This is an approach that many contemporary jurists, those whose work presupposes the autonomy of legal order, tend to suppress. In this book, Martin Loughlin assesses the contribution made by political jurists and explains its contemporary significance. Political jurists maintain that the essential characteristics of modern legal order can only be revealed by considering how political authority is constituted. The political is orientated to the fact that people are organized into territorially-bounded units within which authoritative governing arrangements have been established, but the authority of this way of viewing the world is strengthened only through institution-building. Law may be an aspect of the political, but to perform its authority-generating functions effectively it must operate relatively autonomously. The political and the legal operate relationally, without one being reduced to the other. Loughlin introduces the rich literature of political jurisprudence through essays on innovative political jurists such as Hobbes, Burke, Constant, Romano, and Schmitt, and on such central themes as political right, institutionalism, constitutional legality, and reason of state. Book excerpt: "Toleration is one of the most studied concepts in contemporary political theory and philosophy, yet the range of contemporary normative prescriptions concerning how to do toleration or how to be tolerant is remarkably narrow and limited. Contemporary thinking about toleration evinces, paradoxically, an intolerance of politics. This book argues for toleration as a practice of negotiation, looking to a philosopher not usually considered political: Michel de Montaigne. For Montaigne, toleration is an expansive, active practice of political endurance in negotiating public goods across lines of value difference. In other words, to be tolerant means to possess a particular set of political capacities for negotiation. Douglas Thompson draws on Montaigne's Essais to recover the idea that political negotiation grows out of genuine care for public goods and the establishment of political trust. Thompson argues that we need a Montaignian conception of toleration today if we are to negotiate effectively the circumstances of increasing political polarization and ongoing value conflict, and he applies this notion to current debates in political theory, as well to contemporary issues, including the problem of migration and refugee asylum. Additionally, for Montaigne scholars, he reads the Essais principally as a work of public political education, and resituates the work as an extension of Montaigne's political activity as a high-level negotiator between Catholic and Huguenot parties during the French Wars of Religion"--

Book excerpt: Political Magic examines early modern British fictions of exploration and colonialism, arguing that narratives of intercultural contact reimagine ideas of sovereignty and popular power. These fictions reveal aspects of political thought in this period that official discourse typically shunted aside, particularly the political status of the commoner, whose “liberty” was often proclaimed even as it was undermined both in theory and in practice. Like the Hobbesian sovereign, the colonist appears to the colonized as a giver of rules who remains unruly. At the heart of many texts are moments of savage wonder, provoked by European displays of technological prowess. In particular, the trope of the first gunshot articulates an origin of consent and political legitimacy in colonial showmanship. Yet as manifestations of force held in abeyance, these technologies also signal the ultimate reliance of sovereigns on extreme violence as the lessthan-mystical foundation of their authority. By examining works by Cavendish, Defoe, Behn, Swift, and Haywood in conjunction with contemporary political writing and travelogues, Political Magic locates a subterranean discourse of sovereignty in the century after Hobbes, finding surprising affinities between the government of “savages” and of Britons.

But acts of violence, like U.S. drone strikes that indiscriminately kill civilians, and mass shootings that become terrorist attacks when suspects are identified as Muslim, suggest that definitions of terrorism are always contested. In Genealogies of Terrorism, Verena Erlenbusch-Anderson rejects attempts to define what terrorism is in favor of a historico-philosophical investigation into the conditions under which uses of this contested term become meaningful. The result is a powerful critique of the power relations that shape how we understand and theorize political violence. Tracing discourses and practices of terrorism from the French Revolution to late imperial Russia, colonized Algeria, and the post-9/11 United States, Erlenbusch-Anderson examines what we do when we name something terrorism. She offers an important corrective to attempts to develop universal definitions that assure semantic consistency and provide normative certainty, showing that terrorism means many different things and serves a wide range of political purposes. In the tradition of Michel Foucault’s genealogies, Erlenbusch-Anderson excavates the history of conceptual and practical uses of terrorism and maps the historically contingent political and material conditions that shape their emergence. She analyzes the power relations that make different modes of understanding terrorism possible and reveals their complicity in justifying the exercise of sovereign power in the name of defending the nation, class, or humanity against the terrorist enemy. Offering an engaged critique of terrorism and the mechanisms of social and political exclusion that it enables, Genealogies of Terrorism is an empirically grounded and philosophically rigorous critical history with important political implications.
