Book Proceedings Actes et Documents of the XIXth Session of The Hague Conference on Private International Law

Download or read book Proceedings Actes et Documents of the XIXth Session of The Hague Conference on Private International Law written by The Hague Conference on Private Internat and published by BRILL. This book was released on 2006-10-31 with total page 747 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume of the Proceedings of the Nineteenth Session of the Hague Conference on Private International Law encompasses all preparatory work and records of meetings which led to the adoption of the Hague Convention on the Law Applicable to Certain Rights in Respect of Securities held with an Intermediary (the Hague Securities Convention). The signing of this Convention on 5 July 2006 by two of the world's major financial markets, the United States and Switzerland, shows the relevance of the new treaty. Traditional rules, based on physical transfers and direct holdings, are too diverse and inadequate to deal with securities which are nowadays transferred and pledged by electronic entries to accounts with clearing and settlement systems and other intermediaries. By identifying specific conflict rules, the Hague Securities Convention provides a means to remedy this lack of legal certainty which has characterized for too long the field of security transactions. The Proceedings will enable the financial world, but also legal practitioners and academics to grasp the background and full objectives of this very innovative international instrument.

Book Japan and International Law Past Present and Future

Download or read book Japan and International Law Past Present and Future written by Nisuke Ando and published by BRILL. This book was released on 2023-12-11 with total page 440 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is a record of the international symposium held at the Kyoto International Conference Hall to mark the centennial of the Japanese Association of International Law. The purpose of the symposium was to reflect on past Japanese practice, to analyze current problems affecting Japan, and to seek to clarify the future role of Japan in the global community, in terms of international law. After joining the international community in the middle of the nineteenth century, Japan adopted a policy of wealth creation and armament in order to maintain its independence against the expanding Western States. At the same time, on the domestic scene, Japan vigorously promoted the modernization - Westernization - of its political, economic, and social institutions. Japan emerged as one of the victorious `Principal Allied and Associated Powers' in World War I, and started asserting its place in the international order. However, in the aftermath of the Great Depression, Japan failed to reach agreement with the international community, eventually left the League of Nations, invaded the Asian continent, and met with complete military defeat in World War II. In the subsequent years, Japan toiled to rebuild its economy and to rejoin the world community, but despite its miraculous economic recovery and expansion, Japan remains ambivalent in its policy of contributing to the maintenance of international peace and security. During these one and a half centuries the Japanese practice of international law has covered a wide range of fields. From these various fields, the symposium took up three specific topics: War and Peace, Economy, and Human Rights, because of their relevance to past Japanese practice and because future Japanese practice in these areas would be bound to affect international law in the coming century. In addition, the symposium discussed Japanese transactions, in general, with international law. The period covered by the symposium has witnessed many drastic changes in the world, and international law, which used to be applied almost exclusively to relations among the Western States, has now come to be applied universally. The Association wished to emphasize that an analysis of Japanese practice should be of significance for anyone interested in promoting and consolidating the rule of law in the world community at large.

Download or read book Ageing Matters written by John Doling and published by Routledge. This book was released on 2018-01-18 with total page 205 pages. Available in PDF, EPUB and Kindle. Book excerpt: The implications of population ageing have long concerned politicians, policy makers and governmental and non-governmental organizations in the welfare states of Europe. However, an ageing workforce is increasingly a matter of concern for the developed and fast-developing countries of Asia. Japan leads the field in this respect on account of the speed of its postwar economic development. But the little tigers of Hong Kong, Singapore, South Korea and Taiwan are poised to catch up, and Malaysia, though in the second tier of developing Asian economics, faces the prospect of population ageing sufficient to daunt an as yet under-prepared infrastructure for old age support. This book is the first to examine in detail the experiences and prospects of population ageing in those Asian countries with the highest GDP per capita. The authors pose the question to what extent Asia and 'old Europe' can learn from each other in terms of policy planning. The first section of the book sets out the field in terms of the demographic characteristics and policy predicaments of European and Asian countries. The second section presents case-studies of six countries: Japan, Hong Kong, Singapore, South Korea, Taiwan and Malaysia.
