  • Author : Ronnie Mackay
  • Publisher : Oxford University Press

Download or read book Fitness to Plead written by Ronnie Mackay and published by Oxford University Press. This book was released on 2018-06-20 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law relating to fitness to plead is an increasingly important area of the criminal law. While criminalization may be justified whenever an offender commits a sufficiently serious moral wrong requiring that he or she be called to account, the doctrine of fitness to plead calls this principle into question in the case of a person who lacks the capacity or ability to participate meaningfully in a criminal trial. In light of the emerging focus on capacity-based approaches to decision-making and the international human rights requirement that the law should treat defendants fairly, this volume offers a benchmark for the theory and practice of fitness to plead, providing readers with a unique opportunity to consider differing perspectives and debate on the future development and direction of a doctrine which has up till now been under-discussed and under-researched. The fitness to plead rules stand as an exception to notions of public accountability for criminal wrongdoing yet, despite the doctrine's long-standing function in criminal procedure, it has proven complex to apply in practice and has given rise to many varied legislative models and considerable litigation in different jurisdictions. Particularly troublesome is the question of what is to be done with someone who has been found unfit to stand trial. Here the law is required to balance the need to protect those defendants who are unable to participate effectively in their own trial, whether permanently or for a defined period, and the need to protect the public from people who may have caused serious social harm as a result of their antisocial behaviour. The challenge for law reformers, legislators, and judges, is to create rules that ensure that everyone who can properly be tried is tried, while seeking to preserve confidence in the fairness of the legal system by ensuring that people who cannot properly engage in the criminal trial process are not forced to endure it.

Book A Mindful Divorce

Download or read book A Mindful Divorce written by Armando Cecatiello and published by IL CASTELLO SRL. This book was released on 2018-10-03 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: The end of a relationship is always a difficult moment that inevitably brings suffering to the former partners, children and all the people close to the couple in crisis. If we add resentment, desire for revenge and anger, the mix can become explosive and make life impossible for everyone. If we view crisis and divorce as a possibility to begin a new life, we can solve the problems in a different and constructive manner, and often even make life better. This book is meant for married or unmarried couples involved in a family crisis and who seek a successful method to find shared and lasting solutions to their problems, considering the interests of all parties involved. It is also geared for professionals wanting a full picture of the Collaborative Process: lawyers, psychologists, social workers and all those who deal with conflict in general and family crisis in particular. They will find in Collaborative Process an innovative, non-judicial method to solve a conflict. There is no battle to win: true victory is finding shared solutions together that benefit all, children included. Armando Cecatiello, Divorce Lawyer, Mediator and Writer, has handled divorce cases both in the courtroom and outside of the judicial system for over 20 years. Specialized in Collaborative Process as well as a trainer in this innovative method, he has vast experience in all matters of family law where he employs a conscious and sustainable approach.

Book Justice and Unjusticiability

Download or read book Justice and Unjusticiability written by Ermanno Calzolaio and published by LIT Verlag Münster. This book was released on 2020-03-10 with total page 168 pages. Available in PDF, EPUB and Kindle. Book excerpt: The book tries to identify the main contours of unjusticiability and non-justiciability from an historical and comparative perspective distinguishing between common law world and civil law tradition. In the light of a general overview, the aim of this publication is to reflect on the utility of paving the way for a much wider approach to unjusticiability. More precisely, some scholars have recently suggested that such a notion could embrace all the situations where a court does not decide a case, so that it is impossible for the plaintiff to have the case decided by a court. A first category covers the situations where the court refuses to judge because it does not want to judge. A second category is related to all the cases where there is an impossibility to reach a decision. Any case where the judge cannot or does not wish to make justice--si iudex non facit iustitiam--continues to indicate a series of new (and old) questions.

Book The Limits of Criminological Positivism

Download or read book The Limits of Criminological Positivism written by Michele Pifferi and published by Routledge. This book was released on 2021-10-30 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Limits of Criminological Positivism: The Movement for Criminal Law Reform in the West, 1870-1940 presents the first major study of the limits of criminological positivism in the West and establishes the subject as a field of interest. The volume will explore those limits and bring to life the resulting doctrinal, procedural, and institutional compromises of the early twentieth century that might be said to have defined modern criminal justice administration. The book examines the topic not only in North America and western Europe, with essays on Italy, Germany, France, Spain, the United Kingdom, Belgium, and Finland but also the reception and implementation of positivist ideas in Brazil. In doing so, it explores three comparative elements: (1) the differing national experiences within the civil law world; (2) differences and similarities between civil law and common law regimes; and (3) some differences between the two leading common-law countries. It interrogates many key aspects of current penal systems, such as the impact of extra-legal scientific knowledge on criminal law, preventive detention, the ‘dual-track’ system with both traditional punishment and novel measures of security, the assessment of offenders’ dangerousness, juvenile justice, and the indeterminate sentence. As a result, this study contributes to a critical understanding of some inherent contradictions characterizing criminal justice in contemporary western societies. Written in a straight-forward and direct manner, this volume will be of great interest to academics and students researching historical criminology, philosophy, political science, and legal history.
