However, legal interest in this field has remained relatively underdeveloped, and few scholars have addressed emerging legal issues to any significant degree. This collection of contributions by leading writers in the field of ethnic migration and diaspora studies therefore provides some important interdisciplinary perspectives of how ethnic/diasporic minorities in British and European contexts interact with the official legal system. This volume makes a significant contribution in assessing the role of law in current debates on the integration of ethnic and religious minorities of migrant origin in the EU. The chapters derive from papers first delivered at a lecture series on 'Cultural Diversity and Law' at the Institute of Advanced Legal Studies. Book excerpt: The European Union’s (EU) membership conditionality has been perceived as a highly effective means of influence on non-member states in the run-up to the 2004 and 2007 enlargements. According to the incentive-based explanation that dominates the literature, conditionality has been particularly effective when the EU offered a credible membership incentive and when governments did not consider the domestic costs of compliance threatening to their hold on power. This volume challenges much of the existing work on EU enlargement and postcommunist transition, however, by testing the conditionality thesis in the post-accession setting. Whereas a conditionality hypothesis would predict deteriorating compliance among the newest member states, several contributions here actually find the opposite. Enduring compliance among postcommunist states with the acquis, as well as with less formally institutionalized EU preferences for economic liberalization and minority protection, calls into question the role that conditionality plays in eliciting conformity. Simultaneously, support for the conditionality hypothesis in areas such as political party development and EU relations with Turkey and the western Balkans suggests conditionality’s effects vary across countries and issues. As the first study to systematically examine the relationship between international institutions and postcommunist states after enlargement, this volume provides new insights into how external actors exercise their power in domestic politics. The applicant states from Eastern Europe are much poorer than the current member states from Western Europe. Their democracy and in some cases even their statehood is newly established and presumably more fragile. Their economic, legal and administrative structures are less developed. This collection of essays will try to examine the origin, nature, scale and implications of this divergence. How much divergence is likely to be imported by the Union and will it hamper the process of European integration? This volume looks at differences and similarities in the field of macro-economics, welfare systems, democracy, institutional infrastructure, civic orientations and popular culture. The book shows that the map of convergence and divergence in the future EU will be very complex and will not correspond exactly with the old east-west divide. Moreover, the division lines are constantly changing with the enlargement process representing an important factor pushing individual states into a single regulatory frame, if not in a common political direction. However, there are other "unifying" factors at play: globalization produces different models and loyalties than Europeanization. Moreover, the European pulling effect works unevenly in different functional fields and in different countries. There are also many factors that produce greater divergence rather than convergence across the European Union; a certain degree of divergence is thus unavoidable. The book shows, in particular, that certain types of divergence can be beneficial rather than merely detrimental in the process of Europeanintegration.
