Book Vicarious Liability

    Book Details:
  • Author : Anthony Gray
  • Publisher : Bloomsbury Publishing
  • Release : 2018-09-20
  • ISBN : 1509920242
  • Pages : 463 pages

Download or read book Vicarious Liability written by Anthony Gray and published by Bloomsbury Publishing. This book was released on 2018-09-20 with total page 463 pages. Available in PDF, EPUB and Kindle. Book excerpt: The scope of vicarious liability has significantly expanded since its original conception. Today employers are being found liable for actions of employees that they did not authorise, and never would have authorised if asked. They are being held liable for an employee's criminal activity. In the related strict liability field of non-delegable duties, they are being held liable for wrongdoing of independent contractors. Notions of strict liability have grown increasingly isolated in the law of tort, given the exponential growth in the tort of negligence. They require intellectual justification. Such a justification has proven to be elusive and largely unsatisfactory in relation to vicarious liability and to concepts of non-delegable duty. The law of three jurisdictions studied has now apparently embraced the 'enterprise risk' theory to rationalise the imposition of vicarious liability. This book subjects this theory to strong critique by arguing that it has many weaknesses, which the courts should acknowledge. It suggests that a rationalisation of the liability of an employer for the actions of an employee lies in more traditional legal doctrine which would serve to narrow the circumstances in which an employer is legally liable for a wrong committed by an employee.

Book Power and Plenty

Download or read book Power and Plenty written by Ronald Findlay and published by Princeton University Press. This book was released on 2009-08-10 with total page 648 pages. Available in PDF, EPUB and Kindle. Book excerpt: International trade has shaped the modern world, yet until now no single book has been available for both economists and general readers that traces the history of the international economy from its earliest beginnings to the present day. Power and Plenty fills this gap, providing the first full account of world trade and development over the course of the last millennium. Ronald Findlay and Kevin O'Rourke examine the successive waves of globalization and "deglobalization" that have occurred during the past thousand years, looking closely at the technological and political causes behind these long-term trends. They show how the expansion and contraction of the world economy has been directly tied to the two-way interplay of trade and geopolitics, and how war and peace have been critical determinants of international trade over the very long run. The story they tell is sweeping in scope, one that links the emergence of the Western economies with economic and political developments throughout Eurasia centuries ago. Drawing extensively upon empirical evidence and informing their systematic analysis with insights from contemporary economic theory, Findlay and O'Rourke demonstrate the close interrelationships of trade and warfare, the mutual interdependence of the world's different regions, and the crucial role these factors have played in explaining modern economic growth. Power and Plenty is a must-read for anyone seeking to understand the origins of today's international economy, the forces that continue to shape it, and the economic and political challenges confronting policymakers in the twenty-first century.

Book Good Bye Hegemony

Download or read book Good Bye Hegemony written by Simon Reich and published by Princeton University Press. This book was released on 2014-03-23 with total page 206 pages. Available in PDF, EPUB and Kindle. Book excerpt: Many policymakers, journalists, and scholars insist that U.S. hegemony is essential for warding off global chaos. Good-Bye Hegemony! argues that hegemony is a fiction propagated to support a large defense establishment, justify American claims to world leadership, and buttress the self-esteem of voters. It is also contrary to American interests and the global order. Simon Reich and Richard Ned Lebow argue that hegemony should instead find expression in agenda setting, economic custodianship, and the sponsorship of global initiatives. Today, these functions are diffused through the system, with European countries, China, and lesser powers making important contributions. In contrast, the United States has often been a source of political and economic instability. Rejecting the focus on power common to American realists and liberals, the authors offer a novel analysis of influence. In the process, they differentiate influence from power and power from material resources. Their analysis shows why the United States, the greatest power the world has ever seen, is increasingly incapable of translating its power into influence. Reich and Lebow use their analysis to formulate a more realistic place for America in world affairs.
