Book The Emerging Law of Forced Displacement in Africa

Download or read book The Emerging Law of Forced Displacement in Africa written by Allehone M. Abebe and published by Routledge. This book was released on 2016-10-04 with total page 320 pages. Available in PDF, EPUB and Kindle. Book excerpt: As of the end of 2015, there were 40.8 civilians who had been internally displaced by conflicts and effects of natural disasters in various parts of the world. Internally displaced persons (IDPs) are currently the largest group of persons receiving assistance from some of the main international humanitarian organisations. With the largest concentration of internally displaced persons (IDPs), the African continent has been the worst affected region. While previously IDPs have largely been neglected under international law, the first-ever continental binding treaty on internal displacement, the African Union Convention on the Protection of and Assistance to Internally Displaced Persons (the Kampala Convention), entered into force on 6 December 2012. As of January 2016, 25 states have ratified the instrument while 40 states have become signatories. This book significantly contributes to the study, policy making and practice on managing internal displacement by presenting the first major systematic examination of the evolution, elements and implementation of the Kampala Convention. It explores the responsibility of the state for the protection of IDPs particularly those who are most vulnerable during armed conflicts, internal strife, natural disasters, human rights violations and other circumstances. The status of ratification of the Convention is reviewed as well as the steps currently being undertaken by governments to implement the Convention. It also analyses the contribution by human rights mechanisms, inter-governmental bodies and UN peace-keeping missions in the implementation of the Convention. The book casts the Kampala Convention in broader institutional and normative developments in Africa and beyond. It demonstrates how concepts such as ‘responsibility to protect’ and ‘sovereignty as responsibility’ have begun to make inroads; influencing some of the more progressive instruments adopted by the African Union. It also sheds light on the relationship between the Convention and some regional instruments. In assessing the effectiveness of the Kampala Convention Allehone Abebe argues that the link between the Convention and initiatives on development, human rights and governance in Africa should be fully fostered.

Book Intellectual Property and Emerging Technologies

Download or read book Intellectual Property and Emerging Technologies written by Matthew Rimmer and published by Edward Elgar Publishing. This book was released on 2012-01-01 with total page 499 pages. Available in PDF, EPUB and Kindle. Book excerpt: This unique and comprehensive collection investigates the challenges posed to intellectual property by recent paradigm shifts in biology. It explores the legal ramifications of emerging technologies, such as genomics, synthetic biology, stem cell research, nanotechnology, and biodiscovery. Extensive contributions examine recent controversial court decisions in patent law such as Bilski v. Kappos, and the litigation over Myriad's patents in respect of BRCA1 and BRCA2 while other papers explore sui generis fields, such as access to genetic resources, plant breeders' rights, and traditional knowledge. The collection considers the potential and the risks of the new biology for global challenges such as access to health-care, the protection of the environment and biodiversity, climate change, and food security. It also considers Big Science projects such as biobanks, the 1000 Genomes Project, and the Doomsday Vault. The inter-disciplinary research brings together the work of scholars from Australia, Canada, Europe, the UK and the US and involves not only legal analysis of case law and policy developments, but also historical, comparative, sociological, and ethical methodologies. Intellectual Property and Emerging Technologies will appeal to policy-makers, legal practitioners, business managers, inventors, scientists and researchers.

Book The External Dimension of the EU s Policy against Trafficking in Human Beings

Download or read book The External Dimension of the EU s Policy against Trafficking in Human Beings written by Chloé Brière and published by Bloomsbury Publishing. This book was released on 2021-04-08 with total page 279 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book explores the external dimension of the ambitious EU policy on human trafficking. Through this policy the EU institutions and Member States promote the eradication of human trafficking and support, to that end, cooperation with their partners, being third States or international organisations. Analysing the unilateral and multilateral mechanisms the EU uses to achieve these aims, the book questions whether the EU's external response to human trafficking addresses it in all its dimensions, and whether it does so in a coherent way. As a case study, the book explores the cooperation of the EU with countries of the Western Balkans, which constitutes a specific unilateral mechanism. The analysis of the multilateral mechanisms covers the cooperation of the EU with key international and regional organisations combating human trafficking, including but not limited to the Council of Europe or the United Nations Office on Drugs and Crime. The book also examines the impact of the evolution of migration flows and the increasing reliance of military tools on the EU's response to human trafficking.

Book Regulation in the European Electricity Sector

Download or read book Regulation in the European Electricity Sector written by Maciej M Sokołowski and published by Routledge. This book was released on 2016-02-22 with total page 209 pages. Available in PDF, EPUB and Kindle. Book excerpt: Since the very beginning of European integration, electricity has been within the legal sphere of the EU. Much of this is found within the binding European acts making up the framework of the Energy Packages. The established legal institutions have had a significant impact on the shape of the energy market in Europe. Nevertheless, the European energy market still seems to be developing, as demonstrated by the current lively discussion about the state of the Energy Union. Regulation in the European Electricity Sector delves into European energy law and reflects on some of the primary issues related to the public legal impact on the European energy sector. The book offers a brief explanation of the background operation of the electricity sector, as well as liberalisation within the area, and traces the evolution of the EU’s approach towards the issue of public law regulation within the electricity sector. Finally, the book presents an analysis of European and national laws, considering their interpretation, and explores the future of public law regulation. Aimed at giving the reader a deep insight into a nature of the state’s presence in the power sector, this book will be of great interest to students and scholars of EU energy law and policy.

Book Parliamentary Institutions in Regional and International Governance

Download or read book Parliamentary Institutions in Regional and International Governance written by Andrea Cofelice and published by Routledge. This book was released on 2018-09-25 with total page 165 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume offers an original and theoretically grounded conceptualization and measurement of international parliamentary institutions and their role in ensuring the accountability of regional international organizations. Through a comparative analysis of the establishment, evolution, institutional organization, oversight and policymaking functions of 22 parliamentary institutions, mainly from European, African and Latin American regional international organizations, the book serves a twofold purpose. First, it allows assessment of the extent to which parliamentary institutions have (measurable) influence on the outcome of regional organizations’ decision-making processes. Second, drawing on the literature on new institutionalism and comparative regionalism, the volume investigates the conditions under which the influence of parliamentary institutions is expected to grow, thus advancing the understanding of the variation and development of this poorly explored type of international institution. The book is aimed at scholars of global governance, international organization and comparative regionalism, and will also be of interest to parliamentarians and parliamentary practitioners from national and international institutions.
