Book excerpt: O desenvolvimento desta pesquisa focalizado na proteção integral aos direitos de crianças e adolescentes negros requer uma análise interdisciplinar entre o Direito e a Sociologia. O Direito da Criança e do Adolescente consubstancia-se num ramo jurídico autônomo com normas e princípios próprios consagrador da doutrina da proteção integral. Tal doutrina eleva a condição de crianças e adolescentes a sujeitos de direitos reconhecendo-os como pessoas em estágio de desenvolvimento diferenciado e que por isso gozam de absoluta prioridade para a efetivação dos seus direitos fundamentais. Já o aporte teórico da Sociologia utilizado neste trabalho estuda a complexa temática que envolve as relações raciais na sociedade brasileira apontando expressivamente que o racismo, o preconceito racial e a discriminação racial são elementos impeditivos à efetivação dos direitos de crianças e adolescentes negros. Assim, a proteção integral disposta para crianças e adolescentes tem a finalidade de promover a efetivação dos seus direitos independentemente de sua cor, raça, sexo, religião, cultura. O Direito da Criança e do Adolescente veda a discriminação racial, mas não propõe medidas específicas de combate a esse processo discriminatório. O objetivo geral da pesquisa é verificar se a proteção sistemática proposta pelo Direito da Criança e do Adolescente promove a igualdade racial no país. O primeiro capítulo faz uma incursão histórica sobre as crianças e adolescentes negros no Brasil situando a infância desde o último século do período escravocrata (séc. XIX) até a contemporaneidade. O segundo capítulo traz uma abordagem teórico-conceitual sobre as relações raciais e o movimento anti-racista no Brasil. O terceiro capítulo se destina a investigar a doutrina da proteção integral e o sistema de garantias de direitos a partir do ordenamento jurídico brasileiro para verificar a possibilidade do investimento em políticas de ação afirmativa. E o último capítulo pontua as principais dificuldades encontradas atualmente para a efetivação da igualdade racial para crianças e adolescentes negros. O estudo aplicou o método de abordagem indutivo, com procedimento monográfico e realizado através de levantamento bibliográfico.

This book disrupts the traditional narrative of Latin America's legally benign racial past by comprehensively examining the existence of customary laws of racial regulation and the historic complicity of Latin American states in erecting and sustaining racial hierarchies. Tanya Katerí Hernández is the first author to consider the salience of the customary law of race regulation for the contemporary development of racial equality laws across the region. Therefore, the book has a particular relevance for the contemporary U.S. racial context in which Jim Crow laws have long been abolished and a "post-racial" rhetoric undermines the commitment to racial equality laws and policies amidst a backdrop of continued inequality.

Ranging across such topics as slavery, emancipation, scientific racism, immigration policies, racial classifications, and legal processes, Cottrol unravels a complex odyssey. By the eve of the Civil War, the U.S. slave system was rooted in a legal and cultural foundation of racial exclusion unmatched in the Western Hemisphere. That system's legacy was later echoed in Jim Crow, the practice of legally mandated segregation. Jim Crow in turn caused leading Latin Americans to regard their nations as models of racial equality because their laws did not mandate racial discrimination--a belief that masked very real patterns of racism throughout the Americas. And yet, Cottrol says, if the United States has had a history of more-rigid racial exclusion, since the Second World War it has also had a more thorough civil rights revolution, with significant legal victories over racial discrimination. Cottrol explores this remarkable transformation and shows how it is now inspiring civil rights activists throughout the Americas.
