Download or read book Gun Control Improving the National Instant Criminal Background Check System written by and published by . This book was released on 2000 with total page 17 pages. Available in PDF, EPUB and Kindle. Book excerpt: Effective February 28, 1994, the interim provisions of the Brady Act required licensed firearms dealers to request a presale background check on handgun purchasers. These checks generally were to be conducted by the chief law enforcement officer (CLEO) in the purchaser's residence community to determine, on the basis of available records, if the individual was legally prohibited from buying the firearm under the provisions of federal, state, or local law. The sale was not to be completed for 5 business days unless the dealer received an approval from the CLEO before that time. If the CLEO did not contact the dealer by the end of the 5-day period, the dealer could make the sale unless the dealer had reason to believe the transaction would be unlawful.

Book excerpt: In 1993, with the passage of the Brady Law, Congress enacted a dual standard for gun purchases -- one for licensed gun stores and a separate standard for unlicensed sellers. The practical impact: Sales at gun stores require background checks (BC); sales at gun shows by unlicensed sellers do not. In 1999, Congress debated legislation to require criminal BC at gun shows. But scant info. was known about how often criminals obtained guns from gun shows. During the debate, legislators could only guess how long most BC took to complete under the Nat. Instant Check System, and even some basic questions such as whether BC would put gun shows out of bus. were debated with little info. This report seeks to answer those questions. Illustrations.

Book Background Check Requirements for Firearm Transfers

Download or read book Background Check Requirements for Firearm Transfers written by Kenneth P. Backhus and published by . This book was released on 2019 with total page 4 pages. Available in PDF, EPUB and Kindle. Book excerpt: Whether a background check is required for a firearm transfer in Minnesota is determined by whether a federal firearms dealer is involved. The scope of the check (if one is required) is based on the type of firearm being transferred. In a nutshell, a person who purchases a firearm (any type) from a federal dealer must undergo a National Instant Criminal Background Check System (NICS) check. If the firearm being purchased from the dealer is a pistol or a semiautomatic military-style assault weapon, Minnesota law requires that the transferee produce a valid permit to purchase (i.e., a transferee permit) or permit to carry (both of which require background checks at the time of issuance) or that the dealer files a transfer report with local law enforcement (which prompts a background check). No federal or Minnesota mandated background check is required for transfers of firearms (any type) between private parties (no dealer involvement) living in Minnesota.
