Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Important Features of Pleading and Practice: Under the New York Civil Practice Act A perhaps not surprising but at least significant fact is that since October lst, 1921, there have been over 650 decisions relating to sections of the Civil Practice Act and the Rules of Civil Practice appearing in the New York Law Journal alone. All of these decisions, and also a considerable number from other parts of the state, have been carefully considered in connection with these lectures. It is a great pleasure to note that, with a very few exceptions, the distinct tendency of the courts in all parts of the state has been to interpret the provisions of the new law in a broad and liberal spirit. No doubt some errors will be found herein. It is hoped they may be few and that they may not be judged too harshly. Book The Rules of Pleading Under the New York Code and the Codes of Other States and the Practice Relating to Pleading

This book was released on 2017-10-11 with total page 824 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Rules of Pleading Under the New York Code and the Codes of Other States, and the Practice Relating to Pleading: With an Appendix of Forms New York Code of Civil Procedure, would be found of use to the practitioner in other Code States. In addition to the statement of the rules of pleading, a few chapters of the book have been devoted to the practice relating to pleading, and an appendix of forms is given. These forms are intended rather as suggestions than as precedents, for under the present system, precedents of pleadings are of doubtful value. Each cause of action set forth in a pleading must stand or fall upon the facts of that particular case; and no collection of forms can furnish a system of ready-made pleadings, though it may serve as a reminder of a necessary allegation that other wise would have been omitted. The general plan of the work appears in the table of contents, and the matters of detail in the index. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from The Principles of Pleading in Civil ActionsIT has been remarked by high authority that if the practice of Special Pleading were entirely banished from the courts, the science of Pleading would still be the most instructive branch of the Common Law.1 Therefore every student should learn to plead, accord ing to the laws of Special Pleading. The science should be studied and carried into practice, although the penalties attending an infringement of its strict rules have been most properly mitigated.About the PublisherForgotten Books publishes hundreds of thousands of rare and classic books. Book Hand Book of Common Law Pleading Classic Reprint

Download or read book Hand Book of Common Law Pleading Classic Reprint written by Benjamin Jonson Shipman and published by Forgotten Books. This book was released on 2017-11-10 with total page 640 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Hand-Book of Common-Law Pleading In the following pages, the writer has endeavored to state, as clearly and concisely as possible, such of the rules and principles of common-law pleading as are still recognized and applied in this country, omitting such of those found in the old English system as have become obsolete in practice, except where, as in the case of special pleading, they are the foundation of the method now in use, and giving due prominence to those rules whose principles are most noticeably applied in pleading under the codes. Whether the common-law rules are to be taken as directly followed in the latter, aside from the formalities prescribed in the practice acts, or wheth er the rules and principles of code pleading are to be considered as derived simply and only from the statute, the fact remains that a knowledge of the common-law system cannot fail to be of advantage, if, indeed, it is not an essential, to a thorough understanding of both code and equity pleading. It has been the observation and ex perience of the writer, not only that such knowledge enables a lawyer to frame his pleadings under the latter systems with greater ease and accuracy, but that, especially in code pleading, doubts as to the necessity or propriety of particular allegations, where the statute is silent or obscure in its directions, can generally be easily disposed of by an understanding of the reason of the common-law rule in similar cases. A lawyer who enters upon the active practice of his profession with no other guide than what the codes prescribe is but poorly qualified for attaining the important result of placing the statement of a complicated and important case before the court in a logical and concise form. Book Practice and Pleading in Civil Actions and Proceedings at Law in All the Courts of Massachusettts

