Book excerpt: Since 2000s, Africa and India severally rejected the notion that UPOV's 1991 standard of Plant Breeders Rights (PBRs) is the only route to fulfill their obligations under Article 27 of the TRIPs Agreement. Objecting to the exclusive focus of the UPOV regime on formal plant breeders, African countries, insisted on a holistic approach to plant breeders' rights to include protection for rights of communities, farmers and their indigenous knowledge, innovation and practices. Consequently, under the African Union's (AU) auspices, Africa proposed the Model Law for the Protection of the Rights of Local Communities and Breeders, and for Regulations of Access to Biological Resources. Self-evidently, the law not only recognizes the centrality of the smallholder indigenous and local community farmers on the continent's food production, it also underscores the interconnections of biodiversity conservation, farmers' rights, traditional knowledge, access and benefit sharing over genetic resources within then emergent international regimes. Nearly two decades after, Africa's resolve has proven to be fickle. The continent has reversed itself and fully embraced the UPOV regime. At about the same time as the Model Law, India enacted the Protection of Plant Varieties and Farmers' Rights Act, 2001 - an instrument consistent with the spirit of Africa's Model Law. Both regimes take into account the role of local farmers as the backbone of agricultural innovation, food production and food security in the developing world, including Africa and India, thereby further enhancing the idea of farmers' rights in food and agriculture law and policy. This Article juxtaposes the circumstances around Africa's failure of resolve and India's wobbly experience over farmers' rights. It calls attention to farmers' rights as a site for a missed and yet potentially redeemable opportunity for both Africa and India to advance South-South solidarity for food security.

The success stories have brought substantial achievements as regards one or more of the four elements of Farmers' Rights: the rights of farmers to save, use, exchange and sell farm-saved seed; the protection of traditional knowledge; benefit- sharing; and participation in decision-making. This does not mean that these examples are perfect. Challenges encountered on the way are conveyed and offer important lessons. The stories represent different regions and localities, including Europe, Asia, Africa and Latin America, as well as various categories of stakeholders and types of initiatives and policies.

Book excerpt: Over the last 50 years there has been a growing appreciation of the important role that farmers play in the development and conservation of crop genetic diversity, and the contribution of that diversity to agro-ecosystem resilience and food security. This book examines policies that aim to increase the share of benefits that farmers receive when others use the crop varieties that they have developed and managed, i.e., ‘farmers varieties’. In so doing, the book addresses two fundamental questions. The first question is ‘how do farmer management practices – along with other factors such as environment and the breeding systems of plants – affect the evolution and maintenance of discrete farmers’ varieties?’ The second question is ‘how can policies that depend on being able to identify discrete plant varieties accommodate the agricultural realities associated with the generation, use and maintenance of farmers’ varieties?’ This focus on discreteness is topical because there are no fixed, internationally recognized taxonomic or legal definitions of farmers’ varieties. And that presents a challenge when developing policies that involve making specific, discrete farmers’ varieties the subject of legal rights or privileges. The book includes contributions from a wide range of experts including agronomists, anthropologists, geneticists, biologists, plant breeders, lawyers, development practitioners, activists and farmers. It includes case studies from Asia, Africa, Latin America and Europe where, in response to a diversity of contributing factors, there have been efforts to develop policies that provide incentives or rewards to farmers as stewards of farmers’ varieties in ways that are sensitive to the cultural, taxonomic and legal complexities involved. Book excerpt: This article examines the international legal framework in which traditional farmers and agricultural biotechnology (agro-biotech) protect their knowledge and plant genetic resources. Traditional farms and agro-biotech both play significant roles in enhancing global food security and biodiversity. Legal measures to protect the knowledge of agro-biotech and traditional farmers were deployed by nations with a head start in the agro-biotech industry. The resulting system of utility patents and the sui generis concept of plant breeders' rights often subordinates the claims of farmers under those of agro-biotech. The author argues the current regime under the International Treaty on Plant Genetic Resources for Food and Agriculture (ITPGRFA) is inadequate to moderate the inequities created by intellectual property in plant genetic resources. Agro-biotech alone cannot ensure global food security and sustainable agriculture, nor can an intellectual property system that undermines local and traditional agriculture. Traditional farming knowledge is indispensable to ensuring that culturally acceptable food is accessible around the globe. A two-pronged approach to inequities in the current intellectual property system is possible. First, developing countries can use national legislation to comprehensively define farmers' rights beyond the ITPGRFA. Second, the governing body of the treaty can prioritize interpreting Article 12.3(d) of the Treaty with regard for the expectations of developing countries.

