Book excerpt: With the passage of what ended up as the America Invents Act in 2011, an extended, multi-year effort -- often characterized as “patent reform” -- reached something of a culmination. The Act outlined several significant changes in patent law, the first being a change in who was entitled to obtain a patent when two or more inventors were competing. The new “First inventor to file” (as compared to “First to Invent”) was seen as more equitable and consistent with worldwide patent practices. Other changes made patents more difficult to obtain by expanding what is considered to be the “prior art” that can show an invention is not unique. Other changes were intended to “streamline” the patent system for U.S. inventors, thus leading to the final name of the Act and the politicians' advocacy that the new law “creates jobs.”What the America Invents Act did not do was close out the need for patent reform, particularly with the continuing challenge of so-called “patent trolls”

These processes were meant to reduce patent litigation costs and clear the field of “dubious patents,” all the while increasing certainty in the existence and scope of patent rights. Though this was not the first attempt to achieve these goals, Congress failed to heed the lessons of past reforms or fully take into account the costs associated with these new post-issuance review mechanisms. The result was a set of dubious reforms. This Article marshals empirical data and case-study based evidence to show that the newly created system is open to abuse, that such abuse occurs, and that the costs that Congress ignored are substantial.

Book excerpt: On September 16, 2011, President Obama signed the America Invents Act (AIA), the first major overhaul of the patent system in nearly sixty years. This article analyzes the recent change to patent law's best mode requirement under the AIA. Before the AIA, patent applicants were required, at the time of submitting their application, to disclose the best mode of carrying out the invention as contemplated by the inventor. A failure to disclose the best mode was a basis for a finding of invalidity of the relevant claims or could render the entire patent unenforceable under the doctrine of inequitable conduct. The AIA still requires patent applicants to disclose the best mode, but has removed the traditional enforcement mechanisms - declarations of invalidity and unenforceability - as defenses to patent infringement. In this article, I propose and explore a couple innovative techniques that could be used to add teeth to the seemingly toothless best mode requirement. Ultimately, I reject these proposals as not being workable solutions and suggest that Congress's resolution of the best mode problem is nonsensical and that it should completely eliminate the requirement rather than sending mixed signals to the Patent Office and patent practitioners.

Book excerpt: In May 2018, the International IP Commercialization Council (IIPCC) hosted a conference titled "Meeting the Challenges to America's Economic Future: Charting the Course in U.S. Intellectual Property and Innovation Policy" that explored the current state of the U.S. patent system in the wake of the America Invents Act (AIA) of 2011, the most comprehensive patent reform legislation since the 1950s. As the conference transcripts reflect, many stakeholders are worried that our innovation ecosystem is at risk because the pendulum has swung too far against the protection of patent rights. This Introduction offers a balanced view of the state of the patent system in the United States. It discusses the problems facing accused infrigers that prompted Congress to pass the AIA, and considers the impact that legislation and other reform efforts implemented by the judiciary and the U.S. Patent & Trademark Office (PTO) have had on our patent system. While speakers at the IIPCC conference called on Congress to pass significant legislation like the Support Technology & Research for Our Nation's Growth and Economic Resilience (STRONGER) Patents Act, I believe the better approach is incremental reform led by the PTO -- the entity that should serve as the nation's primary policymaker on patents and innovation.
