Book excerpt: This book aims to investigate the life and work of Paul Koschaker (1879-1951), who was one of the most prominent legal historians during the first half of the 20th century. From the 1930s onwards, Koschaker is renowned for having attempted reaffirm the authority of Roman law, which was experiencing a major crisis at German universities at the time, mainly due to the Nazi regime's disdain for this subject. Above all, he intend to emphasise the role Roman law played as a cornerstone of European legal tradition, as was masterfully depicted in his book 'Europa und das romische Recht'. Moreover, Koschaker had many other areas of interest throughout his career, such as cuneiform laws and comparative legal history issues. This work in particular attempts to provide the first comprehensive study of Koschaker's biographical experiences, as well as his scientific and academic stances, which have come to light as a result of the discovery and analysis of numerous previously unpublished archival sources.

The theme of the present volume is maritime risk management. After an overview over the history of insurance, the contributions to the present volume examine different maritime risk management strategies by adopting a variety of methodological approaches. Some contributions focus on normative provisions, others contrast practice with legal scholarship, or focus on the emergence of insurance companies as opposed to individual insurers. Again, other contributions give insights in marine insurance practice in specific cities or analyse insurance practice through the lens of specific insurance litigation. As to the time frame, the different contributions span from antiquity to the nineteenth century.

It is the lost story of a trailblazer in the fields of quantum mechanics and cosmology, a herald of nuclear energy and applications of modern science. This biography of Haas is based on new and previously unpublished family records and archived material from the Vienna Academy of Science and the University of Notre Dame, which the author has collected over many years. From his analysis of the letters, documents, and photos that rested for nearly a century in family attics and academic archives, Michael Wiescher provides a unique and detailed insight into the life of a gifted Jewish physicist during the first half of the twentieth century. It also sheds light on the scientific developments and thinking of the time. It appeals not only to historians and physicists, but also general readers. Book excerpt: Comparative law is a research methodology which has been increasingly fashionable in recent decades, as comparisons between common law and civil law have dominated the law studies landscape. There are many methods of comparative law in use, including comparison of legal rules, comparison of cases, and comparison of legal theories. Each of these methods has strong proponents and opponents. Dogmatic comparisons of rules are criticized for not giving the whole picture of law in action, but praised for being the first and the only truly legal step in comparative research. Case-based comparisons are praised for enabling us to compare the true understanding of rules by courts, yet the critics of this method point out that only the higher courts’ decisions are subject to comparison, and most cases do not reach this stage. Finally, comparisons of legal theories are praised for enabling us to know the spirit of the laws, yet opponents would argue that many countries sharing the same theory would draw opposite conclusions from it. This book is a result of the attempted (and successful) introduction of comparative law into the region of Eastern and Central Europe. The subject has induced interest beyond expectations. This volume opens with a chapter on the unification of law, both from the perspective of institutional unification by such supra-state organizations, spontaneous and institutionalized unifications between two or more legal systems, and the methods of choosing the right rules in the unification process. Chapters two and three follow the classical division of private and public law, as proposed by the brilliant Roman lawyer Ulpian. Overall, the chapters in this book offer an interesting and engaging commentary on the current topics discussed by academics in Eastern and Central Europe.

Book excerpt: Slaves were property of their dominus, objects rather than persons, without rights: These are some components of our basic knowledge about Roman slavery. But Roman slavery was more diverse than we might assume from the standard wording about servile legal status. Numerous inscriptions as well as literary and legal sources reveal clear differences in the social structure of Roman slavery. There were numerous groups and professions who shared the status of being unfree while inhabiting very different worlds. The papers in this volume pose the question of whether and how legal texts reflected such social differences within the Roman servile community. Did the legal system reinscribe social differences, and if so, in what shape? Were exceptions created only in individual cases, or did the legal system generate privileges for particular groups of slaves? Did it reinforce and even promote social differentiation? All papers probe neuralgic points that are apt to challenge the homogeneous image of Roman slave law. They show that this law was a good deal more colourful than historical research has so far assumed. The authors’ primary concern is to make this legal diversity accessible to historical scholarship.
