Di ciò era consapevole anche il Costituente, che volle dedicare particolare attenzione al fenomeno culturale nel suo complesso, prevedendo al contempo la tutela e la promozione della cultura, come anche della ricerca (art. 9), nonché la protezione della libertà dell’arte, della scienza e del loro insegnamento (art. 33). Dalla lettura delle disposizioni costituzionali è possibile ritenere che il patrimonio culturale realizzi compiutamente il valore unitario della Nazione, identificando la “cultura italiana” attraverso i beni e le tradizioni storiche e sociali. I profili organizzativi assumono fondamentale rilievo perché non solo debbono garantire la tutela e la valorizzazione del patrimonio culturale ma anche la sua trasmissione e conservazione nell’interesse delle future generazioni. Funzioni che sono oggi svolte sia tramite le istituzioni pubbliche (anche con strumenti di cooperazione valorizzati dal principio di sussidiarietà “verticale”) sia attraverso il coinvolgimento a vario titolo dei privati. A tal proposito, il Codice dei beni culturali e del paesaggio del 2004 ed il Codice dei contratti pubblici del 2016 accordano un ruolo rilevante ai privati, nella valorizzazione del patrimonio culturale, con varie tipologie di accordi e forme di partenariato.

Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition. Indeed, populism frequently relies on concepts and categories belonging to the language of constitutionalism (majority, democracy, people), offering a kind of constitutional counter-narrative.

Samuel Fleischacker argues that guaranteeing aid to the poor is a modern idea, developed only in the last two centuries. Earlier notions of justice, including Aristotle's, were concerned with the distribution of political office, not of property. It was only in the eighteenth century, in the work of philosophers such as Adam Smith and Immanuel Kant, that justice began to be applied to the problem of poverty. To attribute a longer pedigree to distributive justice is to fail to distinguish between justice and charity. Fleischacker explains how confusing these principles has created misconceptions about the historical development of the welfare state. Socialists, for instance, often claim that modern economics obliterated ancient ideals of equality and social justice. Free-market promoters agree but applaud the apparent triumph of skepticism and social-scientific rigor. Both interpretations overlook the gradual changes in thinking that yielded our current assumption that justice calls for everyone, if possible, to be lifted out of poverty. By examining major writings in ancient, medieval, and modern political philosophy, Fleischacker shows how we arrived at the contemporary meaning of distributive justice.
