Book Protecting Liberty in an Age of Terror

Download or read book Protecting Liberty in an Age of Terror written by Philip B. Heymann and published by MIT Press (MA). This book was released on 2005 with total page 216 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since September 11, 2001, much has been said about the difficult balancing act between freedom and security, but few have made specific proposals for how to strike that balance. As the scandals over the abuse of Iraqi prisoners at Abu Ghraib and the "torture memos" written by legal officials in the Bush administration show, without clear rules in place, things can very easily go very wrong. With this challenge in mind, Philip Heymann and Juliette Kayyem, directors of Harvard's Long-Term Legal Strategy Project for Preserving Security and Democratic Freedoms in the War on Terrorism, take a detailed look at how to handle these competing concerns. Taking into account both the national security viewpoint and the democratic freedoms viewpoint, Heymann and Kayyem consulted experts from across the political spectrum—including Rand Beers, Robert McNamara, and Michael Chertoff (since named Secretary of Homeland Security)—about the thorniest and most profound legal challenges of this new era. Heymann and Kayyem offer specific recommendations for dealing with such questions as whether assassination is ever acceptable, when coercion can be used in interrogation, and when detention is allowable. They emphasize that drawing clear rules to guide government conduct protects the innocent from unreasonable government intrusion and prevents government agents from being made scapegoats later if things go wrong. Their recommendations will be of great interest to legal scholars, legislators, policy professionals, and concerned citizens.

Book Fight for Liberty

Download or read book Fight for Liberty written by Mark Lasswell and published by PublicAffairs. This book was released on 2018-10-16 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: Anne Applebaum, Garry Kasparov, Richard North Patterson, and a constellation of other thinkers make the urgent case for liberal democracy---reinvigorating its central values in an age of doubt and discord. Liberal democracy is in crisis around the world, besieged by authoritarianism, nationalism, and other illiberal forces. Far-right parties are gaining traction in Europe, Vladimir Putin tightens his grip on Russia and undermines democracy abroad, and America struggles with poisonous threats from the right and left. But the defenders of democracy are strong too. Taking their cues from the 1788 Federalist Papers, the Renew Democracy Initiative is a collective of pro-democracy advocates from across the political spectrum, including Anne Applebaum, Garry Kasparov, Max Boot, Bret Stephens, Ted Koppel, and Natan Sharansky. This book is their foundational document, a collection of essays that analyze the multi-pronged threats to liberal democracy in the U.S. and abroad, and offer solutions based on fundamental democratic principles such as freedom of speech, a free press, and the rule of law. Fight for Liberty is a roadmap for the struggle against the rising tide of extremism and a cri de coeur in defense of the liberal world order, which sees itself threatened as never before today.

Book At the Threshold of Liberty

Download or read book At the Threshold of Liberty written by Tamika Y. Nunley and published by UNC Press Books. This book was released on 2021-01-29 with total page 271 pages. Available in PDF, EPUB and Kindle. Book excerpt: The capital city of a nation founded on the premise of liberty, nineteenth-century Washington, D.C., was both an entrepot of urban slavery and the target of abolitionist ferment. The growing slave trade and the enactment of Black codes placed the city's Black women within the rigid confines of a social hierarchy ordered by race and gender. At the Threshold of Liberty reveals how these women--enslaved, fugitive, and free--imagined new identities and lives beyond the oppressive restrictions intended to prevent them from ever experiencing liberty, self-respect, and power. Consulting newspapers, government documents, letters, abolitionist records, legislation, and memoirs, Tamika Y. Nunley traces how Black women navigated social and legal proscriptions to develop their own ideas about liberty as they escaped from slavery, initiated freedom suits, created entrepreneurial economies, pursued education, and participated in political work. In telling these stories, Nunley places Black women at the vanguard of the history of Washington, D.C., and the momentous transformations of nineteenth-century America.

Book Active Liberty

Download or read book Active Liberty written by Stephen Breyer and published by Vintage. This book was released on 2007-12-18 with total page 176 pages. Available in PDF, EPUB and Kindle. Book excerpt: A brilliant new approach to the Constitution and courts of the United States by Supreme Court Justice Stephen Breyer. For Justice Breyer, the Constitution’s primary role is to preserve and encourage what he calls “active liberty”: citizen participation in shaping government and its laws. As this book argues, promoting active liberty requires judicial modesty and deference to Congress; it also means recognizing the changing needs and demands of the populace. Indeed, the Constitution’s lasting brilliance is that its principles may be adapted to cope with unanticipated situations, and Breyer makes a powerful case against treating it as a static guide intended for a world that is dead and gone. Using contemporary examples from federalism to privacy to affirmative action, this is a vital contribution to the ongoing debate over the role and power of our courts.
