The vague and sometimes conflicting policy mandates of Congress, the president, and courts are translated into real public policy in the bureaucracy. As the role of the national government has expanded, the national legislature and executive have increasingly delegated authority to administrative agencies to make fundamental policy decisions. How this administrative state is designed, its coherence, its responsiveness, and its efficacy determine, in Robert Dahl’s phrase, “who gets what, when, and how.” This study of agency design, thus, has implications for the study of politics in many areas. The structure of bureaucracies can determine the degree to which political actors can change the direction of agency policy. Politicians frequently attempt to lock their policy preferences into place through insulating structures that are mandated by statute or executive decree. This insulation of public bureaucracies such as the National Transportation Safety Board, the Federal Election Commission, and the National Nuclear Security Administration, is essential to understanding both administrative policy outputs and executive-legislative politics in the United States. This book explains why, when, and how political actors create administrative agencies in such a way as to insulate them from political control, particularly presidential control.

Book excerpt: Until now political scientists have devoted little attention to the origins of American bureaucracy and the relationship between bureaucratic and interest group politics. In this pioneering book, Daniel Carpenter contributes to our understanding of institutions by presenting a unified study of bureaucratic autonomy in democratic regimes. He focuses on the emergence of bureaucratic policy innovation in the United States during the Progressive Era, asking why the Post Office Department and the Department of Agriculture became politically independent authors of new policy and why the Interior Department did not. To explain these developments, Carpenter offers a new theory of bureaucratic autonomy grounded in organization theory, rational choice models, and network concepts. According to the author, bureaucracies with unique goals achieve autonomy when their middle-level officials establish reputations among diverse coalitions for effectively providing unique services. These coalitions enable agencies to resist political control and make it costly for politicians to ignore the agencies' ideas. Carpenter assesses his argument through a highly innovative combination of historical narratives, statistical analyses, counterfactuals, and carefully structured policy comparisons. Along the way, he reinterprets the rise of national food and drug regulation, Comstockery and the Progressive anti-vice movement, the emergence of American conservation policy, the ascent of the farm lobby, the creation of postal savings banks and free rural mail delivery, and even the congressional Cannon Revolt of 1910.

Book excerpt: When we speak of depoliticizing an administrative agency, what we mean is insulating it from direct presidential control. The resulting distinction between executive and independent agencies, however, is essentially invisible to Congress. All the mechanisms of control that Congress exercises over administrative agencies are equally available whether the agency is executive or independent. This article considers the concept of further depoliticizng administrative agencies by insulating them from Congress as well, as device that can be described as hyperdepoliticization. In considering this possibility, a variety of empirical questions naturally present themselves: would it truly shield the agency from partisan politics; would it improve the quality of agency decision making; would it render the agency unaccountable in some meaningful and measurable way?Hyperdepoliticization also presents some more theoretical issues that are absent from garden variety depoliticization; in fact, the issues that it raises are so theoretical that they belong as much to the field of philosophy as they do to law or political science. To insulate an agency from all political pressure by elected officials, Congress must not only place limits on a subordinate (the President), but also on itself. This implicates the philosophic question of how precisely does a conscious actor place limits on its future conduct? This article begins with the philosophic, but simultaneously pragmatic question of self-limitation. It rejects the classic discussion of this issue, John Elster's Ulysses and the Sirens, and argues instead that the basis for self-limitation is a commitment to principle. It then applies this approach to three examples of hyperdepoliticization by the U.S. Congress: the Base Closure and Realignment Acts of 1988 and 1990, the Federal Reserve Board's control of the money supply, and the Dodd-Frank Act's Consumer Finance Protection Bureau.

Copland explains how unaccountable agents have taken over much of the U.S. government apparatus. Congress has largely abdicated its authority. “Independent” administrative agencies churn out thousands of new regulations every year. Courts have enabled these rulemakers to expand their powers beyond those authorized by law—and have constrained executive efforts to rein in the bureaucratic behemoth. No ordinary citizen can know what is legal and what is not. There are some 300,000 federal crimes, 98 percent of which were created by administrative action. The proliferation of rules gives enormous discretion to unelected enforcers, and the severity of sanctions can be ruinous to citizens who unwittingly violate a regulation. Outside the bureaucracy, private attorneys regulate our conduct through lawsuits. Most of the legal theories underlying these suits were never voted upon by our elected representatives. A combination of historical accident, decisions by judges and law professors, and self-interested advocacy by litigators has built an onerous and expensive legal regime. Finally, state and local officials may be accountable to their own voters, but some reach further afield, pursuing agendas to dictate the terms of national commerce. These new antifederalists are subjecting the citizens of Wyoming and Mississippi to the whims of the electorates of New York and San Francisco—contrary to the constitutional design. In these ways, the unelected have assumed substantial control of the American republic, upended the rule of law, given the United States the world’s costliest legal system, and inverted the Constitution’s federalism. Copland caps off his account with ideas for charting a corrective course back to democratic accountability.

Book excerpt: The bureaucracy literature has long analyzed political control of administrative agencies. Such studies typically ask to what extent the president, the Congress, the courts, and interest groups influence the regulatory process? This dissertation analyzes an important but overlooked element of political control: statutory constraints on the rulemaking process such as the Administrative Procedures Act's notice and comment requirement. Almost all existing studies assume that such constraints are effective, or achieve the goals of their supporters. This assumption neglects the influence of politics, however. This dissertation challenges the conventional wisdom by analyzing the impact of politics on the likelihood that a rulemaking process constraint will be effective. Chapter 1 explains the problem and reviews the literature, showing that many studies have incorrectly assumed that all rulemaking process constraints are effective. Chapter 2 argues that opponents of proposed constraints can win concessions that undermine the odds that a constraint will be effective. Chapter 3 tests this theory with case studies of the full universe of generally applicable statutory rulemaking constraints. The chapter also analyzes whether constraints increase the amount of time required to complete a rulemaking. Contrary to common expectations, some constraints are wildly ineffective. Chapter 4 discusses the implications. The results offer new evidence regarding the extent to which the administrative process responds to the Congress, president, and courts. The results also provide insight into the goals of Congress and the president with respect to administrative law. In concluding, Chapter 5 discusses future research directions.
