It is also one of the most contested fields of EU action, covering measures which have a significant impact on the protection of fundamental rights and the relationship between the individual and the State, while at the same time presenting a challenge to State sovereignty in the field and potentially reconfiguring significantly the relationship between Member States and the EU. The book will examine in detail the main aspects of EU criminal law, in the light of these constitutional challenges. These include: the history and institutions of EU criminal law (including the evolution of the third pillar and its relationship with EC law); harmonisation in criminal law and procedure (with emphasis on competence questions); mutual recognition in criminal matters (including the operation of the European Arrest Warrant) and accompanying measures; action by EU bodies facilitating police and judicial co-operation in criminal matters (such as Europol, Eurojust and OLAF); the collection and exchange of personal data, in particular via EU databases and co-operation between law enforcement authorities; and the external dimension of EU action in criminal matters, including EU-US counter-terrorism co-operation. The analysis is forward-looking, taking into account the potential impact of the Lisbon Treaty on EU criminal law.

Book excerpt: Following the Treaty of Lisbon, The European Council has been given the power to adopt and implement an internal security strategy. it did so in March 2010, and this was followed in November by a Commission communication setting out the priorities, and how to implement them. The communication sets out five steps towards a more secure Europe: The disruption of international crime networks, The prevention of terrorism, security in cyberspace, improved border management, and increased resilience to crises and disasters. Of these cyber-security is a comparative newcomer and it is now clear that it can lead to massive disruption of state infrastructure, and can be used for espionage, terrorism, even war. As such, much of the evidence received concerned the role which the EU might play in fighting cyber-attacks. The Commission's main proposal is to set up a new Cybercrime Centre. This might be no more than a talking shop, but it could become a useful tool for investigating and analysing past attacks, improving law enforcement and preventing future attacks. Much will depend on whether it is given adequate resources. The Committee looked at the implementation of the strategy and at the way in which it overlaps with national and international strategies, In the hope that they can be mutually supportive. The Council has a new committee, which, under the Treaties, has the duty of coordinating all the work on internal security. Unless it does so effectively very little can be achieved; if it properly fulfils its mandate, The EU may play a valuable role in protecting the security of its citizens.

Book excerpt: In this report looking at crisis management in the EU, the Committee call for a closer working relationship between the EU Monitoring and Information Centre (MIC) and NATO's Euro-Atlantic Disaster Response and Coordination Centre (EADRCC). The role of the two bodies is similar, but there is practically no contact between them. It would be in the interests of the EU, NATO and the members of both organisations to support and complement each other's work rather than duplicating it. In the event of a serious natural or man-made disaster the failure of the two bodies to cooperate could have serious consequences. The Committee also raise concerns that NATO prevents officials of the EU Joint Situation Centre (SitCen) from taking part in NATO training courses due to concerns about security clearance. The Committee state that the level of security clearance required by NATO should be the same for officials of national Governments and of the European Union. The Committee also call on the Government to begin working with the EU to ensure a full EU contribution to the security preparations in place at the 2012 Olympic site and in surrounding London boroughs. Finally the report criticises the failure of the UK to participate fully in international exercises designed to test preparedness for Chemical, Biological, Radiological or Nuclear (CBRN) attacks. The UK has been involved to some extent in only 11 of 31 EU or NATO CBRN exercises between 2000 and 2008; it has played a full part by deploying teams in none of the NATO exercises, and only one of the EU exercises.

Book excerpt: This is the 29th report of the European Union Committee from the 2007-08 session (HLP 183, ISBN 9780104013700) and looks at Europol (the European Police Office) and its efforts in coordinating the fight against serious and organised crime. Europol began in 1999 and will, by 2010 be established as an agency of the EU. The Council Decision bringing about this change in its constitution has made some amendments to its powers, working methods and governance, but in the Committee's view represents a missed opportunity. The Committee finds it is a matter of concern that four-fifths of the information exchanged by national liaison officers stationed at Europol is exchanged without actually going through Europol and is therefore not added to Europol's database. Member States are reluctant to share sensitive information. The Committee believes that Member States should station at Europol only officers and officials with a high security clearance. A success for Europol has been the analysis of information to help investigate particular caregories of crime and following the UK's influence in focusing on organised crime in particular. The Committee believes that other Member States need to be persuaded on the importance of planning for future threats. The Committee also believes that the existing structure for the governance and management of Europol could be enhanced by clarifying the respective duties of the Director and Management Board. Further, the Committee states that if the Treaty of Lisbon came into force, accountability of Europol to the European Parliament and national parliaments would improve.

Book excerpt: This report calls on the UK Government to investigate how piracy and laundering the proceeds of crime contribute to the financing of terrorism. The Government is complacent regarding the possibility of a link between piracy and terrorism. Shipowners putting together ransom money must seek consent for the payment and disclose how much is being paid, to whom, and where. The fight against money laundering depends on banks and others providing reports of suspicious activities to the Serious Organised Crime Agency (SOCA). 200,000 entries are made on their ELMER database each year, there are now 1.5 million entries, and most are kept for 10 years even where there is no evidence that the suspicious activity was criminal. The Information Commissioner must investigate this. The Committee considers the cost and resource impact on banks and others in the private sector in making Suspicious Activity Reports (SARs) and the lack of feedback about their effectiveness. States must share information about the movement of money, especially information about suspicious bank accounts. The Warsaw Convention on Money Laundering and Terrorist Financing is the first comprehensive international treaty covering both the prevention of money laundering and the financing of terrorism. But the UK has yet to sign it, let alone ratify it. The Committee believe this is indefensible. They call on Ministers to set an urgent timetable for signature and ratification. The Committee also criticise the failure to implement the EU Framework Decision on mutual recognition of confiscation orders.

Ten years ago, the member states transferred competences to the EU for law and policy-making in the fields of immigration, asylum and border controls, and began the transfer process for criminal justice and policing. This decade of European cooperation on AFSJ policies has experienced very dynamic convergence, the enactment of a large body of European law and the setting-up of numerous EU agencies working in these domains. Such dynamism in policy-making has not been without challenges and vulnerabilities, however. As this collective volume shows, the main dilemmas that lie ahead relate to an effective (while more plural) institutional framework under the Treaty of Lisbon, stronger judicial scrutiny through a greater role for national courts and the Court of Justice in Luxembourg, better mechanisms for evaluating and monitoring the implementation of EU AFSJ law and a more solid fundamental rights strategy. The contributions in this volume address the progress achieved so far in these policy areas, identify the challenges for future European cooperation in the AFSJ and put forward possible paths for making more progress in the next generation of the EU's AFSJ. The book puts forward a definition of the criminalisation of migration as the three-fold process whereby migration management takes place via the adoption of substantive criminal law, via recourse to traditional criminal law enforcement mechanisms including surveillance and detention, and via the development of mechanisms of prevention and pre-emption. The book provides a typology of criminalisation of migration, structured on the basis of the three stages of the migrant experience: criminalisation before entry (examining criminalisation in the context of extraterritorial immigration control, delegation and privatisation in immigration control and the securitisation of migration); criminalisation during stay (examining how substantive criminal law is used to regulate migration in the territory); and criminalisation after entry and towards removal (examining efforts to exclude and remove migrants from the territory and jurisdiction of EU Member States and criminalisation through detention). The analysis focuses on the impact of the criminalisation of migration on human rights and the rule of law, and it highlights how European Union law (through the application of both the EU Charter of Fundamental Rights and general principles of EU law) and ECHR law may contribute towards achieving decriminalisation of migration in Europe.
