Book Protecting American Innovators by Combating the Decline of Patents Granted to Small Entities

Download or read book Protecting American Innovators by Combating the Decline of Patents Granted to Small Entities written by W. Keith Robinson and published by . This book was released on 2016 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The new patent laws and recent economic trends indicate that there is a difficult time ahead for small entities. American entrepreneurs and small businesses have created several of the major technological innovations in the past forty years. However, statistics indicate that patents granted to small entities have declined. In the wake of this trend, the U.S. Patent system has undergone significant changes. Currently, the United States Patent and Trademark Office (“USPTO”) is in the process of implementing the policies and procedures outlined in its five-year strategic plan. Further, the Leahy-Smith America Invents Act (“AIA”), the largest patent reform law since 1952, was signed into law on September 16, 2011. Unfortunately, some of these new policies and the overall affect of the AIA may have a negative impact on the patenting efforts of small entities. For example, some scholars have argued that the AIA's new “first-to-file” regime will result in a significant drop in the number of patents granted to small inventors. Accordingly, new patent policies in combination with the decline in small entity patenting may threaten the ability of small entities to continue to lead the country in innovation. There is some evidence to suggest that an increase in small entity patenting will correlate with a boost in American innovation. In response, this article proposes that the USPTO implement a prioritized examination program for small entities. In support of this program, this article examines policies that may affect a small entities' ability to participate in patent. This article suggests that the patent prosecution process puts small entities at a disadvantage in comparison to large entities. Further, the new procedures implemented because of the AIA at best maintain the status quo regarding patent prosecution for small entities. Finally, this article proposes a patent valuation tool that would enable USPTO stakeholders to measure the effectiveness of the proposed program. The overall goal of these proposals is to balance the USPTO's desire to optimize patent quality and timeliness with the goal of increasing the number of filed patent applications that are granted to small entities.

You may have heard terms like "patent trolls" and "patent reform" in the news, because fixing the patent system has become a major topic for lawmakers today. Patents are based on a simple concept of encouraging inventions. But around this simple concept, a complicated system of laws has grown. This book will guide you through the fast-changing world of patent law and policy, identifying some of the most pressing problems with the system and suggesting ways to fix them. A Five Part Plan for Patent Reform is part of a white paper series by Public Knowledge, a nonprofit technology policy organization based in Washington, DC. Book International Patent Protection for Small Businesses

Download or read book International Patent Protection for Small Businesses written by U S Department of Commerce United State and published by CreateSpace. This book was released on 2014-09-04 with total page 36 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recent economic research shows that small businesses are the primary driver of job creation in the United States, with young startup companies, which are by their nature small businesses, creating on average three million U.S. jobs per year. Though this pattern of job creation has largely held true for over thirty years, the capacity of American small businesses to create jobs is at risk. American firms compete and grow by supplying products and services that consumers demand, and by internationalizing their businesses through licensing, franchising, or exporting. For many small companies, patent protection prevents competitors from simply copying their innovations, and aids in attracting investor capital needed to grow, build market share, and create jobs. Yet small companies face significant financial challenges in acquiring, maintaining, and enforcing patents outside the United States. Therefore, supporting small firms and fostering job creation requires a thorough understanding of these challenges and an exploration of possible remedies. The Leahy-Smith America Invents Act requires the Director of the United States Patent and Trademark Office, in consultation with the Secretary of Commerce and the Administrator of the Small Business Administration, to study how best to support businesses with international patent protection. The USPTO and SBA are required to determine whether a revolving fund loan program or a grant program would be proper for helping small businesses defray the costs of filing, maintaining, and enforcing international patents. The USPTO and SBA are required to provide other pertinent recommendations. To prepare this report, the USPTO principally relied upon input from the public, seeking comments through a Federal Register notice and holding two public hearings to collect evidence for this study. At each hearing, government panelists from the USPTO and SBA invited and accepted formal testimony, and allowed informal comment and questioning from members of the public. In all, the USPTO received eighteen sets of comments, including responses from a U.S. intellectual property organization, an international industry organization, a foreign government intellectual property office, a U.S. law firm, a U.S. private company, eight U.S. patent practitioners, and five American citizens speaking as individuals. In addition, the USPTO conducted research, relying upon archival sources such as reports, economic studies, and existing data sources where available.

Book 21st Century Innovation Systems for Japan and the United States

Download or read book 21st Century Innovation Systems for Japan and the United States written by National Research Council and published by National Academies Press. This book was released on 2009-05-15 with total page 302 pages. Available in PDF, EPUB and Kindle. Book excerpt: Recognizing that a capacity to innovate and commercialize new high-technology products is increasingly a key for the economic growth in the environment of tighter environmental and resource constraints, governments around the world have taken active steps to strengthen their national innovation systems. These steps underscore the belief of these governments that the rising costs and risks associated with new potentially high-payoff technologies, their spillover or externality-generating effects and the growing global competition, require national R&D programs to support the innovations by new and existing high-technology firms within their borders. The National Research Council's Board on Science, Technology, and Economic Policy (STEP) has embarked on a study of selected foreign innovation programs in comparison with major U.S. programs. The "21st Century Innovation Systems for the United States and Japan: Lessons from a Decade of Change" symposium reviewed government programs and initiatives to support the development of small- and medium-sized enterprises, government-university- industry collaboration and consortia, and the impact of the intellectual property regime on innovation. This book brings together the papers presented at the conference and provides a historical context of the issues discussed at the symposium.

Book A Patent System for the 21st Century

Download or read book A Patent System for the 21st Century written by National Research Council and published by National Academies Press. This book was released on 2004-10-01 with total page 186 pages. Available in PDF, EPUB and Kindle. Book excerpt: The U.S. patent system is in an accelerating race with human ingenuity and investments in innovation. In many respects the system has responded with admirable flexibility, but the strain of continual technological change and the greater importance ascribed to patents in a knowledge economy are exposing weaknesses including questionable patent quality, rising transaction costs, impediments to the dissemination of information through patents, and international inconsistencies. A panel including a mix of legal expertise, economists, technologists, and university and corporate officials recommends significant changes in the way the patent system operates. A Patent System for the 21st Century urges creation of a mechanism for post-grant challenges to newly issued patents, reinvigoration of the non-obviousness standard to quality for a patent, strengthening of the U.S. Patent and Trademark Office, simplified and less costly litigation, harmonization of the U.S., European, and Japanese examination process, and protection of some research from patent infringement liability.

Book Patent Challenges for Standard Setting in the Global Economy

Download or read book Patent Challenges for Standard Setting in the Global Economy written by National Research Council and published by National Academies Press. This book was released on 2013-10-07 with total page 181 pages. Available in PDF, EPUB and Kindle. Book excerpt: Patent Challenges for Standard-Setting in the Global Economy: Lessons from Information and Communication Technology examines how leading national and multinational standard-setting organizations (SSOs) address patent disclosures, licensing terms, transfers of patent ownership, and other issues that arise in connection with developing technical standards for consumer and other microelectronic products, associated software and components, and communications networks including the Internet. Attempting to balance the interests of patent holders, other participants in standard-setting, standards implementers, and consumers, the report calls on SSOs to develop more explicit policies to avoid patent holdup and royalty-stacking, ensure that licensing commitments carry over to new owners of the patents incorporated in standards, and limit injunctions for infringement of patents with those licensing commitments. The report recommends government measures to increase the transparency of patent ownership and use of standards information to improve patent quality and to reduce conflicts of laws across countries.
