Book Overlap

Book excerpt: "The BC treaty process employs a model of claims negotiation new in the Canadian experience. Contrary to long-standing federal claims policy, treaties are being settled in areas where multiple indigenous groups lay claim to the same territory. Drawing on theories of human territoriality, critical legal geography, and indigenous geography, this thesis examines the indigenous socio-spatial identities at work within (and beyond) the BC treaty process, the spatial dimensions of aboriginal rights as articulated by Canadian courts, and BC Supreme Court actions that have arisen because of overlapping claims. Two overarching goals of the BC treaty process are to achieve certainty of jurisdiction and to avoid aboriginal rights litigation. This thesis concludes that insufficient Crown and judicial engagement with the issue of overlapping claims undermines both of these goals."--P. ii.

Book Aboriginal Rights Claims and the Making and Remaking of History

Download or read book Aboriginal Rights Claims and the Making and Remaking of History written by Arthur J. Ray and published by McGill-Queen's Press - MQUP. This book was released on 2016-06-01 with total page 361 pages. Available in PDF, EPUB and Kindle. Book excerpt: Forums such as commissions, courtroom trials, and tribunals that have been established through the second half of the twentieth century to address aboriginal land claims have consequently created a particular way of presenting aboriginal, colonial, and national histories. The history that emerges from these land-claims processes is often criticized for being “presentist” – inaccurately interpreting historical actions and actors through the lens of present-day values, practices, and concerns. In Aboriginal Rights Claims and the Making and Remaking of History, Arthur Ray examines how claims-oriented research is often fitted to the existing frames of indigenous rights law and claims legislation and, as a result, has influenced the development of these laws and legislation. Through a comparative study encompassing the United States, Canada, South Africa, Australia and New Zealand, Ray also explores the ways in which various procedures and settings for claims adjudication have influenced and changed the use of historical evidence, made space for indigenous voices, stimulated scholarly debates about the cultural and historical experiences of indigenous peoples at the time of initial European contact and afterward, and have provoked reactions from politicians and scholars. While giving serious consideration to the flaws and strengths of presentist histories, Aboriginal Rights Claims and the Making and Remaking of History provides communities with essential information on how history is used and how methods are adapted and changed.

Book Dividing the Union

Download or read book Dividing the Union written by Matthew W. Hall and published by SIU Press. This book was released on 2016 with total page 290 pages. Available in PDF, EPUB and Kindle. Book excerpt: The first indepth examination of the architect of the Missouri Compromise In 1820 the Missouri controversy erupted over the issue of slavery in the newly acquired lands of the Louisiana Purchase. It fell to Jesse Burgess Thomas (1777-1853), a junior U.S. senator from the new state of Illinois, to handle the delicate negotiations that led to the Missouri Compromise. Thomas's maturity, good judgment, and restraint helped pull the country back from the brink of disunion and created a compromise that held for thirtyfour years. In Dividing the Union, Matthew W. Hall examines the legal issues underlying the controversy and the legislative history of the Missouri Compromise while focusing on Thomas's life and influence. As Hall demonstrates, Thomas was perfectly situated geographically, politically, and ideologically to deal with the Missouri controversy. The first speaker of the Indiana Territorial General Assembly and one of the first territorial judges in Illinois Territory, Thomas served in 1818 as the president of the Illinois State Constitutional Convention. That he was never required to clearly articulate his own views on slavery allowed Thomas to maintain a degree of neutrality, and, as Hall shows, his varied political career gave him the experience necessary to craft a compromise. Thomas's final version of the Compromise included shrewdly worded ambiguities that supported opposing interests in the matter of slavery. By weaving Thomas's life story into the history of the Missouri Compromise, Hall offers new insight into both a pivotal piece of legislation and an overlooked but important figure in nineteenthcentury American politics.
