The significance of liberalised and integrated Public Private Partnership Contracts as an essential component of the world legal and policy order is well documented. The regulation of PPPs is justified economically to allow for competition in the relevant public service and to achieve price transparency, thus resulting in significant savings for the public sector. In parallel to the economic justifications, legal imperatives have also called for the regulation of PPPs in order to allow free movement of goods and services and to prohibit discrimination on grounds of nationality. The need for competitiveness and transparency in delivering public services through PPPs is considered a safeguard to achieve international standards in delivering public utility services. First, it assesses the compatibility of the current PPPs legislation and regulation in the MENA region with the international standards of legislation and regulation prevalent in many other countries, including the UK, France and Brazil. Secondly, it compares the practices in the MENA region with those of international bodies such as the OECD and World Bank. Comparisons are then made between the MENA countries and those in Europe and Asia with regard to the influence of culture, policy and legal globalization. Book excerpt: This research paper provides a regional review of the state of electricity access in Sub-Saharan Africa (SSA), focusing on installed capacity, electricity generation, the growth of renewable energy, electricity consumption, government investment, public financial flows, and several major initiatives. The study contrasts electrification between 1990 and 2010 with recent efforts and identifies countries that are consistently making progress and those that lag. The analyses show signs of progress on scaling up SSA power infrastructure and increasing electricity access, particularly in the Eastern and Western sub-regions. The installed generation capacity expanded at an average rate of 2.43 GW/year between 2005 and 2015. Renewable energy is growing, particularly solar, wind, and geothermal; about 9.7 GW of renewable energy capacity was installed between 2010 and 2016. Over this period, the net electricity generation in SSA increased at 9.1 TWh/year, more than double the historical average growth of 4.02 TWh/year (1990–2010). In general, the study found that rates of electrification across the entire region are more than twice the historical rates, and an average of at least 26 million people are now gaining access to electricity yearly. Nevertheless, progress is uneven across SSA. As of 2016, almost half of the population without electricity access live in Nigeria, DR Congo, Ethiopia, Tanzania, and Uganda. Quantitative analysis suggests that about 70 million people in SSA would have to gain access every year from 2017 to achieve universal access by 2030. Overall, SSA countries with national programs on energy access supported by policy/regulatory framework and infrastructure investment are making progress.

Book excerpt: Energy is linked to many of the sustainable development priorities, including public health, gender equality, food security, clean water, education, economic growth, youth and women’s empowerment and climate action. The absence of clean and sustainable energy has a significant adverse impact on the health and livelihoods of the poorest populations. Around 2.3 billion people, mostly in low- and middle- income countries (LMICs), still mainly rely on inefficient and polluting fuels and stoves for daily cooking, exposing them to health-damaging emissions that result in millions of premature deaths each year. Health and livelihood risks are greatest for women and children as they are often tasked with cooking and gathering fuel. The traditional use of biomass for cooking also puts the environment and climate at risk by contributing to deforestation and greenhouse gas emissions. Around 1 billion people worldwide, mostly in poor and rural communities, are estimated to be served by health care facilities without any electricity or reliable power supply, and only one in two hospitals in sub-Saharan Africa has a reliable electricity supply. Without adequate and reliable power, essential medical devices cannot function, basic amenities remain out of reach and delivery of health care services is of substandard quality. Unless rapid action is taken, the world will not meet its targets under the 2030 Agenda for Sustainable Development and the Paris Agreement. In November 2018, during the first World Health Organization (WHO) Global Conference on Air Pollution and Health, Dr Tedros Adhanom Ghebreyesus, Director-General of WHO, announced his vision to build a Health and Energy Platform of Action (HEPA) to enhance multisectoral collaboration between the health and energy sectors and mobilize the political and financial commitments needed to achieve Sustainable Development Goals (SDGs) 3 and 7. In response, WHO, the United Nations Department of Economic and Social Affairs (UN DESA), the United Nations Development Programme (UNDP) and the World Bank, in cooperation with the International Renewable Energy Agency (IRENA) and other key stakeholders, launched HEPA in May 2019, with an initial focus on improving health through promoting clean fuels and technologies for cooking and accelerating access to electricity for health care facilities. Following this announcement, in July 2020, HEPA members worked together to develop a strategic workplan with five overarching objectives to strengthen the cooperation between the health and energy sectors and elevate energy access as a key development priority area for public health, gender equity, climate and sustainable development more broadly (see Box 1). HEPA has gained significant momentum since its establishment in 2019. By October 2022 the platform had over 20 member organizations. All members are committed to working together and synergizing efforts on the ground to accelerate universal electrification of health care facilities and clean cooking. This HEPA action report summarizes the key activities and results achieved and highlights activities under each of HEPA’s five objectives.
