Generally, the reason for OT authority is that the government needs to obtain leading edge R&D and prototypes from commercial sources, but some companies are unwilling or unable to comply with the government's procurement regulations. Available in PDF, EPUB and Kindle. Book excerpt: Other Transaction Authorities (OTAs) have become a core element of the Department of Defense’s (DoD) approach to technology acquisition. DoD OTA obligations increased 75 percent in fiscal year 2019 and have increased 712 percent since FY 2015. The Army remains the predominant awarder of OTAs largely due to the efforts of Army Contracting Command New Jersey, which is headquartered out of Picatinny Arsenal, but the other DoD components are starting to catch up. A new research and development (R&D) funding paradigm between contracts and OTAs might be consolidating, with OTAs increasingly replacing contracts in the mid-to-late stages of the development pipeline for major weapon systems. In FY 2015, OTAs accounted for just three percent of DoD’s total R&D portfolio. Comparatively, in FY 2019, OTAs totaled 18 percent of DoD’s total R&D portfolio. OTA consortia are becoming central players in the technology marketplace. The majority of OTA obligations in recent years were awarded to consortia, accounting for 57 percent of DoD OTA obligations between FY 2015 and FY 2019.

Book excerpt: Department of Defense (DoD) Science and Technology (S & T) programs seek and need the best research and technology, most of which serves the needs of the commercial marketplace. DoD had limited access to these non-traditional performers because many would not accept the onerous requirements imposed by contracts issued under the rules of Federal Acquisition Regulations. In 1989, Congress provided "Other Transaction Authority" (OTA) to address this problem. OTA provided a procurement vehicle which minimized the laws and regulations applicable to contracts, grants, or cooperative agreements. This study examined all DoD reports submitted to Congress detailing Cooperative Agreement and "Other Transaction" awards for fiscal years 1997-2003 to determine the extent to which the objectives of the OTA legislation were achieved. The researcher found that only 11 percent of the awards went directly to "non-traditional" contractors, the remaining 89 percent going to traditional defense contractors. Only one-tenth of one percent of all DoD "Research, Development, Test & Evaluation" funding in those fiscal years, awarded in the form of cooperative agreements or :other transactions," went directly to "non-traditional" contractors. Thus, OTA has proved ineffective at attracting "non-traditional" contractors to DoD S & T projects.

Under this authority, projects are not required to comply with procurement-specific laws and regulations. In effect, OT authority provides a blanket waiver of laws such as the Truth in Negotiations Act and the Competition in Contracting Act, and regulations such as the Federal Acquisition Regulation (FAR), and the defense supplement to the FAR. A principal objective of the legislation was to enable and encourage a broader range of commercial firms to participate in developing defense systems, thus bringing to such programs similar advanced technologies being developed for the commercial markets. During the 1994-1998 time period, 72 such projects began. RAND was asked by DoD to assess the experience provided by those projects. The objective of this assessment was to determine the overall effectiveness of this new acquisition approach. Specifically: Do the benefits expected from relaxing the process controls justify the possible costs that might be incurred? We conducted this assessment by performing a detailed examination of 21 projects, comprising about one-third of the total population that had accumulated some track record by late 1999. We addressed four topics: (1) What were the general characteristics of typical OT agreements? (2) What benefits appear to have been achieved through use of the OT process? VIII Assessing the Use of 'Other Transactions' Authority for Prototype Projects (3) Were there any apparent disadvantages encountered, and specifically were government interests appropriately protected? (4) What were the net effects after balancing the apparent advantages and disadvantages?

As such, they are not required to comply with the Federal Acquisition Regulation (FAR), its supplements, or laws that are limited in applicability to procurement contracts.
