Since that time the advocates of the doctrine of popular consent as the sine qua non of territorial settlements involving changes of sovereignty have endeavored to secure its universal recognition in theory as well as in practice. In the course of the nineteenth century plebiscites have been held in a number of territorial transfers, resulting in changes of sovereignty without, however, establishing the resort to such popular votes as a general practice in international law. In the attempt to form an opinion as to the justification of the employment of a plebiscite in the determination of sovereignty, either as a general principle or as a proper mode of settlement in individual cases, we turn instinctively to the past in search of its precedents illustrating the practice of the nations, and for records of opinions of leading statesmen and international jurists. The present study aims to estimate the evolutionary momentum of the doctrine actually applied, in so far as it is traceable through the mass of alleged or genuine precedents of ancient, feudal, and modern times, and to consider the theoretical and practical aspect of the subject from the point of view of international and constitutional law in the light of more recent developments. The most complete collection of precedents which a review of the bibliography of the subject seems to offer is found in F. Book excerpt: Plebiscites, or referendums, are epitomes of direct democracy and the right of self-determination. While direct democracy has always been a key subject in the theory and practice of western liberal democracies, the issue of self-determination has been propelled to the fore by the hegemonistic moves of Russia. By providing a historical analysis of the post-World War One plebiscites, this book deals with enduring, painfully contemporary, and in in any case fundamental, concepts. The contributors to this edited volume approach the referendums comparatively. After grounding the analysis theoretically, the authors look at detailed aspects of individual cases, with the two plebiscites held in the Danish-German border region of Schleswig in the winter of 1920 as points of departure. They then extend the exploration through the inter-war period and address the effects of border delimitations on everyday life or gender roles in the context of ethnic mobilization. Finally, the book places the post-World War One plebiscites in a long-term perspective. The concluding essays assess, among others, the applicability of plebiscitary solutions to contemporary conflicts, taking into consideration issues of borders, religion, language, identity, and minority rights.

Book excerpt: The use of referendums around the world has grown remarkably in the past thirty years and, in particular, referendums are today deployed more than ever in the settlement of constitutional questions, even in countries with little or no tradition of direct democracy. This is the first book by a constitutional theorist to address the implications of this development for constitutional democracy in a globalizing age, when many of the older certainties surrounding sovereignty and constitutional authority are coming under scrutiny. The book identifies four substantive constitutional processes where the referendum is regularly used today: the founding of new states; the creation or amendment of constitutions; the establishment of complex new models of sub-state autonomy, particularly in multinational states; and the transfer of sovereign powers from European states to the European Union. The book, as a study in constitutional theory, addresses the challenges this phenomenon poses not only for particular constitutional orders, which are typically structured around a representative model of democracy, but for constitutional theory more broadly. The main theoretical focus of the book is the relationship between the referendum and democracy. It addresses the standard criticisms which the referendum is subjected to by democratic theorists and deploys both civic republican theory and the recent turn in deliberative democracy to ask whether by good process-design the constitutional referendum is capable of facilitating the engagement of citizens in deliberative acts of constitution-making. With the referendum firmly established as a fixture of contemporary constitutionalism, the book addresses the key question for constitutional theorists and practitioners of how might its operation be made more democratic in age of constitutional transformation.
