It was, however, temporarily laid aside for other tasks, until January, 1892. Since that time it has been constantly in hand and has been prosecuted as rapidly as health and the pressure of many other duties would permit. Not withstanding the utmost effort, however, it has been delayed long beyond the time originally fixed for its completion. As it is, the book is very far from being what the writer hoped to make it, or what he still believes he might have made it, had his work been done under more favorable conditions. To retain it longer, however, for further elaboration seems neither practicable nor wise. The general outline and arrangement of Mr. Benjamin have, in the main, been adopted. This course was decided upon for two reasons: first, because Mr. Benjamin's classification has always been regarded as excellent in itself; but secondly and chiefly, because Mr. Benjamin's analysis (which in its turn was largely that of Lord Blackburn) has so decidedly controlled the development of our law in many important particulars, that to attempt a new classification or nomenclature would be confusing if not presumptuous. As any one will find who attempts to compile a collection of cases, it is hard to make it small enough. I have tried to limit myself to the leading and illustrative authorities, and in the few notes no attempt has been made at a full collection of the decisions, - indeed, no case is ever referred to without a distinct reason for calling attention to it. A special difficulty in dealing with the law of property, and particularly of real property, is to determine how much to dwell on parts of the law which have now become practically obsolete. No two persons would probably decide this question in exactly the same way. I have endeavored to bear in mind, on the one hand, that a real knowledge of the law as it is, requires a knowledge of the law as it has been; and, on the other, that I am working for men who are preparing themselves to be lawyers, and not merely for students of the history of institutions. For the parts of the law of which he treats and for which it was impossible or undesirable to give cases, I have had recourse to the terse and exact sentences of Littleton. I desire especially to acknowledge the aid I have received from Mr. Leake's Digest of the Law of Land. The subject is in some ways harder to epitomize. Since Bracton's artless enumeration quoted on the title page, personal property, especially in the form of choses in action, has ramified in all directions and become closely entangled with law of contract. None of the general treatises, in my opinion, make sufficiently clear the distinction between these two, property and contract: perhaps I have succeeded little (if at all) better than my predecessors, though I have tried to keep off contract, except where necessary for explaining the nature of certain kinds of property. Another difficulty lies in the multiplicity of statutory regulations. Here I have attempted to cull those only which affect property as such in its creation, the extent of its enjoyment, and most of all in the methods of its conveyance.
