Book excerpt: Excerpt from A Philosophical and Practical Treatise on the Will In offering to the public the following Treatise on the Will, I am obliged to presume, in no small degree, on its forbearance and candour. It is a subject, which, in some of its applications, has been so long connected with Theological controversies, that it is almost impossible to write upon it, without exciting the suspicion, that the discussion will assume a party character. I hope the reader will do me the justice in the outset to believe, that my object is not a party one, and that the ascertainment of truth is my only aim. If he will take the trouble carefully to read the Treatise through, as I hope he will before pronouncing an opinion upon it, I anticipate the pleasure of standing fair in his estimation, as a candid inquirer after the truth, whether I have been successful in my efforts or not. I presume the reader, and the public generally, will agree with me in the admission, that the subject of the Will is one of great importance, both theoretically and practically. And yet there can be no hesitation in saying, that it has never received that attention from mental philosophers, which is due to it. Allison takes a distinctive two-level approach. On the one hand, he considers Hume's thought in its own terms and historical context. So considered, Hume is viewed as a naturalist, whose project in the first three parts of the first book of the Treatise is to provide an account of the operation of the understanding in which reason is subordinated to custom and other non-rational propensities. Scepticism arises in the fourth part as a form of metascepticism, directed not against first-order beliefs, but against philosophical attempts to ground these beliefs in the "space of reasons." On the other hand, Allison provides a critique of these tenets from a Kantian perspective. This involves a comparison of the two thinkers on a range of issues, including space and time, causation, existence, induction, and the self. In each case, the issue is seen to turn on a contrast between their underlying models of cognition. Hume is committed to a version of the perceptual model, according to which the paradigm of knowledge is a seeing with the "mind's eye" of the relation between mental contents. By contrast, Kant appeals to a discursive model in which the fundamental cognitive act is judgment, understood as the application of concepts to sensory data, Whereas regarded from the first point of view, Hume's account is deemed a major philosophical achievement, seen from the second it suffers from a failure to develop an adequate account of concepts and judgment.

It tells the tale of two lectures and their legacies: Oliver Wendell Holmes, Jr.’s “The Path of Law” (1897) and H.L.A. Hart’s Holmes Lecture, “Positivism and the Separation of Law and Morals” (1958). Holmes’s radical challenge to late 19th century legal science gave birth to a rich variety of competing approaches to understanding law and legal reasoning from realism to economic jurisprudence to legal pragmatism, from recovery of key elements of common law jurisprudence and rule of law doctrine in the work of Llewellyn, Fuller and Hayek to root-and-branch attacks on the ideology of law by the Critical Legal Studies and Feminist movements. Hart, simultaneously building upon and transforming the undations of Austinian analytic jurisprudence laid in the early 20th century, introduced rigorous philosophical method to English-speaking jurisprudence and offered a reinterpretation of legal positivism which set the agenda for analytic legal philosophy to the end of the century and beyond. A wide-ranging debate over the role of moral principles in legal reasoning, sparked by Dworkin’s fundamental challenge to Hart’s theory, generated competing interpretations of and fundamental challenges to core doctrines of Hart’s positivism, including the nature and role of conventions at the foundations of law and the methodology of philosophical jurisprudence.
