Book excerpt: This is the seventh report of the 2007-08 session from the Foreign Affairs Committee (HCP 147-I, ISBN 9780215521477) and focuses on the issue of Overseas Territories. Altogether 45 conclusions and recommendations are set out under the following headings, covering: constitutional relationships; governance; rule of law; human rights; environmental governance; contingent liabilities; sovereignty disputes. Specific recommendations include: that the Committee commends the Government's encouragement of Overseas Territories in reviewing their constitutions and setting out proposals for reform; that Gibraltar's presence on the UN list of non-self-governing territories is an anachronism; that territory governments should be given the opportunity to pass on their opinions of the candidates for Governor before appointments are made; that the FCO should ensure it takes Overseas Territories' interests into account in its relations with the EU; the Committee recommends that the FCO should strongly encourage all Overseas Territories to introduce freedom of information legislation; that the FCO must ensure that judicial decisions in Overseas Territories should not have any interference either from the Governor or the local government; that discrimination on the basis of sexual orientation or gender status should be made illegal in all Overseas Territories; the Committee believes the Government has been highly negligent in not carrying out a strategic assessment of Overseas Territories funding requirements for conservation and ecosystem managment; that Governors within Overseas Territories should use reserve powers to deal with irregularities, such as money laundering, in offshore financial services (for a related publication, see HCP 4, session 2007-08 NAO: Managing Risk in Overseas Territories). The Committee states that the Government has acted decisively in some Overseas Territories but in some other cases, has been too hands-off (eg. the corruption allegations on the Turks & Caicos Islands). Also that the choice of Governor for a Territory is crucial. Finally, the Committee deplores any retaliatory measures taken against indivduals who have assisted the Committee. Book excerpt: In 1965, the UK excised the Chagos Islands from the colony of Mauritius to create the British Indian Ocean Territory (BIOT) in connection with the founding of a US military facility on the island of Diego Garcia. Consequently, the inhabitants of the Chagos Islands were secretly exiled to Mauritius, where they became chronically impoverished. This book considers the resonance of international law for the Chagos Islanders. It advances the argument that BIOT constitutes a 'Non-Self-Governing Territory' pursuant to the provisions of Chapter XI of the UN Charter and for the wider purposes of international law. In addition, the book explores the extent to which the right of self-determination, indigenous land rights and a range of obligations contained in applicable human rights treaties could support the Chagossian right to return to BIOT. However, the rights of the Chagos Islanders are premised on the assumption that the UK possesses a valid sovereignty claim over BIOT. The evidence suggests that this claim is questionable and it is disputed by Mauritius. Consequently, the Mauritian claim threatens to compromise the entitlements of the Chagos Islanders in respect of BIOT as a matter of international law. This book illustrates the ongoing problems arising from international law's endorsement of the territorial integrity of colonial units for the purpose of decolonisation at the expense of the countervailing claims of colonial self-determination by non-European peoples that inhabited the same colonial unit. The book uses the competing claims to the Chagos Islands to demonstrate the need for a more nuanced approach to the resolution of sovereignty disputes resulting from the legacy of European colonialism.

Book excerpt: The Tokyo International Conference on African Development (TICAD) was established in 1993 with the intention of creating opportunities for trade and investment on both sides and the promotion of sustainable development. In 2003, the conference translated Japanese aid policy to Africa into three key pillars: human centered development, poverty reduction through economic growth, and the consolidation of peace, and since 2005 Africa has on several occasions been the largest recipient of Japanese overseas aid. Tracing Japanese foreign aid to Africa during and after the Cold War, this book examines how the TICAD process sits at the intersection of international relations and domestic decision making. Indeed, it questions whether the increase in aid has been driven by domestic changes such as demands from civil society and donor interest, or pressures emanating from the international system. Taking Angola and Mozambique as case studies, the book explores how Japan’s development cooperation with Africa has assisted previously war torn states make the transition from war to peace, and in doing so demonstrates the centrality of human security to Japanese foreign policy as a means of ensuring sustainable development.
