Since that time, patent litigation has continued to increase in complexity. This edition encompasses implementation of the America Invents Act (“AIA”), the emergence of review proceedings at the Patent Trial and Appeal Board (“PTAB”), the Supreme Court's many recent patent decisions (patent eligibility, claim construction, claim indefiniteness, infringement analysis (rejecting “joint infringement”), the intent requirement for induced infringement liability (rejecting a defense of good faith belief of a patent's invalidity), and attorney fees), and the Federal Circuit's damages jurisprudence (including damage awards for standard essential patents (SEP) licensed pursuant to fair, reasonable, and nondiscriminatory (FRAND) terms. It also includes case management checklists, model case management orders, and other materials developed by district judges and advisory bodies for streamlining patent case management. Finally, this volume adds a chapter on patent litigation at the Court of Federal Claims.

Book Anatomy of a Patent Case

Download or read book Anatomy of a Patent Case written by Harry J. Roper and published by . This book was released on 2016 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: "Patent litigation has assumed a pivotal role in today's global economy. In response to the increased prominence of patents, the Complex Litigation Committee of the prestigious American College of Trial Lawyers (ACTL) has authored a manual that provides a balanced view of the issues in each phase of a patent case for judges and lawyers. [This book]...covers all steps required to bring a patent case to trial, and the key elements that make such litigation unique. [This edition] specifically addresses the complex technical, procedural, and legal issues inherent in a patent lawsuit that are not usually found in other types of civil litigation. It is limited to the unique characteristics of patent litigation and has been added to the Federal Judicial Center's resource library for district court judges and their law clerks. The handbook provides concise coverage of the fundamentals, effective lessons from the most significant cases, and essential insights from leading experts and judges. The new third edition includes: a brand-new chapter 15, patent office inter partes review (IPR) and other AIA trial proceedings...addressing key features of PTAB trials and the impact of PTAB trials on patent litigation in federal courts; the impact of changes in the law resulting from numerous decisions from the Supreme Court, as well as the Federal Circuit Court of Appeals, including, what subject matter is eligible for patent protection, how the all-important claim construction determination is to be made and when attorneys fees should be granted; amendments to the Federal Rules of Civil Procedure that alter pleading requirements; and much more."--

Book excerpt: Mediation can be an effective tool in resolving simple to complex patent litigation. As the volume of patent cases has increased around the country, the number of experienced mediators and parties that have participated in the mediation process has also increased. This guide collects the knowledge of experienced judges, mediators, counsel, and parties to promote cost-effective, time-effective, and constructive dispute resolution. Much of the practical information contained within this guide was derived from interviews with federal judges, patent litigators, and in-house attorneys familiar with conducting patent mediations. These sources are not quoted directly so as to preserve anonymity with regard to their views on particular issues. This stage-by-stage and issue-by-issue guide supplements the Patent Case Management Judicial Guide (PCMJG), a comprehensive treatise developed for the federal judiciary. The PCMJG addresses the mechanics, timing, and considerations for effective mediations when judges are managing patent cases. This supplement addresses issues specific to mediators (magistrate judges and private mediators) and in-house and litigation counsel.

Book Compensatory Damages Issues in Patent Infringement Cases Second Edition

Download or read book Compensatory Damages Issues in Patent Infringement Cases Second Edition written by Federal Judicial Center and published by . This book was released on 2020-09-13 with total page 128 pages. Available in PDF, EPUB and Kindle. Book excerpt: Several years ago, then-Chief Judge Paul R. Michel of the U.S. Court of Appeals for the Federal Circuit brought together a diverse group of lawyers, judges, academics, and experts to develop a guide for trial courts to consult when faced with issues of compensatory damages in patent infringement cases. The goal was to bring to bear the participants' collective experience on how best to address and resolve patent damages issues, all within the overarching framework of achieving the "just, speedy, and inexpensive determination of every action and proceeding."1 The first edition of this pocket guide, published in 2011, was the result. As that initial publication recognized, however, patent infringement damages is a continuously evolving area of law. In the intervening years, the courts not only have continued to refine the legal principles that govern the determination of patent infringement damages, but also have implemented a variety of case-management techniques that focus on patent damages. Judge Jeremy Fogel, director of the Federal Judicial Center, therefore requested a revised patent damages guide to reflect the current state of the law and the courts' evolving case-management efforts. This second edition is the result. As with the original, this revised guide does not attempt to provide a comprehensive explication of substantive damages law or to predict its future evolution. Rather, it is intended to focus on case-management practices that may be helpful to the courts in the adjudication of patent infringement damages. Because judges have requested inclusion of more substantive damages law, however, we have added more detail in this regard, but we have stopped well short of presenting a patent damages treatise.
