Excerpt: ...the other branch of the question, there is a more definite knowledge of results. It must first be explained that the method of confinement practiced in this penitentiary and in a number of adjacent county prisons is separate, but in no sense solitary. The cells are furnished with abundant light and ventilation, and are of suflicient dimensions for the constant and comfortable residence of the occupant. They all have an inside iron grill and an outside oaken door, the latter being habitually fastened about one foot open, which enables the prisoner to hear but not to see whatever transpires in the corridor, including religious and choral services. Every prisoner receives a daily minimum of six visits, and in addition can call for and see any of the inspectors or principal oflicers whenever he wishes. When unprovided with profitable labor he has an hour's walk in the yard on every suitable day, so arranged, however, that he can not recognize or be recognized by any other convict. He has ample light by day, and electric light till 9 o'clock p. m., and has one and a half hour's license during every evening when he may exercise his voice and make any reasonable noise he may desire. He can draw at will on a well-selected library of several thousand volumes, and the rules governing interviews and correspondence with his friends are liberal. He may have a bath byimmersion daily, and must have at least one weekly, and his food is judiciously varied to maintain appetite, cheerfulness and health. Of course a prison is and ought to be a place of punishment to be dreaded and avoided. Yet it should be physically comfortable and healthy, should discharge no man morally worse than when he entered it, and should protect every prisoner...

Book excerpt: Anti-competitive business cartels, engaging in practices such as price fixing, market sharing, bid rigging and restrictions on output, are now subject to strong official censure and rigorous legal control in a large number of jurisdictions across the world. The longstanding condemnation under the US Sherman Act of 1890 has been taken up (although in a rather different form) during the last thirty years in the EC/EU and in European national jurisdictions in particular, but also in a range of countries outside North America and Europe. Legal control has not only extended geographically but has intensified, as a number of jurisdictions have moved beyond administrative regulation and penalties to embrace enforcement through civil liability and (most significantly in terms of policy and rhetoric) the methods of criminal law. It is therefore timely to consider critically this development of legal control and assess its achievement to date and its future prospects. But such an exercise requires an understanding of the reasons and need for such regulation, based on a clear appreciation of the nature and extent of the economic and social malaise which is its subject. What, more exactly, are such business cartels, why do they come into existence and persist, why are they regarded as being so bad, and what are the objectives within this increasingly complex and multi-level phenomenon of legal control? By seeking to answer such fundamental questions, this book sets a research agenda for a pathology, aetiology and criminology of business cartels, and probes more accurately their nature, operation, endurance and perceived delinquency.

For these reasons, along with a loss of faith in rehabilitation, the probation service is now described by many as having become a law enforcement agency, charged by government with the assessment and management of risk, the protection of the public and the management and punishment of offenders, rather than their transformation into pro-social citizens. This book explores the extent to which practitioners within the National Probation Service for England and Wales and the National Offender Management Service ascribe to the values, attitudes and beliefs associated with these macro and mezzo level changes and how much their practice has changed accordingly. By viewing examples of 'real' practice through the lens of the modernisation of public services, managerialism and theories of organisation change, the book considers how 'real' practice is likely to emerge as something unpredictable and perhaps different from the intentions of both government/management and practitioners.
