Book excerpt: This book considers the impact of the COVID-19 pandemic on the realisation of the United Nations’ Sustainable Development Goals. Although efforts towards the attainment of the Sustainable Development Goals are ongoing, the COVID-19 pandemic has had a significant impact on these efforts: accentuating inequities, as well as absorbing resources. This book addresses this impact, as it takes up the question of how to ensure global recovery – in line with the target for the Sustainable Development Goals – after the pandemic. Adopting an interdisciplinary approach, but focusing particularly on the role of law and legal frameworks in this recovery, the book considers the effect of the pandemic on key industries such as shipping, insurance, manufacturing, and banking, as well as on the role of the State and non-State actors. Pursuing an explicitly Global South perspective, the book maintains that in the post-COVID era it is the elaboration a rule of law framework that is in sync with both the Global North and South that is crucial if the Sustainable Development Goals are to be achieved. This book will be of value to scholars, students and policymakers working in the general area of law and development, but especially those with specific interests in the United Nations’ Sustainable Development Goals.

Many governments have sought to extract themselves from the business of port operations and, in many cases, the provision of port services has devolved to local governments, communities or private management and administration. As such devolution implies a change in governance model, this trend raises questions about consequent performance. This issue examines the changed port management environment, focusing particularly on government policies such as devolution, regulatory reform and newly imposed governance models, all of which have exerted a significant influence over the nature of that changed environment. The issue is structured so as to first explore the devolution and port reform approaches for 14 countries or regions, before examining how ports are governed and what the choice of governance might mean for their performance. Part I introduces the issue, and provides a framework for defining the basic concepts involved in devolution; it paints a picture of the current port environment, its likely future evolution and the expected impact this will have on the functioning of ports. Part II examines the port industry in 14 countries or administrations, and presents the thinking behind any devolution programs that have been implemented. Part III focuses on port governance and devolution generally, and examines governance from both strategic management and economics perspectives, including topics such as governance models, supranational governance and stakeholder conflict. Part IV examines the measurement of port performance and closes by providing conclusions and a future research agenda. GAO reviewed documents and interviewed various port stakeholders from 17 major U.S. ports.

The author analyses, the information resources mobilized to combat the pandemic in industrialized countries and pays particular attention to the operational mechanism. The analysis sought to clarify the modalities of operation of the crisis system managing, while at the same time looking at the decision-making mechanisms. The main lines of analysis retained are: the piloting and management of the crisis, the markets for ordering protective equipment and vaccine, the hospital organization and the prevention campaign, the cost and the methods of financing. Finally, the author, whether it might therefore, not be appropriate to rethink the organization of the pandemic's governance? The health crisis governing should not be opened up more and deal with societal challenges? This organization is too complex and suffer both from a certain heaviness and from a lack of resources, which is detrimental to it proper functioning. It should first and foremost be open to people in the field whose absence, weighs heavily on the organization of the response to the pandemic. It should also be open to other specialties, even if they seem far removed from public health and medicine, if they are useful to the Government in guiding its action.

Book excerpt: Port Development and Competition in East and Southern Africa analyzes the 15 main ports in East and Southern Africa (ESA) to assess whether their proposed capacity enhancements are justified by current and projected demand; whether the current port management approaches sufficiently address not only the maritime capacity needs but also other impediments to port efficiency; and what the expected hierarchy of ports in the region will be in the future. The analysis confirms the need to increase maritime capacity, as the overall container demand in the ports in scope is predicted to begin exceeding total current capacity by between 2025 and 2030, while gaps in terms of dry and liquid bulk handling are expected even sooner. However, in the case of many of the ports, the issue of landside access—the ports’ intermodal connectivity, the ease of international border crossing, and the port-city interface—is more important than the need to improve maritime access and capacity. The analysis finds that there is a need to improve the operating efficiency in all of the ESA ports, as they are currently less than half as productive as the most efficient ports in the matched data set of similar ports across the world, in terms of efficiency in container-handling operations. Similarly, there is a need to improve and formalize stakeholder engagement in many of the ports, to introduce modern management systems, and to strengthen the institutional framework to ensure the most efficient use of the infrastructure and to be able to attract private capital and specialist terminal operators. Finally, given the ports’ geographic location and proximity to main shipping routes, available draft, and the ongoing port-and-hinterland development, the book concludes that Durban and Djibouti are the most likely to emerge as the regional hubs in ESA’s future hub-and-spoke system.
