Book excerpt: Excerpt from Practice Before the Comptroller of Patents Comptroller-General of Patents' report for the year 1910 shews that in the year 1909-1910 there were 30,603 applications for patents, and 2,829 applications for patents under the International Convention. In the same year there were 1, 005 hearings to meet Office objections to acceptance; and also 4,511 hearings in opposition, revocation, amendment, and other cases fixed, of which 2,320 were heard. It is apparent, therefore, that there is a very large practice at the Patent Office and before the Comptroller. Information on the details of and precedents for this practice have had hitherto to be sought in official documents and works treating generally of patent law, which latter are to a great extent necessarily occupied with the action for Infringement and other actions in the High Court. It was therefore thought that a book which dealt in detail and completely with this practice only would be useful. This book is written with the object of fulfilling this want, and it is intended in it to treat of Patent Office practice exclusively and in greater detail than has before been done. To this end all the reported cases which have come before the Comptroller or Law Officer since 1883 are discussed in the following pages, save a small number which were found to be entirely unimportant. Book excerpt: Excerpt from Digest of the Decisions of Law and Practice in the Patent Office From 1890 to 1900 It may be said that the paragraphs of a digest are like the claims of a patent. As the latter express what an invention has added to the prior art, so the former express what each case has added to the body of the law. In accordance with this conception, the successive decisions comprised in this book have been studied in the light of those which preceded them, and the paragraphs have been formulated as points of law rather than as abridged statements of fact. The scheme of classification is largely based on the Rules of Practice, and is therefore at once natural and familiar. All related points have been grouped together, the result being a compact structure with few repetitions. The table of con tents is intended to be full enough to serve as an indication of the general scope of the various divisions and sub-divisions as well as to facilitate reference thereto. In the index, the subject-matter of each paragraph has been repeated under all the heads that were thought fairly likely to be searched. The numerical table of Rules will aid in finding the cases that bear on any particular Rule. Priority has been treated very fully, with especial reference to evidence of diligence and evidence of reduction to practice. Undoubtedly this subject will resume its normal importance with the development of Office practice under the doctrine of Hammond v. Hart. The period included in the digest is from January of 1890 to July of 1900. All of this period excepting the quarter of April - June, 1900, is comprised in the body of the text, that quarter being contained in an appendix, and the whole being covered by a single index. A few remarks may therefore prove useful: Notes relating to Affidavits, not specially provided for, are placed 'under rule 76. Notes relating to Shifting the Burden of Proof in Interference Cases are placed under rule 116. Notes relating to Public Use Proceedings are placed under rule 126. Rule No. 130 was added after the matter for this work went to press. All notes which should properly be placed under this rule will be found under rule 124, in the interpretation of which the necessity for the rule was developed. Notes relating to New Trials are placed under rules 142 and 144. The publication of the Commissioner's Decisions began in 1869, and has been continued in annual volumes. The Official Gazette has been published in the following manner: from 1872 - 1882 inclusive, two volumes per annum; 1883, three vol umes; 1884 - 1892, inclusive four volumes per annum; 1893 to date, six volumes per annum. Should you desire all the cases construing any one rule or its subject matter, follow down the right hand or fourth column on each page until the number appears. The title opposite on the same line is the case desired. Should you desire to know if any case has been subsequently construed, find your case in its alphabetical position in the first column, then look for the figures immediately below its citations in the Commissioner's Decisions and the Official Gazette columns. These annotations are mostly subsequent discussions of the case. Should you desire the citation on any given title, you will find it on the same line opposite its alphabetical position.