Download or read book Practice and Pleading in Civil Actions and Proceedings at Law in All the Courts of Massachusettts written by Joseph Mason and published by Forgotten Books. This book was released on 2018-02-11 with total page 694 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Practice and Pleading in Civil Actions and Proceedings at Law in All the Courts of Massachusettts: With a Chapter on Equity Jurisdiction and Practice Under the Statute of 1883, Chapter 223 The recent revision of the Statutes of Massachusetts created a need of a new work on practice in civil ao tions in the courts of the State. In the following pages I have endeavored to supply that want. A work on practice must necessarily treat of a great number of subjects, and consequently, in a treatise limited to a single volume, cannot be exhaustive upon all. The subjects considered in this work, though numerous, are such as strictly belong to a work on practice, and are treated in it with special reference to their application to practice in the courts. N o pains have been spared to bring the matter within as small a compass as was consistent With the object and purpose of the work. Consequently I have not unnecessarily encumbered it with common forms of process in general use, but have included in it only such forms of process and procedure as may not otherwise be easily attainable by members of the bar. I have endeavored to embody in the work the rules of practice in our courts, as contained in the statutes of the State and in the rules and decisions of the courts at the present time, not omitting such matters of nu written law in relation to practice as may be useful to the young practitioner. Download or read book The Encyclopaedia of Pleading and Practice Classic Reprint written by William Mark McKinney and published by Forgotten Books. This book was released on 2017-11-10 with total page 1184 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Encyclopaedia of Pleading and Practice Missouri. In Crane Missouri Pac. R. Co., 87 Mo. 588, the court said: It has been settled in this state, since the case of Thompson North Missouri R. Co., 51 mo. 191, that contributory negligence is a matter of defense, and that the onus of establishing it is on the defendant, and the rule has been reiterated in the late case of Stephens v. Macon, 83 Mo. 345. If the onus of proving contributory negligence, or of knowledge on the part of the plaintiff of defective ma chinery, rests on the defendant, it would be a singular rule of pleading to require a plaintiff to aver negatively that he was not guilty of contributory negli gence, or did not have knowledge of defective machinery; neither one of which he would be required to prove to make out his case. Book Practice and Pleading in Actions in the Courts of Record in the State of New York Under the Code of Procedure and Other Statutes When Applicable

Download or read book Practice and Pleading in Actions in the Courts of Record in the State of New York Under the Code of Procedure and Other Statutes When Applicable written by Henry Whittaker and published by Forgotten Books. This book was released on 2017-11-07 with total page 1066 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Practice and Pleading in Actions in the Courts of Record in the State of New York, Under the Code of Procedure, and Other Statutes, When Applicable: With an Appendix of Forms The author has, on the other hand, omitted from the present edition his former brief notice of independent special proceedings, and also the concluding chapter as to the retrospective effect of the Code. The latter subject has become practically obsolete; the former is, in fact, foreign to the plan of the work. That plan remains substantially the same as before. The progress of a suit in the higher courts of the state is traced, from its origin and preliminaries, down to its final determination; practical directions being given for its conduct and management, in each step which may be necessary or advisable during that progress. The provisions of the Code, of the Revised or General Statutes, and of the Rules of the Courts, which bear upon each particular division of the general subject, are, on the present occasion, cited in the body of the work, instead of being subjoined at its close. An appendix of forms is added, as heretofore, and each volume closes with an index of the subjects considered in it. The first embraces all matters connected, directly or indirectly, with the commencement and progress of a suit, down to the preparation and service of the complaint, inclusive; the second, all subsequent stages of procedure, in that suit, down to its close. Book Practice and Pleading in Personal Actions in the Courts of Massachusetts Classic Reprint

This book was released on 2015-07-12 with total page 688 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Practice and Pleading in Personal Actions in the Courts of Massachusetts In the preparation of the present edition, the second edition has been thoroughly revised, and all obsolete matter stricken out. A large amount of new matter has been added, under the different topics treated of; among which may, especially, be mentioned the subjects of the Courts and their Jurisdiction, Certiorari, Review, Writ of Error, Trustee Process, Judgment and Execution, Appeals, and Exceptions. The new matter added to the book amounts, altogether, to about one hundred pages. About five hundred citations of cases have been added, including all the cases decided, upon points of pleading or practice, by the Supreme Judicial Court, since the publication of the second edition. All new legislation in any way affecting the subjects treated of, from that of the legislative session of 1883 to and including the important legislation of the session of 1893, has been noted. Gratefully acknowledging the favor with which the former editions of their work have been received, the authors submit the present edition to the indulgent consideration of the legal profession of the Commonwealth.
