established for the purpose of evaluating the Department of Defense's (DoD's) capacity to attract and retain both civilian and military personnel. As part of this evaluation, RAND was asked to study the growth of political appointment positions within the DoD as well as to examine the appointment and confirmation process that potential political appointees face. Tasked with reviewing relevant DoD data, the National Defense Research Institute (NDRI), acting in support of the Defense Science Board Task Force, found that the number of DoD positions requiring Senate confirmation has grown significantly over the past two decades. The study also revealed that the functional responsibilities of such positions have narrowed while their vacancy rates have increased. In assessing the literature, the NDRI found that disincentives exist in the political appointment and confirmation process -- namely, requirements that candidates disclose a range of personal and financial information; requirements to comply with conflict-of-interest regulations that may require divestiture of stock holdings; and requirements to comply with extensive post employment restrictions. Additionally, the length of the appointment and confirmation process itself may serve as a disincentive to potential appointees.

Book excerpt: Several federal agencies, including the Small Business Administration (SBA), provide training and other assistance to veterans seeking civilian employment. For example, the Department of Defense, in cooperation with the Department of Labor, Department of Veterans Affairs, and several other federal agencies, including the SBA, operates the Transition Goals Plans Success program (Transition GPS), which provides employment information and entrepreneurship training to exiting military servicemembers to assist them in transitioning from the military to the civilian labor force. In recent years, the SBA has focused increased attention on meeting the needs of veteran small business owners and veterans interested in starting a small business. In FY2013, the SBA provided management and technical assistance services to more than 100,000 veterans through its various management and technical assistance training partners (e.g., Small Business Development Centers, Women's Business Centers [WBCs], Service Corps of Retired Executives [SCORE], and Veterans Business Outreach Centers [VBOCs]). In addition, the SBA's Office of Veterans Business Development (OVBD) administers several programs to assist veteran-owned small businesses. Congressional interest in the SBA's veteran assistance programs has increased in recent years primarily due to reports by veteran organizations that veterans were experiencing difficulty accessing the SBA's programs. Congress also has a continuing interest in assisting veterans, especially those returning from overseas in recent years, in their transition from military into civilian life. Although the unemployment rate (as of September 2014) among veterans (4.7%) was lower than for nonveterans aged 18 years and older (5.7%), the unemployment rate of veterans who have left the military since September 2001 (6.2%) was higher than the unemployment rate for nonveterans. The expansion of federal employment training programs targeted at specific populations, such as women and veterans, has also led some Members and organizations to ask if these programs should be consolidated. In their view, eliminating program duplication among federal business assistance programs across federal agencies, and within the SBA, would result in lower costs and improved services. Others argue that keeping these business assistance programs separate enables them to offer services that match the unique needs of various underserved populations, such as veterans. In their view, instead of considering program consolidation as a policy option, the focus should be on improving communication and cooperation among the federal agencies providing assistance to entrepreneurs. This report opens with an examination of the current economic circumstances of veteran-owned businesses drawn from the Bureau of the Census's 2007 Survey of Business Owners, which was administered in 2008 and 2009 and released on May 17, 2011. It then provides a brief overview of veterans' employment experiences, comparing unemployment and labor force participation rates for veterans, veterans who have left the military since September 2001, and nonveterans. The report describes the employment assistance programs offered by several federal agencies to assist veterans in their transition from the military to the civilian labor force and examines, in greater detail, the SBA's veteran business development programs, the SBA's efforts to assist veterans' access to capital, and the SBA's veteran contracting programs. It also discusses the SBA's Military Reservist Economic Injury Disaster Loan program.

Book excerpt: The Constitution empowers the president to nominate and, with 'the advice and consent of the Senate', to appoint the principal officers of the Unites States. This process is marked by three distinct stages: nomination, confirmation, and appointment. After the President submits an individual's name for nomination to a specific position, the nominee must then appear before the Senate, which holds hearings to decide whether to confirm the president's choice. If the Senate votes to approve the nominee, the president then appoints that person to assume the job. In recent years, though, this process has become increasingly partisan as Senate hearings have pitted Republican against Democrat in ideological battles over a nominee's fitness for government service. One of the most notable examples of President George W Bush's tenure was the confirmation debate over Attorney General John Ashcroft. However, the president has to make appointments to fill other, less high-profile positions in agencies such as the Postal Rate Commission and the Surface Transportation Board. The process tends to be deliberate, making for several vacancies in certain agencies, along with incumbents serving beyond their terms. This book provides an overview of the presidential appointment process, as well as descriptions of each federal agency the president is tasked to staff. Also included are lists of some of President Bush's nominees and their current status. The importance of presidential appointments is clear, as the nominees have the opportunity to influence the nation's agenda and direction. Book excerpt: In its 2004 report, the 9/11 Commission identified what it perceived were shortcomings in the appointment process during presidential transitions. The report asserted that delays in filling top executive branch leadership positions, such as those experienced during the 2000-2001 transition, could compromise national security policymaking in the early months of a new Administration. Although the unique circumstances of the 2000 presidential race truncated the ensuing transition period, the commission's observations could be applied to other recent transitions; lengthy appointment processes during presidential transitions, particularly between those of different political parties, have been of concern to observers for more than 20 years. The process is likely to develop a bottleneck during this time, even under the best of circumstances, due to the large number of candidates who must be selected, vetted, and, in the case of positions filled through appointment by the President with the advice and consent of the Senate (PAS positions), considered by that body. The appointment process has three stages: selection and vetting, Senate consideration, and presidential appointment. Congress has taken steps to accelerate appointments during presidential transitions. This book describes and analyses the processes, during a presidential transition, by which top-level executive branch PAS positions are filled. It also discusses nominations to cabinet positions during inter-term transitions; temporarily filling Presidentially appointed, Senate-confirmed positions; senate consideration of Presidential nominations; and Presidential appointee positions requiring Senate confirmations and committees handling nominations.
