Book excerpt: U.S.-Russian trade is governed by Title IV of the Trade Act of 1974, which conditions Russia's normal trade relations (NTR) status, including the "freedom-of-emigration" requirements of the Jackson-Vanik amendment. On December 16, 2011, the 153 members of the World Trade Organization (WTO) invited Russia to join the organization, after Russia completed an 18-year accession process. The WTO requires each member to accord newly acceding members "immediate and unconditional" most-favored-nation (MFN) status, which is called NTR in U.S. law. Russia is expected to formally join the WTO sometime in the summer after its parliament has approved the accession package, which is expected to occur sometime in early July. In order to comply with the WTO rule, the United States would have to change Russia's status from conditional NTR to unconditional or permanent NTR (PNTR).

Book excerpt: On December 8, 2006, the House passed legislation (212-184) to grant Vietnam permanent normal trade relations (PNTR) status as part of a more comprehensive trade bill (H.R. 6406). Pursuant to H.Res. 1100, the bill was then coupled with a taxextension bill (H.R. 6111) and sent to the Senate. The Senate passed the combined bills on December 8 (79-9). On December 20, 2006, President Bush signed the bill into law (P.L.109-432) and, per the law, proclaimed PNTR for Vietnam on December 29, 2006. Congress considered PNTR in the context of Vietnam's accession to the World Trade Organization (WTO), which Vietnam joined in January 2007. Although Congress had no direct role in Vietnam's accession to the WTO, congressional approval was necessary for the President to extend PNTR to Vietnam. The WTO requires its members to extend unconditional most-favored-nation status (MFN), called PNTR in the United States, in order to receive the full benefits of WTO membership in their bilateral trade relations. Until PNTR was granted, the United States had extended conditional NTR treatment to Vietnam under Title IV of the Trade Act of 1974, as amended, which includes the so-called Jackson-Vanik amendment (section 402). Title IV prohibits the President from granting certain countries permanent NTR unless the country has met certain conditions. Vietnam's entry into the WTO does not establish any new obligations on the part of the United States, only on the part of Vietnam. However, Vietnam's WTO accession requires the United States and Vietnam to adhere to WTO rules in their bilateral trade relations, including not imposing unilateral measures, such as quotas on textile imports, that have not been sanctioned by the WTO. Accession to the WTO affords Vietnam the protection of the multilateral system of rules in its trade relations with other WTO members, including the United States. It could help the United States in that Vietnam would be obligated to apply WTO rules in its trade. PNTR status from the United States provides Vietnam more predictability its growing trade relations with the United States and sheds a legacy of the cold war. For the United States, PNTR is another in a series of steps the United States has taken in trade and foreign policy to normalize relations with Vietnam and place distance between current relations and the Vietnam War. During the congressional debate on PNTR, Members raised issues regarding the conditions for Vietnam's entry into the WTO, other issues pertaining to the U.S.Vietnam economic relationship, and other aspects of the overall U.S.-Vietnam relationship.

On November 19, 2006, U.S. and Russian officials signed the bilateral agreement on Russia's accession to the World Trade Organization (WTO). This step allowed Russia to move much closer to acceding to the WTO and also made it likely that the 110th Congress will confront the issue of whether to grant Russia PNTR. This report will be updated as events warrant.

By becoming a full member of the WTO, China has in fact made three tiers of commitments. The first tier is the commitment to the objectives of the WTO, such as free trade, most-favoured nations, national treatment and transparency, as expounded in the various documents setting up the organization and its predecessor, the GATT. The second tier is the commitment to the set of rules governing trade for specific sectors, such as agricultural and textile goods, or information technology and telecommunications. This is set out in China's accession protocol. The third tier is the commitment to bilateral agreements which China signed with her major trading partners. Their support is mandatory before China can be admitted to the WTO and therefore she has to satisfy each of them through elaborate bilateral negotiations. This handbook highlights the important commitments that China has made to the international community and analyzes the potential impact of such commitments on China.Part I of the book outlines China's commitments to convert her economy from a centrally planned one to a free market one as far as cross-border movement of goods, services and personnel is concerned. It reproduces China's commitments in a tabular format to facilitate reading, and is supplemented with brief references to WTO regulations where appropriate so that readers get to know how China's commitments relate to WTO obligations. Part II examines the impacts of China's WTO membership as a whole and on her specific economic sectors. Part III consists of Tables and Figures selected from a Report compiled by the US General Accounting Office, presenting some of the Office's analysis and findings of China's commitments on WTO accession.Appendix 1 lists all the legal instruments pertaining to China's accession to the WTO.
