Book excerpt: "Persons and Property in Private Law is a curated collection of socio-legal scholarship and primary legal sources examining the roots, relevance, and application of the legal categories of persons and property. These categories are foundational — being regarded as fundamental to the semantic architecture of law. This comprehensive and thought-provoking book is designed for students in undergraduate law and legal studies programs. The book delves into the origins, evolution, and ideological dimensions of the concepts of persons and property in the legal realm. It explores how the notion of legal personality has evolved over time and its impact on various individuals and entities. Additionally, it critically examines the construct of property and its connection to ownership rights, highlighting the ideological underpinnings and societal implications associated with different forms of property. Persons and Property in Private Law provides a rich and multidimensional exploration of the concepts of persons and property, urging readers to critically engage with the ideological dimensions and implications of these legal constructs. By examining historical perspectives, contemporary issues, and emerging challenges, the book offers a comprehensive and insightful analysis that encourages students and scholars alike to reevaluate traditional legal taxonomies and envision a more inclusive, sustainable, and earth-centred legal framework."--

Book The Legal Understanding of Slavery

Download or read book The Legal Understanding of Slavery written by Jean Allain and published by OUP Oxford. This book was released on 2012-09-27 with total page 416 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Slavery is the status or condition of a person over whom any or all of the powers attaching to the right of ownership are exercised." So reads the legal definition of slavery agreed by the League of Nations in 1926. Further enshrined in law during international negotiations in 1956 and 1998, this definition has been interpreted in different ways by the international courts in the intervening years. What can be considered slavery? Should forced labour be considered slavery? Debt-bondage? Child soldiering? Or forced marriage? This book explores the limits of how slavery is understood in law. It shows how the definition of slavery in law and the contemporary understanding of slavery has continually evolved and continues to be contentious. It traces the evolution of concepts of slavery, from Roman law through the Middle Ages, the 18th and 19th centuries, up to the modern day manifestations, including manifestations of forced labour and trafficking in persons, and considers how the 1926 definition can distinguish slavery from lesser servitudes. Together the contributors have put together a set of guidelines intended to clarify the law where slavery is concerned. The Bellagio-Harvard Guidelines on the Legal Parameters of Slavery, reproduced here for the first time, takes their shared understanding of both the past and present to project a consistent interpretation of the legal definition of slavery for the future.

Available in PDF, EPUB and Kindle. Book excerpt: Two of Australia's leading feminist legal theorists examine the relationship between persons and property and the concept of self-ownership in relation to current legal debates. What is the legal status of the dead body? What difference does pregnancy make to legal personality? Can human genetic sequences be owned? Does a celebrity own their image? Can the human body and its parts be regarded as a species of property or must human beings, whether dead or alive, whole or dismembered, always be regarded as persons? Is a foetus the property of the mother or a person in its own right'.This lucid and original book considers recent legal theory regarding personality and property as well as the historical development of these concepts and illustrates their continuing importance as foundational elements of the legal mind.

Download or read book The Construction of Property written by Amnon Lehavi and published by Cambridge University Press. This book was released on 2013-06-20 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Construction of Property identifies the structural and institutional foundations of property, and explains how these features can accommodate various normative agendas. Offering rich and cutting-edge analysis, the book studies the spectrum of property regimes including private, common and public property as well as innovative forms of property hybrids such as US-style residential community associations, the British Private Finance Initiative, the Israeli Renewing Kibbutz, community land trusts and grassroots phenomena of property ordering in publicly-owned open spaces. It also investigates the protagonists of property beyond the individual and the state, identifying the key role that community organisations and business corporations play for both the private and public aspects of property. The book then addresses property's greatest challenge: the move from a largely domestic legal construct into one that accommodates the increasing social and economic forces of globalisation.

Book excerpt: Excerpt from Commentaries on the Law of Persons and Personal Property: Being an Introduction to the Study of Contracts In preparing the manuscript for publication, I have not endeavored to do more than to add such late decisions and statutes as the lapse of time since its completion has made necessary. In accordance with the plan to which the notes and citations of the author conform, no attempt has been made to give a complete list of late decisions. Later authorities, except Where they change or add to the rule as stated in the text, or except Where it was thought they were valuable merely because recent, have been omitted. Some alterations have been made in the arrangement, and certain passages omitted altogether, because of changes in the law. With these exceptions the text remains as originally written.
