Book excerpt: Parties negotiating the end of authoritarian regimes or armed conflicts are almost inevitably left in a situation of legal uncertainty. Despite their overlapping scope of application, the differences between the approaches of International Criminal Law (ICL) and Transitional Justice (TJ) are so profound that, unless dogmatisms are left aside and a process of dialogue is entered into, it will not be possible to harmonize the current legal regime of international crimes with the need to articulate transitional processes that are capable of effectively overcoming authoritarian regimes and armed conflicts. The serious material limitations shown by national, international and hybrid ICL enforcement mechanisms should be acknowledged and the goals pursued by ICL should be redefined accordingly. A minimum level of consensus on the scope of application, goals and elements of TJ should also be reached. Situations of systematic or large scale violence against the civilian population by transnational criminal organizations increase the challenge.

A stellar group of scholars investigate the challenges that international courts face in transforming the formal legal authority conferred by states into an actual authority in fact that is respected by potential litigants, national actors, legal communities, and publics. Alter, Helfer, and Madsen provide a novel framework for conceptualizing international court authority that focuses on the reactions and practices of these key audiences. Eighteen scholars from the disciplines of law, political science and sociology apply this framework to study thirteen international courts operating in Africa, Latin America, and Europe, as well as on a global level. Together the contributors document and explore important and interesting variations in whether the audiences that interact with international courts around the world embrace or reject the rulings of these judicial institutions. Alter, Helfer, and Madsen's authority framework recognizes that international judges can and often do everything they 'should' do to ensure that their rulings possess the gravitas and stature that national courts enjoy. Yet even when imbued with these characteristics, the parties to the dispute, potential future litigants, and the broader set of actors that monitor and respond to the court's activities may fail to acknowledge the rulings as binding or take meaningful steps to modify their behaviour in response to them. For both specific judicial institutions, and more generally, the book documents and explains why most international courts possess de facto authority that is partial, variable, and highly dependent on a range of different audiences and contexts - and thus is highly fragile. An introduction situates the book's unique approach to conceptualizing international court authority within theoretical debates about the authority of global institutions. International Court Authority also includes critical reflections on the authority framework from legal theorists, international relations scholars, a philosopher, and an anthropologist. The book's conclusion questions a number of widely shared assumptions about how social and political contexts facilitate or undermine international courts in developing de facto authority and political power.

Countless thousands of others have been tortured; no one knows how many have disappeared. Caught between government forces and organized crime cartels, the Mexican people have suffered as atrocities and impunity reign. Based on three years of research, over 100 interviews, and previously unreleased government documents, this report finds a reasonable basis to believe that government forces and members of criminal cartels have perpetrated crimes against humanity in Mexico. The report comprehensively examines why there has been so little justice for atrocity crimes, and finds the main answers in political obstruction. Given the lack of political will to end impunity, new approaches must be taken. The report argues for a series of institutional changes, most importantly the creation of an internationalized investigative body, based inside Mexico, with powers to independently investigate and prosecute atrocity crimes."--Page 4 of cover.

Book excerpt: This book examines the international, regional and domestic human rights frameworks that establish victim rights as a central force in law and policy in the twenty-first century. Accessing substantial source material that sets out a normative framework of victim rights, this work argues that despite degrees of convergence, victim rights are interpreted on the domestic level, in accordance with the localised interests of victims and individual states. The transition of the victim from peripheral to central stakeholder of justice is demonstrated across various adversarial, inquisitorial and hybrid systems in an international context. Examining the standing of victims globally, this book provides a comparative analysis of the role of the victim in the International Criminal Court, the ad hoc tribunals leading to the development of the International Criminal Tribunal for the former Yugoslavia and the International Criminal Tribunal for Rwanda, together with the Extraordinary Chambers of the Courts of Cambodia, Special Panels of East Timor (Timor Leste), and the Internationalised Panels in Kosovo. The instruments of the European Parliament and Council of Europe, with the rulings of the European Court of Justice, and the European Court of Human Rights, interpreting the European Convention of Human Rights, are examined. Telenovelas have multiple layers of socio-cultural message -- local as well as global -- and are invariably laden with appealing drama and emotion, and sometimes comedy. The discussion focuses on how telenovelas reflect society's perception of, and adjustment toward, issues of globalisation. They are a means of portraying how individuals and families rationalize and incorporate rapid social and economic changes. The book explores how telenovelas might offer a subversive interpretation of reality; or provide a channel of dialogue with the government's political aims. The author challenges the assumption that they are merely a reflection of historical, political and social circumstance. One of the many telenovela examples addressed in this book is whether the serial Padre Coraje constructs a parallel between the current Kirchner government and that of Juan Peron, fifty years earlier. The serial explores the two leaders' relationship with the Church and implicitly presents President Kirchner as Peron's successor. Explaining telenovelas as cultural texts (they are not soap operas) provides the primary basis for this study, backed by Argentinian newspaper articles and secondary sources on Latin American history, culture and economy, as well as TV and cinema studies. The result is a more profound and nuanced interpretation than hitherto of Argentinian telenovelas. Analysis enables identification of the links between the serials' storylines and contemporary political and social events. These popular culture texts bring new meaning to the Argentinian historical narrative, and for TV viewers puts the processes and effects of economic and social globalisation on a local multi-cultural level perspective.

Violence against women has increased throughout Mexico and in other countries, including Argentina, Costa Rica, Guatemala, and Peru. Law enforcement officials have often failed or refused to undertake investigations and prosecutions, creating a climate of impunity for perpetrators and denying truth and justice to survivors of violence and victims’ relatives. Terrorizing Women is an impassioned yet rigorously analytical response to the escalation in violence against women in Latin America during the past two decades. It is part of a feminist effort to categorize violence rooted in gendered power structures as a violation of human rights. The analytical framework of feminicide is crucial to that effort, as the editors explain in their introduction. They define feminicide as gender-based violence that implicates both the state (directly or indirectly) and individual perpetrators. It is structural violence rooted in social, political, economic, and cultural inequalities. Terrorizing Women brings together essays by feminist and human rights activists, attorneys, and scholars from Latin America and the United States, as well as testimonios by relatives of women who were disappeared or murdered. In addition to investigating egregious violations of women’s human rights, the contributors consider feminicide in relation to neoliberal economic policies, the violent legacies of military regimes, and the sexual fetishization of women’s bodies.
