Key findings: (i) it is unacceptable that, more than a year after the Government announced it was phasing out the National Policing Improvement Agency, it still has not announced any definite decisions about the future of the vast majority of the functions currently performed by the Agency - the phasing out of the Agency should be delayed until the end of 2012; (ii) after the Olympics, the Home Office should consider making counter-terrorism a separate command of the New National Crime Agency, rather than it being the responsibility of the Metropolitan Police; (iii) the Government must urgently appoint a head of the new National Crime Agency; (iv) a Professional Body for policing could ultimately become a useful part of the policing landscape; (v) the Home Office should be more active in encouraging and supporting forces to collaborate with one another; (vi) IT across the police service as a whole is not fit for purpose and the Home Office must make revolutionising police IT a top priority; (vii) the review of pay and conditions is having an inevitable impact on morale in the police service, but it is possible to do more to mitigate this; (viii) The Committee commends the work of Jan Berry, the former Reducing Bureaucracy in Policing Advocate, in emphasising that reducing bureaucracy in the police service is not simply about reducing paperwork but addressing the causes of that paperwork.

Book excerpt: Draft legislation intended to deliver a more efficient and transparent local audit system may not save money, potentially undermines the integrity of the audit system and may fail to deliver accountability. The principle of independent audit - which has guided public sector audit for the last 150 years - could be undermined if the bill is not amended. Most witnesses criticised the proposed independent auditor panels and felt that they imposed an unnecessary additional bureaucratic burden. They expressed strong support for the retention of a central procurement capacity for appointing auditors to local bodies in order to deliver best value on audit fees. The legislation also has some gaping holes that pose significant risks. Unless stronger safeguards are put into the legislation, whistleblowers might not be able to draw attention to serious failures in local governance. The Comptroller & Auditor General of the National Audit Office should be named in the Bill alongside the appointed auditor, as another prescribed person who may be contacted by any whistleblower. It should also have a duty to publish detailed mandatory guidance to accompany the code and to report annually to Parliament on the Code's effectiveness. Lastly, there is great concern that the draft Bill makes no provision for comprehensive like for like value for money comparisons which would enable informed judgements about the way local bodies spend taxpayer's money. It is essential that the Bill is re-drafted to include a systematic process for benchmarking and like-for-like comparisons between public bodies in the new regime.

Yet the United Kingdom has no agreed process for constitutional change. The Committee does not accept that the government should be able to pick and choose which processes to apply when proposing significant constitutional change. These recommendations are not intended to restrict the government's right to initiate constitutional change, but to hold ministers to account for their decisions. Book excerpt: This report finds that the Government's desire to deliver localism is neither supported consistently across Whitehall nor implemented coherently by each department of state. MPs warn that the Minister for Decentralisation will need to bring coherence, rigour and clear priorities to the Government's programme. The MPs call for a more explicit statement about where the dividing line will be drawn between a central, light-touch framework for local services and unwarranted interference from ministers in local affairs. So far the Government has shown itself all too eager to impose its preferences on local decision-making. Ministers have also introduced policies that circumvent rather than empower local government: elected police commissioners, free schools, academies and health service reform, threaten to fragment rather than integrate delivery of better public services at local level. As devolution proceeds, the manner in which local decisions are taken come under greater scrutiny. Any reduction in the inspection and performance management required by Whitehall must be accompanied by stronger local democratic accountability. Broadening the provider base for public services is an important plank of the government's decentralisation agenda, but it remains unclear how far the 'Big Society' can expand to take on services and functions shed by statutory bodies. Localism should not be adopted purely as a way to curb public sector costs not least because the financial benefits of more tailored services may not offset the loss of efficiencies of scale. Stimulating greater democratic participation and civic activism will itself cost money if it is to be successful and sustainable.

Book excerpt: The Terrorism Act 2000 (Remedial) Order 2011, an urgent remedial order concerning exceptional counter-terrorism powers to stop and search without reasonable suspicion was made by the Home Secretary on 17 March 2011 and came into force on 18 March 2011. The purpose of the Order is to remove the incompatibility of the current statutory powers to stop and search without reasonable suspicion (in sections 44 to 46 of the Terrorism Act 2000) with the right to respect the private life in Article 8 of the European Convention on Human Rights ("ECHR"). The Joint Committee on Human Rights accepts the necessity of introducing a replacement stop and search power and agree with the Government there are compelling reasons for using the remedial order procedure. It does provide for much greater parliamentary scrutiny, but the Committee does recommend that the Government provides more detailed evidence of the sorts of circumstances in which the police have experienced the existence of an operational gap in the absence of a power to stop and search. Without such detailed scrutiny it is difficult for the Committee to reach a view as to the appropriateness of proceeding by urgent remedial order. The Committee also recommends that the Order be replaced with a new Order modifying the provisions and removing the incompatibility identified by the ECHR.
