Available in PDF, EPUB and Kindle. Book excerpt: To whom does a painted tablet—a tabula picta—belong? To the owner of the physical piece of wood on which an image is painted? Or to the person who made the painting on that piece of wood? By extension, one might ask, who is the owner of a text? Is it the person who has written the words, or the individual who possesses the piece of parchment or slab of stone on which those words are inscribed? In Tabula Picta Marta Madero turns to the extensive glosses and commentaries that medieval jurists dedicated to the above questions when articulating a notion of intellectual and artistic property radically different from our own. The most important goal for these legal thinkers, Madero argues, was to situate things—whatever they might be—within a logical framework that would allow for their description, categorization, and placement within a proper hierarchical order. Only juridical reasoning, they claimed, was capable of sorting out the individual elements that nature or human art had brought together in a single unit; by establishing sets of distinctions and taxonomies worthy of Borges, legal discourse sought to demonstrate that behind the deceptive immediacy of things, lie the concepts and arguments of what one might call the artifices of the concrete.

Book Droit et coutume en France aux XIIe et XIIIe si cles

Download or read book Droit et coutume en France aux XIIe et XIIIe si cles written by André Gouron and published by Taylor & Francis. This book was released on 2024-10-28 with total page 323 pages. Available in PDF, EPUB and Kindle. Book excerpt: This third volume by André Gouron brings together a widely scattered set of articles on Roman law in medieval France and its influence. The first group of papers is concerned with the medieval history of Roman law itself, while the two following sections look at how it contributed to the (perfectionnement) of canon law, on the one hand, and to the emergence of customary law on the other. As the author would see it, there are the three aspects of the inexorable advance, if not of a science, at least of a clear effort towards logical clarification, which revolutionised law in the 12th and 13th centuries, first in southern Europe, but soon in the west and north too. At the same time, these studies help reveal some of the complex network of intellectual links that underlay these developments.

Book Studies in the History of Medieval Canon Law

Download or read book Studies in the History of Medieval Canon Law written by Stephan Kuttner and published by Taylor & Francis. This book was released on 2024-10-28 with total page 371 pages. Available in PDF, EPUB and Kindle. Book excerpt: This fourth selection of articles by Professor Kuttner complements the volumes previously published by Variorum. Its subject is the history of the Church law of the Middle Ages, and the manner in which it has been studied. One group of articles is particularly concerned with the broader implications of medieval law, with its role in the history of doctrines and ideas: other sections focus on the history of the Glossators in modern research, and on the canonists of the period following the Decretals of Pope Gregory IX ” the Glossa Ordinaria and the works of St Raymond of Peñafort and Johannes Andreae form specific areas of interest. As in the previous volumes, there is an extensive section of 'Retractiones", recording the results of further research and assiduously detailing and commenting upon work done in the field since the articles were first published. To facilitate access to all this material, important indexes have also been provided.

Download or read book Pionniers du droit occidental au Moyen Age written by André Gouron and published by Taylor & Francis. This book was released on 2023-05-31 with total page 363 pages. Available in PDF, EPUB and Kindle. Book excerpt: 'Pioneers' seems fitting to Professor Gouron to describe the jurists (civilists) of the 12th-century Latin West, that were the bearers of a new science, born in Bologna about 1100. Away from Bologna these pioneers were isolated, scattered from Scotland to Styria or Catalonia, and no more than one hundred can now be identified. These people, and their manuscripts and the relationships between them, are the subject of this collection, the fifth in the Variorum series by André Gouron, himself to be regarded as a pioneer in this field of research. This volume brings together twenty-two studies which have appeared since 1997 in widely scattered publications, often hard to access, along with additional notes and indexes.

Book Juristes et droits savants Bologne et la France M di val

Download or read book Juristes et droits savants Bologne et la France M di val written by André Gouron and published by Taylor & Francis. This book was released on 2024-10-28 with total page 282 pages. Available in PDF, EPUB and Kindle. Book excerpt: This fourth collection by Professor André Gouron presents a set of twenty studies on jurisprudence, jurists and legal practice in the 12th and 13th centuries. The focus is on the schools and traditions of Bologna and in France, but the coverage includes canon, Roman and customary law. The first part deals with theories diffused by the jurists of Bologna and France and the literary genres in which they expressed these theories, particularly on questions of presumptions, proof, and illicit conditions. In the second section the author looks at some of the persons involved in the juridical renaissance of this period, and at some of the effects of the legal doctrines being taught on royal legislation, procedure, the fiscal system, and urban autonomy.

Available in PDF, EPUB and Kindle. Book excerpt: Bracton's relation to the Roman Law is one of the most interesting questions in historical jurisprudence. In this, as in other matters connected with the early history of the English law, Bracton is the most important authority. The period at which he wrote, his ability as a jurist, the richness of matter in his work, all combine to make it necessary to exhaust the sources of knowledge to be derived from him. An index & marginal notes have been added to the translation, & the table of contents has been enlarged.
