Extrait: Henri Dunant, parfois orthographie Henry Dunant, ne sous le nom de Jean-Henri Dunant le 8 mai 1828 a Geneve et mort le 30 octobre 1910 a Heiden, est un humaniste et homme d'affaires suisse. Il est l'un des fondateurs de la Croix Rouge. Pendant un voyage d'affaires en juin 1859, il se trouve a proximite de la ville italienne de Solferino et decouvre les degats humains de la bataille qui s'y deroula. A partir de cette experience, il ecrit un livre intitule Un souvenir de Solferino qu'il publie en 1862. Une annee plus tard, il participe a Geneve a la fondation du Comite international de secours aux militaires blesses, designe des 1876 sous le nom de Comite international de la Croix-Rouge. La premiere convention de Geneve est ratifiee en 1864 et se refere largement a ses propositions. Il obtient avec Frederic Passy le premier prix Nobel de la paix en 1901 et est ainsi considere comme le fondateur du mouvement de la Croix-Rouge internationale. Henri Dunant nait le 8 mai 1828 dans une famille calviniste de Geneve: il est le fils aine de cinq freres et s urs; ses parents, le commercant Jean-Jacques Dunant et son epouse Antoinette Dunant-Colladon, vivent au numero 12 de la rue Verdaine. This growth in the importance of non-State actors at the law-making and law-enforcement levels has generated a lot of new scholarly studies on the topic. However, while it remains uncontested that non-State actors are now playing an important role on the international plane, albeit in very different ways, international legal scholarship has remained riddled by controversy regarding the status of these new actors in international law. This collection features contributions by renowned scholars, each of whom focuses on a particular theory or tradition of international law, a region, an institutional regime or a particular subject-matter, and considers how that perspective impacts on our understanding of the role and status of non-State actors. The book takes a critical approach as it seeks to gauge the extent to which each conception and understanding of international law is instrumental in the perception of non-State actors. Book excerpt: Several international legal issues are related to the concept of legal personality, including the determination of international rights and duties of non-state actors and the legal capacities of transnational institutions. When addressing these issues, different understandings of legal personality are employed. These concepts consider different entities to be international persons, state different criteria for becoming one and attach different consequences to being one. In this book, Roland Portmann systematizes the different positions on international personality by spelling out the assumptions on which they rest and examining how they were substantiated in legal practice. He puts forward the argument that positions on international personality which strongly emphasize the role of states or effective actors rely on assumptions that have been discarded in present international law. The principal argument is that international law has to be conceived as an open system, wherein there is no presumption for or against certain entities enjoying international personality.

La personne morale apparaît comme le terme réunificateur de tout système representative. Dans l'ordre international, ce processus est perturbé par la présence, dans les organs intergouvernementaux, de représentants d'Etat qui sont autant d'organes des Etats membres, présence prolongée par le consentement aux actes adoptés en leur sein. Quel en est donc le sujet d'imputation : l'organisation ou ses membres ? Une théorie de l'acte doit être développée au coeur de la théorie de l'organe pour démontrer que l'organisation internationale est la personnification juridique d'une collectivité d'Etats dotée d'un système représentatif, et n'est que cela. La qualité de partie à un traité constitutif et de membre d'une organisation internationale ne prive l'Etat d'aucun des attributs de la souveraineté dans l'ordre international. Au contraire, la faculté d'investir un sujet de droit de compétences nouvelles est précisément un attribut de la souveraineté : l'organisation est tout entière une création des Etats membres. Leur souveraineté n'inhibe pas le processus de personnification de l'organisation qui, en retour, ne la confisque pas : la souveraineté et la relativité des rapports juridiques demeurent les principes régulateurs de l'ordre international.

Before examining the legal status, privileges and immunities that have commonly been granted to international organizations, the diverse sources where the law can be found are brought together in a new concept: the host arrangement. This concept forms an anchor for the examination of the following aspects of the legal relationship: the legal personality of the organization, the status of its seat, the inviolability of its premises, assets and archives, its jurisdictional immunity, its communications privileges, and its fiscal, customs and financial privileges. In conclusion, the legal concepts underlying the relationship between international organizations and their host states are analyzed and suggestions are made on improving the coherency of the law.
