Book excerpt: This book presents papers from an International Symposium on Contact Disputes and Allegations of Domestic Violence: Identifying Best Practices, held in London in May 2017. The editors invited a group of international experts to explain the approaches taken in their jurisdictions to allegations of domestic violence in child contact cases, with a view to identifying international best practices in such cases. The book includes contributions from England and Wales, Scotland, Ireland, Canada, Sweden and Spain, as well as information presented at the symposium from New Zealand and Australia. The chapters include attention to particular issues such as specialist domestic violence courts, judicial training and hearing children’s voices. Collectively, the chapters identify a set of common problems experienced across all of the jurisdictions, including an overwhelming emphasis on the value of children’s ongoing contact with non-resident parents and the consequent minimisation of domestic violence and the muting of the voices of children who do not wish to have contact with abusive parents. Best practices in taking domestic violence seriously and providing adequate protection from further abuse for children and non-abusive parents were less in evidence. However, the concluding chapter draws together details of several initiatives and approaches which offer promising ways forward. The chapters in this book were originally published as a special issue of the Journal of Social Welfare and Family Law.

It argues against the unquestioning use of parental alienation concepts in child custody conflicts. Increasing use of this concept in family courts has led at times to placement of children with abusive or violent parents, damage to the lives of preferred parents, and the use of treatments that have not been shown to be safe or effective. The 13 chapters cover the history and theory of "parental alienation" principles and practices. Methodological and research issues are considered, and diagnostic and treatment methods associated with "parental alienation" beliefs as well as those recommended by research and ethical evidence are analyzed. The connections of "parental alienation" with gender and domestic violence issues are discussed as are the experiences of individuals who have experienced "parental alienation" treatments. The book argues that "parental alienation" principles and practices should be avoided by family courts, in the best interests of children in custody disputes. This book will be useful reading for lawyers, judges, children’s services workers including social workers, child protection court workers, and mental health professionals involved in child custody decisions.

Sorting out and understanding violent behavior among family members presents complex challenges. Many factors render traditional criminal justice responses inappropriate or ineffective—the cyclical nature of family violence, the relationship between the perpetrator and victim, the causes and effects for both perpetrator and victim; the frequent ambivalence of the victim/witnesses toward involvement of the criminal justice system because of coercion by or fear of the perpetrator, and the guarded privacy traditionally accorded the family. As public awareness and concern about family violence have increased in recent years, many practitioners have sought to fashion responses that take into account the needs of victims as well as punishment and treatment of perpetrators. However, the myriad variables surrounding these responses often send complex and sometimes conflicting signals to even the most sophisticated criminal justice practitioners. Research performs an invaluable function by identifying and sorting through these variables to determine how they affect, and are affected by, various criminal justice responses. This publication contains “bottom line” information from articles written by researchers about their own work or in several instances about other researchers' work on subjects of immediate concern to practitioners: collaborative efforts between police and protection agencies, arrest policies, protection orders, battered women defense strategies, sentencing, batterer treatment, child sexual abuse, and children's testimony. The research findings are the core of the document. It is from these that the researchers have derived their implications for practice and it is from these that the reader may derive additional—and perhaps different—implications for their own particular practice. The studies summarized in this publication represent only those that relate specifically to how the criminal justice system addresses family violence. Other aspects of family violence, such as those associated with custody and divorce proceedings are not included. Also not included are findings from ongoing research mandated by the groundbreaking Violence Against Women Act of 1994—for example, the effects of the “full faith and credit” clause as it pertains to protection orders. The long-range aim of this publication is to encourage continued investigation into family violence and continued critical review of the results so that practitioners can make better informed decisions about practical criminal justice responses.
