Book excerpt: Notre recherche porte sur ia comparaison des politiques locales d'accueil de demandeurs d'asile au cours de la période 1999-2005, dans les départements du Rhône, de l'Isère et des Bouches-du-Rhône. En effet, si la politique d'asile est une politique régalienne déconcentrée, son volet accueil est mis en oeuvre au niveau du département. De fait, la thèse analyse la manière dont I'accueil des demandeurs d'asile qui relève de prérogatives étatiques se décline dans les territoires en fonction des enjeux locaux spécifiques qui y préexistent. La période étudiée est marquée par une hausse soutenue des flux d'arrivées de demandeurs d'asile en France comme dans I'ensemble de l'Europe, avec comme conséquence principale la saturation du dispositif national d'accueil et une remise en cause du droit d'asile. Pour faire face à cette situation, des réponses émergent d'abord localement a I'initiative d'acteurs déja engagés auprès de cette population. Par la suite, l'Etat se saisit de ce problème en adoptant une fonction de régulation: il sollicite ses services déconcentrés, les DDASS, et les invitent à mettre en place des dispositifs locaux innovants en coordination avec les acteurs locaux, principalement associatifs. En résultent des dispositifs relativement hétérogènes d'un département à un autre, avec en conséquence, une inégalite de traitement de I'accueil des demandeurs d'asile sur Ie territoire national. La recherche des facteurs explicatifs de cette hétérogeneité révèle I'importance des processus de mise sur agenda dans la construction des dispositifs locaux. Ces derniers qui relèvent du contexte migratoire préexistant, de I'histoire associative locale et des acteurs traditionnels, influent en effet significativement sur la réponse apportée dans chaque département à la hausse des flux. Plus encore, I'étude comparative met en exergue des modes de coordination entre acteurs institutionnels et associatifs propres à chaque territoire et aux enjeux spécifiques qui s'y trouvent, alors même que la politique d'accueil demeure une politique nationale.

Pourtant la question de l’asile fait l’objet de négociations multi-acteurs à l’échelle communautaire depuis plus de 25 ans. Il s’agit d’une politique qui touche forcement le noyau dur des fonctions régaliennes de l’Etat. Cette politique représente également un exemple caractéristique d’une nouvelle Europe politique en construction. Politique donc nouvelle ? Dépassement des logiques classiques de construction des problèmes au niveau de l’Etat ? Autant de questions auxquelles cette étude essaye de fournir des éléments de réponse. Notre objectif au sein de ce travail consiste à comprendre, d’une part, pourquoi l’asile, sujet synonyme de la souveraineté de l’Etat, figure parmi les politiques communautaires et d’autre part, comment, par quels acteurs et selon quelles logiques cette politique a été négociée et construite. L’étude du processus de construction de l’asile comme politique communautaire, aussi bien en termes de mise sur agenda qu’en termes de négociation, permet également de mettre en lumière certaines des logiques d’action publique au sein d’un nouveau domaine d’intervention de l’Union européenne, celui de la Justice et des Affaires intérieures.

However, although over nine million refugees were repatriated worldwide between 1991 and 1995, there are reasons to believe that it will not necessarily be a durable solution for refugees. The changing constructions and realities of refugee repatriation provide the backdrop for this book which presents new empirical research on examples of refugee repatriation and reconstruction. In the post-Cold War period, a wider range of geopolitical and domestic interests influence which populations policymakers prioritize for admission. The Refugee Challenge in Post-Cold War America examines the actors and interests that have shaped refugee and asylum policy since 1989. Policymakers are now considering a wider range of populations as potentially eligible for protection: victims of civil unrest, genocide, trafficking, environmental upheaval, and gender-based discrimination, among others. Many of those granted protected status since 1989 would never have been considered for admission during the Cold War. Among the challenges of the post-Cold War era are the growing number of asylum seekers who have petitioned for protection at a port of entry and are backlogging the immigration courts. Concerns over national security have also resulted in deterrence policies that have raised important questions about the rights of refugees and the duties of nations. María Cristina García evaluates the challenges of reconciling international humanitarian obligations with domestic concerns for national security.
