This wide-ranging and theoretical study demands that we think again about the legal regulation of sexual relations. It examines how both sense and nonsense of same-sex relations are made in law by way of ‘homosexual’. It explores how the introduction of an idea of homosexuality both promotes the continued abhorrence and increased punishment of same-sex relations and makes possible reforms in the law that promote respect for these relations. This study investigates the struggles that surround the review of the law on ‘homosexuality’ undertaken by the Wolfenden Committee in the 1950s and explores the peculiarities of the enactment of the term ‘homosexual’ into the law of England in 1967. It challenges the current understanding that ‘homosexual’ is either a term used to name a specific category of act or a term that is merely used to name an identity. The Homosexual(ity) of Law shows how ‘homosexual’ is a term that signifies both of these things, but it is also capable of expressing many other meanings. It explores the values that are given a voice through this new term in law. It also demonstrates that ‘homosexual’ in law is a reference to a complex technology of interrogation, surveillance and documentation that isolates gestures, speech and deportment and gives them meaning as ‘homosexual’ in law. Through an analysis of various police practices, the day-to-day decisions of the judiciary in high profile test cases and recent Parliamentary debates relating to the age of consent law reform, The Homosexual(ity) of Law explores the way this ‘homosexual(ity)’ is put to use in current legal practice.

Book excerpt: Consent, Stealthing and Desire-Based Contracting in the Criminal Law examines the inconsistencies in the definitions of consent in sexual encounters by examining emerging sex crimes alongside changing community values and the changing legal definitions of consent in sexual offending, focusing on common law and civil law countries. This book distinguishes itself through the use of empirically validated research strategies and an in-depth analysis of current legislative regimes. It argues that desire and pleasure are largely ignored by legal consent definitions, despite its importance in sexuality more broadly. Using two case studies of emerging forms of sexual offending, the criminalisation of sadomasochistic sexual practices and the offence of ‘stealthing’, it examines how the law is both a blunt and under-utilised instrument in the policing of people’s sexual relationships. The presence or absence of consent can change a lawful sexual act between two people into a serious crime with potentially devastating consequences to both survivor and offender. Yet there remains no consistent definition of consent applied within and between legal jurisdictions across the world. A comparative analysis reveals parallels between common law countries and civil law countries. The book also provides a brief history of the use of term consent in relation to sexual offending and examines definitional and sociological requirements of conceptual consent across history. In Melancholia and Moralism, Douglas Crimp confronts the conservative gay politics that replaced the radical AIDS activism of the late 1980s and early 1990s. He shows that the cumulative losses from AIDS, including the waning of militant response, have resulted in melancholia as Freud defined it: gay men's dangerous identification with the moralistic repudiation of homosexuality by the wider society. With the 1993 march on Washington for lesbian and gay rights, it became clear that AIDS no longer determined the agenda of gay politics; it had been displaced by traditional rights issues such as gay marriage and the right to serve in the military. Journalist Andrew Sullivan, notorious for pronouncing the AIDS epidemic over, even claimed that once those few rights had been won, the gay rights movement would no longer have a reason to exist. Crimp challenges such complacency, arguing that not only is the AIDS epidemic far from over, but that its determining role in queer politics has never been greater. AIDS, he demonstrates, is the repressed, unconscious force that drives the destructive moralism of the new, anti-liberation gay politics expounded by such mainstream gay writers as Larry Kramer, Gabriel Rotello, and Michelangelo Signorile, as well as Sullivan. Crimp examines various cultural phenomena, including Randy Shilts's bestseller And the Band Played On, the Hollywood films "Silence of the Lambs" and "Philadelphia," and Magic Johnson's HIV infection and retirement from the Los Angeles Lakers. He also analyzes Robert Mapplethorpe's and Nicholas Nixon's photography, John Greyson's AIDS musical "Zero Patience," Gregg Bordowitz's video "Fast Trip, Long Drop," the Names Project Quilt, and the annual "Day without Art."
