Book excerpt: On December 20, 1999, the city of Macau became a Special Administrative Region of China after nearly four hundred and fifty years of Portuguese administration. Drawing extensively on Portuguese and other sources and on interviews with key participants, this book examines the strategies and policies adopted by the Portuguese government during the negotiations. The study sets these events within the larger context of Portugal's retreat from empire, the British experience with Hong Kong, and changing social and political conditions within Macau. A weak player on the international stage, Portugal was still able to obtain concessions during the negotiations, notably in the timing of the retrocession and continuing Portuguese nationality arrangements for some Macau citizens. Yet the tendency of Portuguese leaders to use the Macau question as a tool in their domestic political agendas hampered their ability to develop an effective strategy and left China with the freedom to control the process of negotiation.

Book excerpt: With international attention focused on Hong Kong, many forget that Macau also exists in a delicate `one country, two systems’ (OCTS) balance with mainland China. This book provides insights into the circumstances surrounding the less-understood half of China’s OCTS policy, including the stagnation of representational government, and the location of any Macau characteristics in the Macau Basic Law. Despite being Hong Kong’s sister `Special Administrative Region’ (SAR) within the People’s Republic of China, Macau’s unique constitutional development under Portuguese and Chinese administration remains under-appreciated despite its potential contributions to local, national, and international constitutional discourse. Utilizing a multi-disciplinary approach including doctrinal, historical, and comparative methodologies, this work fills that gap. The research blends Portuguese, Chinese, and foreign-language sources in order to reconstruct a balanced constitutional narrative. The book focuses on a consequential effect of globalization – that is, the assimilation of a longstanding and unique constitutional order by a new hegemonic sovereign – including processes for internationalization as China opened up, legal harmonization of two distinct legal and socioeconomic orders, juridification of local affairs with the establishment of a new local court system in preparation for handover to the Chinese regime, and democratization (or the lack thereof) among the various communities comprising the Macanese polity before and since. Focusing on Macau’s unique development at the crux of European and Chinese empires, and the role it plays as a mirror for Chinese intentions vis-a-vis Hong Kong today, the book will be of interest to those working in Constitutional Law, Politics and History.

Book excerpt: This is the first book that focuses on the entrenched, fundamental divergence between the Hong Kong Court of Final Appeal and Macau's Tribunal de Última Instância over their constitutional jurisprudence, with the former repeatedly invalidating unconstitutional legislation with finality and the latter having never challenged the constitutionality of legislation at all. This divergence is all the more remarkable when considered in the light of the fact that the two Regions, commonly subject to oversight by China's authoritarian Party-state, possess constitutional frameworks that are nearly identical; feature similar hybrid regimes; and share a lot in history, ethnicity, culture, and language. Informed by political science and economics, this book breaks new ground by locating the cause of this anomaly, studied within the universe of authoritarian constitutionalism, not in the common law-civil law differences between these two former European dependencies, but the disparate levels of political transaction costs therein.

Book excerpt: In War and Revolution in South China, Edward Rhoads recounts his childhood and early teenage years during the Sino-Japanese War and the early postwar years. Rhoads came from a biracial family. His father was an American professor while his Chinese mother was a typist and stenographer. In the late 1930s and the 1940s, the Rhoads family lived through the turbulent years in southern China and Hong Kong. The book follows Rhoads’ childhood in Guangzhou, his family’s evacuation to Hong Kong, his father’s internment and repatriation to the United States, and his and his mother’s flight to Free China. He recalls his reunion with family members in northern Guangdong Province in 1943, their retreat to China’s wartime capital of Chongqing, where his father worked for the American government, and how they returned to Guangzhou after the war. The Rhoads family then witnessed the socioeconomic recovery in the city and the regime change in 1949. The book ends with their departure from China to the United States in 1951, a year and a half after the Communist revolution. The book fills an important gap in the scholarship by examining the impact of the Sino-Japanese War in southern China from the perspective of one family. Rhoads reveals that the war in this region, while often neglected by scholars, was in fact no less turbulent than it was in northern and central China. Book excerpt: This book project studies the variation of sovereignty in international order by analysing how the general model of sovereignty is localised in the political practice of two major non-Western rising powers, namely China and India. It aims to investigate how the sovereignty of these states is constituted, which includes the question of how sovereignty works and becomes constituted in specific contexts and cases that fall outside the discourses and positions of the so-called Westphalian (conservative, absolutist) sovereignty that is dominantly advocated by these two states on a global level. The core of this project explores specific contested cases and situates them vis-à-vis the broader approaches of China and India to sovereignty. I specifically analyse four particular cases: China’s approach to sovereignty in relation to Hong Kong and Taiwan and India’s approach to sovereignty in relation to Bhutan and Kashmir. In doing so, I will illustrate that sovereignty is a flexible and plastic phenomenon which can be intertwined with principles, models or practices that are usually seen as divergent from or contradicting sovereignty; for example, those that derive from China’s and India’s imperial and colonial history.

Book excerpt: Land was always at the centre of life in Hong Kong’s rural New Territories: it sustained livelihoods and lineages and, for some, was a route to power. Villagers managed their land according to customs that were often at odds with formal Chinese law. British rule, 1898—1997, added complications by assimilating traditional practices into a Western legal system. Custom, Land and Livelihood in Rural South China explores land ownership in the New Territories, analysing over a hundred surviving land deeds from the late Ch’ing Dynasty to recent times, which are transcribed in full and translated into English. Together with other sources collected by the author during 30 years of research, these deeds yield information on all aspects of traditional village life—from raising families and making a living to coping with intruders—and evoke a view of the world which, despite decades of urbanisation, still has resonance today.
