Book excerpt: Colonel Robin Evelegh retired from the British Army in 1977, having commanded his infantry battalion on separate tours at the Springfield Road police station in Belfast in 1972 and 1973. it struck him forcibly at the time that the Government's overall campaign to restore a peacetime level of order in Northern Ireland seemed doomed to failure, although most of the conditions that could be thought necessary for success- skilled and sensitive politicians, devoted civil servants and a disciplined army and police force- were present. This failure, it became clear, arose from faults in the constitutional framework for controlling the campaign against insurrection, and from shortcomings in the laws which laid down the operational rules for the Security forces to suppress terrorism and disorder. The constitutional faults meant that the government's campaign could not be managed effectively, and the shortcomings in the laws meant that a heavy political price had to be paid for draconian legal powers that were almost irrelevant, while the security forces were crippled by the lack of quite minor laws which would have made them effective, and which carried only a modest political penalty. The reasons for these uncertainties and inadequacies are complex. Colonel Evelegh analyses them ruthlessly, and makes their consequences clear - powerfully illustrating his thesis from personal experience in Northern Ireland, from the past, and from counter-insurgency campaigns of recent times. His remedies are argued in detail.

Book excerpt: This book provides an account and analysis of policing in Northern Ireland, providing an account and analysis of the RUC (Royal Ulster Constabulary) from the start of 'the troubles' in the 1960s to the early 1990s, through the uneasy peace that followed the 1994 paramilitary ceasefires (1994-1998), and then its transformation into the Police Service of Northern Ireland following the 1999 Patten Report. A major concern is with the reform process, and the way that the RUC has faced and sought to remedy a situation where it faced a chronic legitimacy deficit. Policing Northern Ireland focuses on three key aspects of the police legitimation process: reform measures which are implemented to redress a legitimacy crisis; representational strategies which are invoked to offer positive images of policing; and public responses to these various strategies. Several key questions are asked about the ways in which the RUC has sought to improve its standing amongst nationalists: first, what strategies of reform has the RUC implemented? second, what forms of representation has the RUC employed to promote and portray itself in the positive terms that might secure public support? third, how have nationalists responded to these initiatives? The theoretical framework and analysis developed in the book also highlights general issues relating to the implications of police legitimacy and illegitimacy for social conflict and divisions, and their management and/or resolution, in relation to transitional societies in particular. In doing so it makes a powerful contribution to wider current debates about police legitimacy, police-community relations, community resistance, and conflict resolution.

The United Kingdom is used as a primary source because English law regulating political violence has been continually refined in the 300 years since the Glorious Revolution and has served as a paradigm for other countries that derive their jurisprudence from that experience. Ireland represents what might be called the post-revolutionary variation. Its laws were drafted and are administered by rebels and the children of rebels, who clearly recall the successes and failures of the British campaigns in their country, and who continue to observe the repercussions of pacification efforts in Northern Ireland. Because there are fewer Irish court decisions and because Irish law in many instances mirrors the law of the United Kingdom, only that Irish material which adds a distinctive perspective is included. The United States presents a third, peaceful model and a country which is increasingly confronted by terrorist acts. The themes addressed in this book revolve around legal efforts to reconcile security considerations with those liberal democratic values which the nations consider to be their constitutional heritage. Part I looks at the treatment of aliens - both those who seek admission and those admitted whom the state decides to expel. Part II examines selected problems involving citizens' rights, and the extent (if any) to which these rights can be impaired by anti-terrorist measures. Part III focuses on these institutional restraints on governmental behaviour derived from legislation or from common law.
