Book Pre trial Discovery in Canada

Download or read book Pre trial Discovery in Canada written by Georg Wittuhn and published by Frankfurt am Main : P. Lang. This book was released on 1989 with total page 168 pages. Available in PDF, EPUB and Kindle. Book excerpt: The growth of international trade has created an even increasing number of international disputes, the resolution of which often necessitates recourse to litigation. From attorneys, such litigation requires familiarity with the Civil Procedure of various countries. This study analyzes the rules of pre-trial discovery as applied in the Federal courts of Canada and the provinvial courts of Ontario and Quebec. The mechanisms of pre-trial discovery are subsequently compared to the corresponding devices under German law. Finally this study discusses the impact the differences between these systems of law have on international litigation and on the recognition and enforcement of judgments.

Book Pretrial Discovery and the Adversary System

Download or read book Pretrial Discovery and the Adversary System written by William A. Glaser and published by Russell Sage Foundation. This book was released on 1968-12-31 with total page 317 pages. Available in PDF, EPUB and Kindle. Book excerpt: Presents the results of the first national field survey of how lawyers use pretrial discovery in practice. Pretrial discovery is a complex set of rules and practices through which the adversaries in a civil dispute are literally allowed to "discover" the facts and legal arguments their opponents plan to use in the trial, with the purpose of improving the speed and quality of justice by reducing the element of trickery and surprise. Dr. Glaser examines the uses, problems, and advantages of discovery. He concludes that it is in wide use in federal civil cases, but that while the procedure has produced more information in some areas, it has failed to bring other improvements favored by its original authors.

Book excerpt: "Discovery is a central element of civil litigation--it is a mechanism in civil litigation to prepare both parties to a lawsuit to know the case that they have to meet so they can prepare for trial or resolve their disputes by settlement. The book covers the principles of and approaches to discovery, and gives practical advice on the techniques and tactics to be deployed, and ethical issues. As well, the book serves as a "how-to" quick manual on conducting discovery in all common law jurisdictions in Canada (i.e., all provinces except Quebec) and explains and updates the discussion in light of current e-discovery practices."--