Book excerpt: Community seed banks first appeared towards the end of the 1980s, established with the support of international and national non-governmental organizations. This book is the first to provide a global review of their development and includes a wide range of case studies. Countries that pioneered various types of community seed banks include Bangladesh, Brazil, Ethiopia, India, Nepal, Nicaragua, the Philippines and Zimbabwe. In the North, a particular type of community seed bank emerged known as a seed-savers network. Such networks were first established in Australia, Canada, the UK and the USA before spreading to other countries. Over time, the number and diversity of seed banks has grown. In Nepal, for example, there are now more than 100 self-described community seed banks whose functions range from pure conservation to commercial seed production. In Brazil, community seed banks operate in various regions of the country. Surprisingly, despite 25 years of history and the rapid growth in number, organizational diversity and geographical coverage of community seed banks, recognition of their roles and contributions has remained scanty. The book reviews their history, evolution, experiences, successes and failures (and reasons why), challenges and prospects. It fills a significant gap in the literature on agricultural biodiversity and conservation, and their contribution to food sovereignty and security.

This book also makes strong argument for a FR almost at par with PBR, by suggesting amendments in the international and Indian level.

The book consists of 11 chapters. Chapter 1 locates intellectual property rights within the armoury of food security policies. Chapter 2 deals with definitional issues and examines the role of intellectual property rights in incentivizing agricultural research and development. Chapter 3 examines the international landscape of intellectual property and the approaches taken to the relationship between intellectual property rights, agricultural biotechnology, access to biological resources, food security and globalization which are taken by the WTO, FAO, CBD and WIPO among the various international and development agencies. Plant variety rights (PVRs) are a specially created form of intellectual property right originally minted to encourage agricultural innovation and Chapter 4 examines the effectiveness of PVRs in a food security context. Agricultural innovation is in part dependent upon access of researchers to the genetic resources of the biodiverse countries of the South. Chapter 5 considers the attempts to construct an international regime to secure this access. The important role of traditional farmers in preserving landraces and cultivars from which improvements can be derived has generated for a call for the recognition of farmers' rights, and this is examined in Chapter 6 together with agitation for the protection of the traditional knowledge which often informs access to the useful genetic resources. Chapter 7 examines the intellectual property implications of the use of genetically modified (GM) crops as a technological solution to food insecurity. The protection of GM crops is achieved through patent protection and Chapter 9 looks at the competition law implications of patent licensing, patent pools and patent thickets. An old intellectual property device that underpinned the commercial development of European agricultural marketing is the geographical indication, and Chapter 8 examines the contribution it might make to achieving food security. Returning to the theme of the role of intellectual property law in incentivizing innovation, Chapter 10 examines its role in promoting agricultural research. The concluding chapter proposes a number of recommendations for action in deploying intellectual property law in the struggle for food security.

However, there remain several grey areas and the rights of farmers, in reality, are still tenuous. Though the rights framework was foregrounded on an understanding between non-governmental organizations and industry, there is lack of clarity at both conceptual and procedural levels. In this context, Sophy K. Joseph analyses the impact of legal policy reforms during the ongoing Second Green Revolution on farmers’ customary rights and livelihood. The author discusses how the extension of private property rights to plant varieties, seeds, and other agrarian resources changed the demographic composition of the rural space, with increased migration of cultivators to the cities. The book argues that the transition from state interventionism (during the First Green Revolution) to state abstention (in the Second Green Revolution) has dramatically influenced India’s conventional agrarian practices and traditions. This work maps the evolutionary process of neoliberal economic and legal policies and its interference with primary concerns such as food security, food sovereignty, and agrarian self-reliance of the country.
