The globalization of research has important implications for the U.S. research enterprise, for the U.S. government agencies, academic institutions, and companies that support and perform research, and for the world at large. As science and technology capabilities grow around the world, U.S.-based organizations are finding that international collaborations and partnerships provide unique opportunities to enhance research and training. At the same time, significant obstacles exist to smooth collaboration across national borders. Enhancing international collaboration requires recognition of differences in culture, legitimate national security needs, and critical needs in education and training. In response to these trends, the Government-University-Industry Research Roundtable (GUIRR) launched a Working Group on International Research Collaborations (I-Group) in 2008, following its meeting on New Partnerships on a Global Platform that June. As part of I-Group's continuing effort, a workshop on Examining Core Elements of International Research Collaboration was held July 26-27, 2010 in Washington, DC. One primary goal of the workshop is to better understand the risks involved in international research collaboration for organizations and individual participants, and the mechanisms that can be used to manage those risks. Issues to be addressed in the workshop include the following: (1) Cultural Differences and Nuances; (2) Legal Issues and Agreements; (3) Differences in Ethical Standards; (4) Research Integrity and the Responsible Conduct of Research; (5) Intellectual Property; (6) Risk Management; (7) Export Controls; and (8) Strategies for Developing Meaningful International Collaborations. The goal for the workshop and the summary, Examining Core Elements of International Research Collaboration, is to serve as an information resource for participants and others interested in international research collaborations. It will also aid I-Group in setting its future goals and priorities.

Most managers leave intellectual property issues to the legal department, unaware that an organization's intellectual property can help accomplish a range of management goals, from accessing new markets to improving existing products to generating new revenue streams. In this book, intellectual property expert and Harvard Law School professor John Palfrey offers a short briefing on intellectual property strategy for corporate managers and nonprofit administrators. Palfrey argues for strategies that go beyond the traditional highly restrictive “sword and shield” approach, suggesting that flexibility and creativity are essential to a profitable long-term intellectual property strategy—especially in an era of changing attitudes about media. Intellectual property, writes Palfrey, should be considered a key strategic asset class. Almost every organization has an intellectual property portfolio of some value and therefore the need for an intellectual property strategy. A brand, for example, is an important form of intellectual property, as is any information managed and produced by an organization. Palfrey identifies the essential areas of intellectual property—patent, copyright, trademark, and trade secret—and describes strategic approaches to each in a variety of organizational contexts, based on four basic steps. Book excerpt: Thirty years ago federal policy underwent a major change through the Bayh-Dole Act of 1980, which fostered greater uniformity in the way research agencies treat inventions arising from the work they sponsor. Before the Act, if government agencies funded university research, the funding agency retained ownership of the knowledge and technologies that resulted. However, very little federally funded research was actually commercialized. As a result of the Act's passage, patenting and licensing activity from such research has accelerated. Although the system created by the Act has remained stable, it has generated debate about whether it might impede other forms of knowledge transfer. Concerns have also arisen that universities might prioritize commercialization at the expense of their traditional mission to pursue fundamental knowledge-for example, by steering research away from curiosity-driven topics toward applications that could yield financial returns. To address these concerns, the National Research Council convened a committee of experts from universities, industry, foundations, and similar organizations, as well as scholars of the subject, to review experience and evidence of the technology transfer system's effects and to recommend improvements. The present volume summarizes the committee's principal findings and recommendations.

Book excerpt: Innovative individuals and firms have increasingly engaged in collaborative research. The greater complexity of modern technology, heightened specialization in advanced fields, improved means of communications, and the desire to share the risks and expenses of high technology research have each contributed to this trend. Congressional interest in creating an environment conducive to collaborative research has resulted in numerous legislative initiatives. The Patent Law Amendments Act of 1984 and the Cooperative Research and Technology Enhancement (CREATE) Act of 2004 are among those that have clarified patent law rules regarding joint inventors and cooperative research endeavors. Observers have nonetheless expressed concerns that applicable patent law standards may discourage, rather than foster, collaboration among researchers. Some patent law experts believe that current rules identifying the members of a research team who qualify as joint inventors are too lenient, vague, and unpredictable. This standard may lead to uncertainties with respect to patent ownership. It may also encourage strategic claims drafting during patent acquisition and enforcement. Another target of concern is the current legal rule governing the joint ownership of patents. In the event more than one individual is considered to be a co-inventor of an invention that is patented, each such person is regarded as a joint owner of that patent. U.S. patent law further deems a joint owner of a patent to enjoy a "tenancyin-common," which allows him to exploit a patent without regard to the other owners. This property rule appears to maximize the opportunity for exploitation of the patented invention in the marketplace. Yet, because every inventor receives full rights in an invention no matter what the extent of his contribution, this ownership principle could possibly lead to inequitable distributions of the profits of patented inventions. If Congress should deem a legislative response to be appropriate, some commentators have called for more specific legislative guidance on the joint inventorship standard. A possible reform would be to stipulate bright-line rules, or possibly a list of factors that courts should consider, with respect to joint inventorship. On the other hand, fashioning a workable standard of joint inventorship might prove difficult or ultimately be unnecessary. In addition, alternative ownership rulesÂsuch as considering ownership on a claim-by-claim, rather than a patent-by-patent basisÂare a possibility. In weighing the desirability of any alternative to the current regime, concerns for ease of judicial administration and the diminution of the incentives of one joint owner to commercialize the patented invention may be appropriate. However, the patent statute's joint inventorship and joint ownership standards are effectively default rules. As collaborative researchers may reach alternative arrangements via contract, legal reform in this area may not be a compelling need.
