[...] R. 1908, S. 1145) also would address several issues of concern, including the quality of issued patents, the expense and complexity of patent litigation, harmonization of U. S. patent law with the laws of our leading trading partners, potential abuses committed by patent speculators, and the special needs of individual inventors, universities, and small firms with respect to the patent system. [...] The provisions of the proposed legislation would arguably work the most sweeping reforms to the U. S. patent system since the nineteenth century. [...] A nonobvious invention must not have been readily within the ordinary skills of a competent artisan at the time the invention was made.12 If the USPTO allows the patent to issue, the patent proprietor obtains the right to exclude others from making, using, selling, offering to sell or importing into the United States the patented invention.13. [...] Adjudicated infringers may be enjoined from further infringing acts.14 The patent statute also provides for the award of damages "adequate to compensate for the infringement, but in no event less than a reasonable royalty for the use made of the invention by the infringer."15 The maximum term of patent protection is ordinarily set at 20 years from the date the application is filed.16.
