It stated that there was no objection to the declaration of independence under international law. It was highly controversial, as the Opinion could be seen to set a precedent for endorsing secession more widely. This book, written by an unparalleled team of experts, investigates the interplay between law and politics that took place over Kosovo's independence, both generally and in the specific context of the Advisory Opinion. It investigates how the International Court of Justice became the battleground over which Kosovo's independence was fought, and how the political arguments in favor of Kosovo's independence changed in the legal setting of the Court. It studies what the Court wanted to achieve, whether it succeeded in those aims, and the contentious reception its Opinion received. The book is structured in five parts, first setting out the historical and political context to the case, focusing on the conflicting narratives of reality within Serbia and Kosovo, of which the ICJ case was only a continuation, and the political arguments for and against Kosovo's independence. Secondly it examines in detail how the case was argued, what were the litigation strategies of the participating states, why some arguments rose to the forefront while others did not. In doing so it will extensively discuss the written and oral pleadings of all the participating states. Thirdly it analyses the Advisory Opinion itself, as well as things that the Court left unsaid with regard to general international law. Fourthly it looks at the consequences that the Opinion has had on the continuing dispute between Serbia and Kosovo, and how it was received in the international legal sphere. Finally, it examines the broader repercussions the Opinion might have on other cases of secession, even if it was probably designed not to have any.

Book excerpt: This volume is driven by the conviction that the key to the establishment of stable liberal democracy anywhere in the world and, in this case, in Kosovo lies in the completion of three interrelated tasks: first, the creation of effective political institutions, based on the principle of the separation of powers (including the independence of the judiciary); second, the promotion of the rule of law; and, third, the promotion of civic values, including tolerance or ethnic/religious/sexual minorities, trust, and respect for the harm principle. In fact, there are problems across all three measures, including with judicial independence, with the rule of law, and with civic values. On the last of these, research findings show that the citizens of Kosovo rank extremely low on trust of other citizens, low on engagement in social organizations, and tolerance of gays, lesbians, and atheists, but high on trust in the political institutions of their country and in pride of their newly independent state.

It also explores the co-optation of peace by ethno-nationalist groups and explores how their contradictory perception of peace produced an ungovernable peace, which has been manifested with intractable ethnic antagonisms, state capture, and ignorance of the root causes, drivers, and consequences of the conflict. Under these conditions, prospects for emancipatory peace have not come from external actors, ethno-nationalist elite, and critical resistance movements, but from local and everyday acts of peace formation and agnostic forms for reconciliation. The book proposes an emancipatory agenda for peace in Kosovo embedded on post-ethnic politics and joint commitments to peace, a comprehensive agenda for reconciliation, people-centred security, and peace-enabling external assistance.

Drawing on communicative action theory, it provides a provocative answer to the hotly contested question of how to understand the legitimacy of the use of force in international politics. The use of force is one of the most critical and controversial aspects of international politics. Scholars and policy-makers have long tried to develop meaningful standards capable of restricting the use of force to a legally narrow yet morally defensible set of circumstances. However, these standards have recently been challenged by concerns over how the international community should react to gross human rights abuses or to terrorist threats. This book argues that current legal and moral standards on the use of force are unable to effectively deal with these challenges. The author argues that the concept of 'deliberative legitimacy', understood as the non-coerced commitment of an actor to abide by a decision reached through a process of communicative action, offers the most appropriate framework for addressing this problem. The theoretical originality and empirical value of the concept of deliberative legitimacy comes fully into force with the examination of two of the most severe international crises from the post Cold War period: the 1999 NATO intervention in Kosovo and the 2003 US military action against Iraq. This book will be of much interest to students of international security, ethics, international law, discourse theory and IR. This book provides the first in-depth study of Kosovo’s diplomatic approach to becoming a sovereign state by obtaining international recognition and securing membership of international organisations. Analysing the everyday diplomatic discourses, performances, and entanglements, this book contends that state-becoming is not wholly determined by systemic factors, normative institutions, or the preferences of great powers; the diplomatic agency of the fledgling state plays a far more important role than is generally acknowledged. Drawing on institutional ethnographic research and first-hand observations, this book argues that Kosovo’s diplomatic success in consolidating its sovereign statehood has been the situational assemblage of multiple discourses, practiced through a broad variety of performative actions, and shaped by a complex entanglement with global assemblages of norms, actors, relations, and events. Accordingly, this book contributes to expanding our understanding of the everyday diplomatic agency of emerging states and the changing norms, politics, and practices regarding the diplomatic recognition of states and their admission to international society.
