Genocide is a crime aimed at the destruction of groups, characterized by intent to destroy the group, whereas persecution is an offense aimed at serious discrimination against individuals, characterized by the mass or systematic character of the killing. Therefore, this paper will tackle the question of moral difference between genocide and persecution and ask why genocide can still be considered the “crime of crimes” if, contrary to persecution, it does not even require a mass-scale attack or a high number of victims. The most convincing approach argues that genocide risks more ancillary harm due to the additional intent not only to harm current group members, but also to destroy the group itself. Genocide per se is not worse than persecution, but it is more likely to expand into massive devastation. This is the reason why even “small” genocides need to be prosecuted, punished and prevented by international law.

Gerald D. Feldman was Professor of History and Director of the Institute of European Studies at the University of California, Berkeley. His special fields of interest were 20th-century German history, and he had a special interest in business history, most recently authoring a biography of Hugo Stinnes, participating in the history of the Deutsche Bank, and writing a history of the Allianz Insurance Company in the Nazi period. Wolfgang Seibel is Professor of Political Science at the University of Konstanz, Germany. Previous appointments include guest professorships at the Institute for Advanced Study, Vienna (1992), and the University of California at Berkeley (1994). He was also a temporary member of the School of Social Science (1989/90) and of the School of Historical Studies (2003) of the Institute of Advanced Study, Princeton. Currently (2004/2005) he is a fellow of the Wissenschaftskolleg zu Berlin. His research is mainly devoted to issues of politics, public bureaucracy and non-governmental organizations.

Robert Satloff, Executive Director of the Washington Institute for Near East Policy and author of Among the Righteous: Lost Stories of the Holocaust’s Long Reach Into Arab Lands, contributes a scholarly essay to the Responses section of this volume called “Countering Holocaust Denial in the Middle East: A New Approach.” Satloff maintains that Holocaust denial in Arab regions may be more effectively countered if recognition is given to Arabs who helped Jews during the Holocaust and if the fate of Jews in Arab lands, particularly during World War II, is given a more thorough consideration. Two additional essays in this segment of the book focus on Arab or Muslim reactions to the Holocaust. Gerhard L. Weinberg, author of the magnum opus A World at Arms: A Global History of World War II, is generally considered to be the world’s most important authority on the Second World War. He contributes the primary article in the Consequences section of this volume, “The Holocaust and the Nuremberg Trials.” His essay argues that the evidence presented at the Nuremberg tribunal as well as the legal principles established at Nuremberg, have set important precedents in international law that also influence the course of contemporary politics as well as both Holocaust and genocide studies.
